Microsoft Research Project Participation Form
Thank you for volunteering to participate in a Microsoft Corporation (“Microsoft”
or “we”) Research Project. Microsoft values your opinion. Your experiences and
feedback will help us, for example, improve features and functionality of our
products and services and help shape the future of our technology. Below are the
terms that apply to your participation. Please read these terms carefully and
confirm your understanding and that you agree to them by signing this form, which
makes a binding agreement between you and Microsoft.
 Your Participation. In the Research Project, Microsoft will be learning about
your opinions on and experiences with various technologies, products, and services.
You may be invited to participate in a variety of activities, such as focus groups,
interviews, at-home use of Microsoft offerings, and interactive experiences at
various locations. Your participation is entirely voluntary—you can decide not to
join at all or you can drop out later. Microsoft is not obligated to include you
and can remove you from the Research Project at any time.
 Gratuities or Payment. Whether or not Microsoft offers you a gratuity or payment
(e.g., a gift card), for your participation or services provided by you in
connection with this Research Project you understand that you will get the benefit
of the opportunity to influence the direction of technology developments, and that
Microsoft will expend time and incur costs in reliance on your consent to this
form. Microsoft is not obligated to further compensate you for your participation
or for the use of your feedback, data, or media created in connection with the
Research Project. If you are a public school or government employee, it is the
intent of Microsoft that any payment for services provided by you in connection
with this Research Project comply with all applicable laws, regulations and ethics
rules of your organization, and any such payment is not intended to influence
decisions about Microsoft’s business. You are solely responsible for ensuring that
accepting payment complies with any applicable ethics policies or regulations of
your organization. If not approved by your organization, please do not accept such
payment and return the payment to Microsoft.
 Feedback, Research Results, and Research Media. As part of the Research Project,
you may give us written answers, suggestions, comments, or feedback (“Feedback”).
Providing Feedback is voluntary. Microsoft may use, disclose, reproduce, license or
otherwise distribute Feedback without further obligation to you or restriction of
any kind. Microsoft may produce research data and analysis and other results
generated from the information you provide and your participation in the Research
Project (“Research Results”). Microsoft may make audio or video recordings of your
activities, take photographs and screen shots, or record technical data during the
Research Project (“Research Media”). You agree to permit this recording and grant
Microsoft the right to include your name, voice, image, biographical information,
and likeness in the recording. You acknowledge that Microsoft owns the recording
and consent to Microsoft’s use of this recording for research and other business
purposes. You consent to Microsoft’s collection, creation, and use of Feedback,
Research Results, and Research Media, including sharing with third parties, for
research, promotional, or other business purposes. Any Feedback, Research Results
or Research Media Microsoft may share with third parties will be anonymized and/or
aggregated and Microsoft will protect your privacy as explained more below.
Microsoft may choose not to use or share Feedback, Research Results, or Research
Media. You will not include in any Feedback or materials you share with Microsoft:
content that is abusive, obscene, vulgar, slanderous, hateful, threatening, or
sexually orientated; content in which you do not have the right to transfer
ownership to Microsoft; confidential information or sensitive personal information
of yourself or others; or any other material that may violate applicable laws.

 Confidentiality. Research Projects and the information you may learn by
participating are Microsoft’s confidential information, even if the technology,
product, or service you are evaluating is commercially available. You will not
disclose to others (including your family and friends) any Microsoft confidential
information or anything else you learn from being in the Research Project without
Microsoft’s permission (unless a court or government orders you to). This includes,
without limitation, no screen shots, no posting on social media, no blogging, no
photos, and no discussions with media or press. However, you may share information
that is general public knowledge or that you legally receive from another, non-
Microsoft source so long as that source was entitled to share the information with
you and did not obligate you to keep it secret. This paragraph applies even if some
of your activities as part of the Research Project happen outside of a Microsoft
facility, for example, in a public place or your own home.
 Data and Privacy. As part of the Research Projects, Microsoft may collect, use,
disclose, transfer, and otherwise process personal information about you (“Data”),
including but not limited to your name, contact information, demographic
information, biographical information, and biometric data such as your voice,
image, or likeness. You grant Microsoft all rights to collect and to use this Data.
Microsoft and its affiliates may use, disclose, transfer, and otherwise process
your Data for Microsoft’s business purposes, including but not limited to testing,
developing, improving, and operating Microsoft products and services. If you wish
to learn more about how Microsoft may use or share your Data, or if you have a

 Risky Activities; Waiver and Release of Liability. Participation in some Research
Projects, such as for new devices, may include physical activity. Do not agree to
participate in and do not undertake any activities that you are not comfortable
performing. You assume the full risk of any physical or emotional discomfort,
injuries, damages, losses, or otherwise you may experience as a result of your
participation in the Research Project (which includes our use of Feedback, Research
Results, and Research Media). You release and hold harmless Microsoft, its
affiliates, and their officers, agents, and employees from any and all claims,
known or unknown, that you may have now or in the future, related to or arising
from your participation in the Research Project, and you hereby waive all such
claims. Microsoft will not be liable for any damages related to your participation
in the Research Project. You will not be entitled to any injunctive or other
equitable relief in connection with your participation in the Research Project.
 Agreement and Authority. This form is the entire agreement between you and
Microsoft. If any part of this form is held invalid by a court, the rest of it will
still be valid and enforceable. This form does not create, or lead to an obligation
to create, an agency or employment relationship. You represent that: you are
competent and have the full right and authority to sign this form; you are old
enough to enter a contract under the law of your jurisdiction (unless your legal
guardian signs this form below); and the rights you grant to Microsoft under this
form will not be limited in any way by any other contract or obligation. This form
is governed by the laws of the State of Washington, without regard to conflict of
laws principles.
Please confirm consent to these terms by signing the bottom of this form. If you
are 18 years old or younger (or under the age to enter a contract in your
jurisdiction), you will need to have a parent or legal guardian fill out the Parent
/ Guardian Information section as well. Upon request, a copy of this consent form
will be provided to you for your records.
