1S LEAVE AND LICENSE AGREEMENT is made at Mapusa
day of month of May of the year 2023.
on this 1st

BETWEEN

MR. GAUTAM GAJANAN MANDREKAR, S/o. Mr. Gajanan


Mandrekar, aged about 32 years, service, unmarried, Indian
National, resident of H. No. 257, Kattewada, Morjim, Pernem -
Goa, shall be hereinafter referred to as THE LICENSOR'(which
expression shall unless. repugnant tothe context or meaning
thereof shall include their heirs, successors, administrators
and legal assign) of the ONE PART.

AND

MR. SIDDINATI AJAY SAI KUMAR, s/o. Mr. Prakash Siddinati,


aged about 28 years, married, Indian National, holder of Aadhaar Card
bearing No. 9551 6562 9977, permanent rlo. 3-59, adimulavari thota,
kajuluru Mandalam, Gollapalem, East Godavari Andhra Pradesh
533468, shall be hereinafter referred to as THE LICENSEE

WHEREAS the LICENSOR is the lawful owner in physical possession


of the house bearing No. 223/1, admeasuring an area of 55 sq. mts.,
constructed in the Property bearing Survey no. 87/1, Plot no. 66,
admeasuring an area 405 sq. mtrs. Situated at Mushirwado, Colvale,
Mapusa, Bardez-Goa, wherein there are rooms.

AND WHEREAS there are following items of the LICENSOR


in the Said Room:

1. Bed.
2. Sofa
3. LPG Cylinder

AND WHEREAS the LICENSEE has approached the LICENSOR for


taking on Leave and License basis the Said Room for the residential
Purpose on the compensation of Rs. 9,500/- (Rupees Nine Thousand Five
Hundred Only) per month for a period of 11 months from 01/05/2023 to
31/03/2024.

AND WHEREAS the LICENSORS have accepted the offer of the


LICENSEE and have agreed to give on License basis the said House for

AND ¾REAS the LICENSOR has agreed to the same and


hence, the present Leave and License Agreement is executed
on the following terms and conditions.

NOW THIS AGREEMENT WITNESSES AS FOLLOWS:

1. The LICENSOR hereby give to the LICENSEE the said House on


Leave and License basis for a period of 11 months, commencing from
01/05/2023 to 31/03/2024.

2. The License fee shall be Rs. 9,500/- (Rupees Nine Thousand Five
Hundred Only) per month, payable before 10th of every month.

3. The LICENSEE has paid a sum of Rs. 20,000/- (Rupees Twenty


Thousand Only) as a deposit which will be refunded at the time of expiry
of the Agreement and will not be adjusted towards the rent.

4. The License is strictly for a period of 11 months, commencing from


01/05/2023 to 31/03/2024 which will beterminated after the expiry of 1
months.

5.The Lese cehisE Agreement may be renewed after the expiry of
the 11 monthsat theinstance of the LICENSOR with 20% enhancement
in the rent.

6. The LICENSEE shall be entitled to use the goods as stated hereinabove.


If any damage is done to the goods than the same will be made good by
LICENSEE at the cost ofLICENSEE.

7. The Electricity charges, water charges, internal maintenance etc., shall


be borne by the LICENSEE.

8. The LICENSORS shall refund the security deposit of Rs. 20,000/


(Rupees Twenty Thousand Only) at the time of the expiry of the
Agreement to the LICENSEE without any interest.

9. This Agreement is by way of leave and license only and shall not be
constructed to be a lease or tenancy.

10. The LICENSEE shall maintain the licensed premises in good


condition and will not cause any damage thereto. If any damage is caused
to the premises or any part thereof by the LICENSEE of his employees or
agents, the same will be made good by the LICENSEE at the cost of the

11. If the LICENSEE commits breach of any terms ofthis Agreement, the
LICENSOR will be entitled to terminate this Agreement even if the
period mentioned above remains to expire by giving 15 (fifeen) days
prior written notice to that effect to the LICENSEE and on the expiration
ofthe Said period of 15(fifteen) days the License will stand terminated.

12. It is specifically agreed and understood that this Instrument of


License which is executed for a period of 11 months shall not be
constructed as a lease or a grant and there shall be n0 room for any other
interpretation of this document, this document being an instrument of
license, governed under the Indian Easement Act 1882.

13.The LICENSEE shall allow the LICENSOR to inspect the above said
House whenever is required by the LICENSOR.

14. The LICENSEB is strictly forbidden from subletting or parting with


the possession for said House in favour of any 3rd party.

15. Both the parties are required to give one month written notice in
advance if either party desires to terminate the Agreement.

16. It is hereb)lyndeod and'agreed between the parties hereto that the
License hereb eted is personal, only to the LICENSEE and that
nothing in these presents shall be constructed to confer legal right or
tenancy upon the LICENSEE or any interest of whatsoever nature in the
said House, except the right of occupation of the said House temporarily,
only at the pleasure and will of the LICENSOR, subject to the terms and
conditions of this Agreement.

17. It is hereby agreed by LICENSEE that the Said house is taken on


Leave and License basis for the residence purpose wherein only one
person will stay and if any increase in the number of the persons will be
informed by the LICENSEE tothe LICENSOR with ten days prior notice
and with all the identity proof documents of the new person.

IN WITNESS WHEREOF both the parties have made and


signed this LEAVE AND LICENSE OF AGREEMENT on the day,
month and year hereinabove mentioned and after Fully
understanding the contents thereof and in presence of the two
attesting witnesses who have signed herein below.
