STATUTORY DECLARATION

I JOSEPH BOSSA of care of Messrs. Katende, Ssempebwa and Company


Advocates P.O. Box 2344 KAMPALA do hereby solemnly declare and state on
oath that:

1. I am a male adult Ugandan of sound mind and legal Counsel for Bank of
Uganda as such I make oath under this statutory declaration as such.

2. That sometime in 1995 the registered proprietor of the above described land
filed a suit against Bank Of Uganda which suit he received judgment against
the Bank of Uganda vide Civil suit No 725 of 1995.

3. That under the judgment Bank of Uganda was to refund the deducted housing
loan to the registered proprietor upon which the registered was to execute
legal mortgage in favour of Bank of Uganda.

4. That at the time of judgment Bank of Uganda had the certificate of title for the
above-mentioned land originally mortgaged to Bank of Uganda by way of
equitable mortgage.

5. That at the time of the judgement the registered proprietor had passed way
the Administrator General was appointed vide Administration Cause No 504
of 1997 to run the registered proprietor’s estate. Copy of the Letters of
Administration is attached as “annexture A”.

6. That the administrator General through the estate’s Advocates Messrs.


Emoru and company Advocates indicated to Messrs. Katende, Ssempebwa
that the estate was not interested in being refunded the deducted housing
loan as such, Messrs. Emoru and company Advocates were handed the
above referred certificate of title.

7. That after a few months, the registered proprietor’s estate through Messrs.
Emoru and Company Advocates turned around and demanded for the refund
of the deducted housing loan. Copies of the letters demanding for the same
are attached herewith and marked as “annexture B”.
8. That through Miscellaneous Application No1552 of 1999 for notice to show
why execution should not issue. Bank of Uganda through its Lawyer Messrs.
Katende, Ssempebwa and Company Advocates refunded the registered
proprietor’s estate the deducted housing loan and obtained an undertaking
that the certificate of title shall be returned for the registration of mortgage in
favour of Bank of Uganda. Copies of the refund of the deducted loan and
acknowledgement of receipt incorporating the undertaking are attached
hereto and marked as “Annexture C”.

9. That todate the certificate of title has never been returned to bank of Uganda
through the Bank’s lawyers.

10. Wherefore I depone this statutory declaration in support of Bank of Uganda’s


caveat preventing any dealing in the above-referred land without notice to
Bank of Uganda at the address indicated.

11. That is stated above is true and correct to the best of my knowledge and
belief.
