The expressions 'FIRST PARTY' and 'SECOND PARTY' shall mean and include their

Mr. Subal Sai have full
legal right for mortgage of said unit.

First party is accepting payment (mortgage) for personal use on the behalf of Flat No.
s02, Tower - H(8) Lotus homz (society) sector 111, Gurgaon Haryana-122001.
Mr. Subal Sai is
accepting for return this amount with 10
percent monthly
interest. If Mr. Subal Sai is failed to return of received amount in (April 2022 to
July 2023) then First party is bound for transfer/sell the same property to the
SECOND PARTY at the total cost of Rs.
36,00,000/- (Rupees Thirty-Six lacs
Only) on the following terms and conditions. If First party ready for sale of mortgage
property to second party then first party is not liable for paying any interest to second

party on mortgage money

2 That the First Party has Received the amount of Rs. 14,00,000/- (Rupees Fourteen
lacs Only) as loan/Earnest Money from the Second Party. First Party Received

If First party is ready for transfer on the name second party then on the following term
and conditions:-

This consideration has been arrived at all inclusive


of extras (not limited to) paid
by the First Party as of date of transfer ( EDC/IDC, PLC, ECC, IFMS transfer
charges & GST as per the builder buyer agreement payment categories) of the flat
comprised in the said project property (i.e. all charges (except Stamp Duty &
Registration amount) including Penalties, Interest, Misc Builder Charges if any
payable for getting possession of said Property shall be included in total

consideration amount).

The First Party will be bear any other charges like transfer charges, GST or any
interest/Penalty and Any maintenance charges demanded by Builder which may
be due and payable to the Developer under the Flat Buyer's Agreement up to the
date of transfer of the said property in the records of the Developer.

That the original set of documents Like Registry which include the Flat-Buyer's
Agreement, all original receipts and the original allotment letter, possession letter

will be handed over by the First Party to the Sccond Party.

3 That in case the First Party refuses to get the transfer of the said property in favour
of the Second Party within the above specified period, for any reasons whatsoever,
the Second Party has right to get the Sale Deed/transfer registered, through SPECIFIC
PERFORMANCE OF CONTRACT by Court of Law at the cost and expenses of the
First Party.

4. The Second Party is empowered to get the property registered or get the sale
completed through execution of Attorney documents etc. either in his/her own name

or in the name of any nominee (S) & other person, for which the First Party shall
have no objection

5. All the expenses in


respect of Registration of Sale Deed/ Attorney documents, Stamp
Duty, Registration Charges and other Misc. expenses shall be borne by the Second
Party.

6. That the First Party hereby confirms that the said property is free from any
encumbrance, sale, gift. liens, court injunctions, attachments
indemnify the Second Party against any actual loss, cost or damages ifMortgage(loan)
any sustained
by the Second Party as a result of
any breach of this representation by the First party
AND all the outstanding dues
against the said property shall be cleared/paid by the
First Party upto the date of
Registry
