EXTRA JUDICIAL SETTLEMENT OF REAL ESTATE BY WITH

DEED OF DONATION
KNOW ALL MEN BY THESE PRESENTS:

This Extra-Judicial settlement with Deed of Donation made and executed by

and among;

GLORIA ALARCON, of legal age, Filipino citizen, with postal and

residence address at San Juan Bautista, Goa, Camarines Sur,
Philippines;

DAVID ALARCON, of legal age, Filipino citizen, with postal and

residence address at San Juan Bautista, Goa, Camarines Sur,
Philippines;

HERCULES ALARCON, of legal age, Filipino citizen, with postal and

residence address at San Juan Bautista, Goa, Camarines Sur,
Philippines; and

ANITA ASHA ALARCON, of legal age, Filipino citizen, with postal and
residence address at San Juan Bautista, Goa, Camarines Sur,
Philippines, hereinafter referred to as HEIRS and DONOR’S

BARANGAY LOCAL GOVERNMENT UNIT OF BRGY. SAN JUAN

BAUTISTA, GOA, CAMARINES SUR represented by HON. REY
RAFAEL DIAZ CABALLERO, also of legal age, Filipino citizen, and
incumbent Punong Barangay of San Juan Bautista, Goa, Camarines
Sur, Philippines; hereinafter called the DONEE;

---WITNESSETH---

That the above-named person are the biological children and legal heirs of
Abelardo Alarcon, who died on __________________ at _____________,
Goa, Camarines Sur which was his residence at a time his death leaving no will or
testament whatsoever;

That to the best of their knowledge and information, the above mention
decedent had no debts or obligations to any agencies and persons;

That the above- named decedent left the parcel of land situated at San Juan
Bautista, Goa, Camarines Sur, Philippines, and which are more particularly
described as follows to wit;

“A PARCEL OF LAND designated as Lot No. 1327, Cad-339, Goa

Cadastre situated at San Juan Bautista, Goa, Camarines Sur. Bounded
as follows; on the NORTH by property of Apolinar Pan; on the EAST by
property of Perpetua Rodriguez; on the SOUTH by a Creek; and on the
WEST by Bernardo Palma. This parcel of land is declared under the
name of Abelardo Alarcon covered by Tax Declaration bearing No.
2016-16-032-00273 with marked assessed value of P 6,290.00”

That the above-described parcel of land was free from any liens and
encumbrances whatsoever in nature;

That the deceased left no other debts or obligations chargeable against this
property neither personal property are included herein;

That pursuant to Rule 74 Sec. 1 of the Rules of Court of the Philippines and
all parties being with full capacity to contract, they do hereby agreed to settle and
partition the above properties equally among theirselves, subject herein to the
liabilities imposed by Sec. IV, Rule 74 of the Rules of Court in favor of any possible
heirs, creditors and other persons who might be deprived of their lawful
participation of the estate of the decedent for a period of two years;

WITHNESSETH FURTHER

That for and in consideration of the love and affection which the above
mentioned Donors have for the Donee, the said Donor by these presents Transfers
and Conveys, by way of Deed of Donation, into the said Donee, his successor and
assigns an integral portion of the above-cited property containing an area of
________________ (_______) SQUARE METERS more or less, free from all
liens and encumbrances.

That the parcel of land donated for the construction of pathways or Brgy.
Road for the benefits of residents of Brgy. San Juan Bautista, Goa, Camarines Sur
and other neighborhood barangays.

That the Donee hereby assumes all financial and legal expenses relative to
this Deed of Donation and so as to give effect thereof.

That the Donee does hereby accept this Donation of the above-mentioned
land and does hereby expresses its appreciation and thanks for the kindness and
liberality of the Donor. That the above-described parcel of land was free from any
liens and encumbrances whatsoever in nature
