突遇出⼝退税取消,出⼝税率发⽣变化,如何要求和客户平分损失

I’m sorry Sir, I’m afraid I have bad news for you.
On the 27th of April, we heard the con rmed news that the Chinese treasury
department will cancel the tax rebate on selected Iron and Steel items. And it
happened on the 1st of May, leaving us only 3 days, a very short notice period. For
HR, GI and PPGI, it’s used to be a 13% rebate rate, which means after exporting
the cargo, we can collect 13% of the sales amount back from Chinese customs.
However, this number today is 0.

And unfortunately, one of our orders is a ected. We have an order of GI coils,


216mt, production is nished but we did not yet clear the cargo. Due to such
sudden tax rebate cancellation, we will have to su er approximately 130-140 USD/
mt pure loss.

As you know, we are decent businessmen. We always honour our contract once
we put our signature on it. If we found any quality defects, we will replace the
unquali ed material at our own cost; if we found packing damage, we will arrange
packing again without even informing you.

However, we understand sudden tax rebate cancellation, is just like war, strike, and
port congestion, which are totally out of our control and can be contributed as
Force Majeure, in another word, an act of God.

According to our Force Majeure terms and condition, we hereby present you the
fact and o cially request to renegotiate the price. Regarding the shipment, we will
clear the cargo and send them to the port waiting for the rst available vessel.
However, we can only ship that cargo until we reach a mutual agreement on a
revised price because we are not able to handle a such a huge loss by ourselves.

Our suggestion would be we share the loss by 50% and 50%. And we hope you
can understand our hard situation and help with it together.
