WHEREAS M/S Good Luck Corporation, address: 18/2, Armenian Street, P.S Kotwali, Dacca-1, obtained the
scheduled 1 bigha 5 katha land through Lease Deed being No. 10090, date-30/05/1969.

AND WHEREAS pursuant to Bangladesh Abandoned Property (Control, Management and Disposal) Order, 1972,
(P.O. NO. 16 of 1972) the said M/S Good Luck Corporation had been declared as abandoned property and vested in
the Government of the People’s Republic of Bangladesh with all its assets including the scheduled land.

AND WHEREAS in pursuance of the decision of the Government under the policy of disinvestment of the
abandoned properties, Government had proposed to sell the demised land to the highest offer.

AND WHEREAS M/S Nahaman Industries offered to purchase the land and in consideration of highest offer
People’s Republic of Bangladesh represented by Section office, Ministry of Industries executed and registered a
Deed of Sale being No. 18415, date on 22/06/1974 in favour of M/S Nahaman Industries. Thereafter they have
muted their name through the mutation case No. 18837/89-90, date-27/04/1990 and have been paying Khajna and
thus they became owner in exclusive peaceful, uninterrupted and physical possession and enjoyment over the
Schedule – A land.

AND WHEREAS the FIRST PARTY/LAND OWNER desirous for constructing a 35-(B1+B2+B3+B4+B5+G+34)
stories commercial building, subject to plan approved by Rajdhani Unnayan Kartripakkha (RAJUK) hereinafter
called, on the land described in schedule ‘A’ to this deed of agreement consisting of commercial spaces ground floor
to top floor and car parking spaces at five basements described more fully in schedule below to this Deed of
Agreement which the FIRST PARTY/LAND OWNERS cannot undertake itself due to its other engagements.

AND WHEREAS the SECOND PARTY / DEVELOPER has agreed to undertake construction of the proposed 35-
(B1+B2+B3+B4+B5+G+34) stories commercial building on the schedule ‘A’ land at its own cost as per terms and
conditions contained herein.

Now it is necessary to we do hereby remove and cancel all the powers and authorities given by us to AMIN
MOHAMMAD FOUNDATION LTD., having its regd. office at 752, Satmasjid Road, P.S.-Dhanmondi, Dist.-
Dhaka, by virtue of a Power of Attorney registered on --------------------being no.------------ in the office of the Sub-
Registrar, Sutrapur, Dhaka, wherein we have appointed AMIN MOHAMMAD FOUNDATION LTD. as our
Lawful Attorney and agent to do, execute and perform all acts, deeds and things, therein recited relating to all that
piece and parcel of land measuring of ----------- katha more described in the schedule.

AND WHEREAS under changing circumstances AMIN MOHAMMAD FOUNDATION LTD. and
we/ Landowners have decided to cancel the said Joint Venture Deed of Agreement.

NOW THIS DEED WITNESSETH:


That we hereby cancelled the said Deed of Agreement deed no. 3136 being no 24/12/2020 absolutely and
completely revoked all power of authority thereby and there under given to our said Attorney either
expressly or impliedly to all intents and purposes.

IN WITHNESSES whereof, we have signed this Deed of Cancellation of the Deed of Agreement in
presence of the following witness on this the day, month and year first above written.

All that piece or parcel of land containing by admeasurements 25 katha or equivalent to 41.25 decimal or thereabout
situated in the P.S. Tejgaon Industrial Area, District- Dhaka, Sub-Registration office- Tejgaon, Mouza- Tejgaon
I/A, being Plot No # 247, Mutation Case No. 9467/2020-21, date-11/04/2021, Zot No. 660, is covered by this Deed
of Agreement.

Uddin & Late Nasima Begum, date of birth: (1) 24/10/1983 & (2) 24/06/1982, address of: House # 07, Road #
Goura Sundar Ray Lane, P.S. # Posta-1211, Dhaka South City Corporation, Dhaka, NID of both: (1) 3258187198 &
(2) 9108158073, Nationality- Bangladeshi by birth and do hereby solemnly affirm and declare as follows:

1. That we are the permanent residents of Bangladesh.

2. That the immovable property mentioned in the deed or property


a) That this is not abandoned property within the meaning of Bangladesh Abandoned Property Order, 1972
(P.O. No.16 of1972).
b) is not under attachment under P.O. No. 8 of1972.
c) has not vested in or does not stand forfeited to the Govt. under any law for the time being in force..
d) has been correctly described as the declarents have atonable right in such property.

3. That property mentioned in the schedule of deed does not contravene any provision of any other law for the
time being in force.

4. That property is not liable to be void under Article 5A of Bangladesh Land holding (Limitation) order, (P.O.
No. 98 of1972).

We do also hereby solemnly affirm and declare as follows:

That we are the owners of the transferred land/ property, none else having any portion of ownership in this land/
property and no Baina Agreement was signed with any other party or this land was sold elsewhere or was not kept
under mortgage to any other party or this land/ property is not any Government khas / vested land or abandoned
property or was not vested to the Government in any way. We hereby declare that if any information furnished
above was recorded wrongfully, we will be liable for the same and civil and criminal both cases may be lodged
against us and we will be liable to make payment of compensation. We hereby further declare that if any wrong,
false, fabricated information was furnished about the land / property. We will be liable to make correction of the
same at our own expense including making payment of compensation and make fresh Deed with registration. This
is to mention that value of the property has not been shown less in this Deed.

That we have the legal title and right in the property mentioned in the schedule of the Deed and the statements made
above are true to our knowledge and we sign this Affidavit before the Authority concern, this the …..… day of
