FISHERIES ADMINISTRATIVE ORDER NO. 263

FAO 263 (January 28, 2019)

Subject: Establishment of Fisheries Management Areas (FMA) for the Conservation and

Management of Fisheries in Philippine Waters.

I. ABOUT

• FAO 263 addresses illegal fishing, and mainstreaming science-based management of

Fisheries, as it directs all coastal LGU to take on shared responsibilities for the conservation

and sustainable management of shared fishery management area (FMA).

• Established 12 Fisheries Management Area (FMA) in considerations to the stocks of

boundary/range/distribution, structure of fisheries, administrative divisions, and

consultations with stakeholders, and creates a framework for their management in the form

of implementing rules and regulations.

• Provides science-based participatory and transparent governance framework to

sustainably manage fisheries in each areas.

II. STRENGTHS

• Focuses not only on the sustainable harvest of target species, but also on addressing

illegal fishing, and conserving the ecological balance of the Philippine water by establishing

FMS rules and regulations.

• Emphasizes and adopts the ecosystem approach to fisheries management, which

balance environmental and socioeconomic concerns, and achieve effective conservation

and management of fish stocks.

• Introduces a science-based approach by the use of scientific studies and data as

provided by Scientific Advisory Group (SAG) for the purpose of implementing rules and

regulations.

III. WEAKNESSES

• Does not ensure the cooperation between local governments, national agencies, and

small fisheries.

• Maximum harvest for every fishermen are not specified in the Harvest Control Rule

(HCR).

• Transparent implementations of FMA are not assured.

• Local Government Units (LGUs) and small-scale fishermen have little or no sufficient

awareness regarding the implementation of FAO 263.

• The administrative order does not include penalties for individuals who will not obey

the rules and regulations of FMA, and the Fisheries Administrative Order 263 itself.

IV. RECOMMENDATIONS

• Include penalties for those who disobey, and commits any of the prohibited acts of

this FAO.

• Strengthen the LGU's awareness regarding the implementation of FAO 263 by

providing information, communication, and education materials.

• Ensure transparency and strict implementation of the rules and regulations as

provided by the Management Body (MB) of each FMA.

• Strengthen partnerships among individuals involved.

• Provide full budgetary support and allocation for more effective implementation of

FMA.

• Provide detailed information for the implementation of Harvest Control Rule (HCR).
