Learning Objectives:
At the end of this chapter, the learners are expected to

1. determine the provisions of the revised Implementing Rules and

Regulations (IRR) of R.A. No. 9163;
2. justify the impact of R.A. No. 9163 on community service-learning; and

3. develop an active role and participation in community or civic affairs.

GETTING STARTED
This chapter deals with the latest Implementing Rules and Regulations (IRR) of R.A. No. 9163,
otherwise known as the National Service Training Program (NSTP) Act of 2001, which was
issued on November 13, 2009. The Commission on Higher Education (CHED), Technical
Education and Skills Development Authority (TESDA); and Department of National Defense
(DND), in cooperation with other concerned government agencies, the Philippine Association
of State Universities and Colleges (PASUC), the Coordinating Council of Private Educational
Associations of the Philippines (COCOPEA), non-governmental organizations (NGOs), and other
well-known organizations, jointly issued, adopted, and promulgated the aforementioned IRR
for NSTP.

According to Section 9 of Article II of the 1987 Constitution:

The State shall promote a just and dynamic social order that will ensure the
prosperity and independence of the nation and free the people from poverty through
policies that provide adequate social services, promote full employment, a rising
standard of living, and an improved quality of life for all.

The Principle behind R.A. No. 9163

Section 1 of the IRR of the NSTP Law states that "[while it is the prime duty of
the government to serve and protect its citizens, in turn it shall be the
responsibility of all citizens to defend the security and promote the general
welfare of the State, and in fulfillment thereof, the government may require
each citizen to render personal military or civil service."

NST on the Role of the Youth
Section 2 of the IRR of the NST Law provides the following:

1. In recognition of the vital role of the youth in nation building, the State shall promote
civic consciousness among them and shall develop their physical, moral, spiritual,
intellectual, and social well-being. It shall inculcate the ideals of patriotism [and)
nationalism and advance their involvement in public and civic affairs.

2. As the most valuable resource of the nation, they shall be motivated, trained,
organized, and involved in military, literacy, civic welfare programs and other similar
endeavors in the service of the nation.

Components of NSTP of R.A. No. 9163:

1.Reserve Officers' Training Corps (ROTC)
2. Civic Welfare Training Service (CWTS)
3. Literacy Training Service (LTS)

Coverage of the NST Law

The coverage of the NSTP Law is provided in Section 4 of the IRR as follows:

1. All incoming freshmen students, male and female, starting School Year
(SY) 2002-2003, enrolled in any baccalaureate and in at least two (2) year
technical-vocational or associate courses, are required to complete one NST
component of their choice as a requirement for graduation.

2. All higher educational institutions including State Universities and
Colleges (SUCs) and technical-vocational education institutions must
offer upon enrollment, all the three NSTP components. However, state
universities and colleges (SUCs) are required to provide and maintain
the ROTC component.

3.The Philippine Military Academy (PMA), Philippine Merchant Marine
Academy (PMMA), Philippine National Police Academy (PNPA) [are]
exempted from the NSTP in view of the special character of these
institutions. Other State Universities and Colleges of similar nature will be
exempted subject to approval of the Department of National Defense.

4.Private higher educational institutions (HEIs) and technical-vocational
education institutions with at least 350 student cadets must
establish/maintain a Department of Military Science and Tactics (DMST),
subject to existing rules and regulations.
