THIS DEED OF INDEMNITY is made at Mumbai this ______ day of

____________, 2022 between (1) Mohamed Aamir Mohamed Obedullah

Ebrahim residing at __________________

______________________________________ & (2) Mohamed Aakif

Mohamed Obedullah ____________________________ ______________________

____________________________, both Males, Adults, Indians hereinafter

referred to as the Deponents/OBLIGORS of One Part AND the Collector of

Mumbai Suburban District, Superintendent-City Survey & Land Records

and City Survey Officer-Bandra of Mumbai Suburban District, of the Other

Part. We declare on solemn affirmation as under:

1. That (1) Smt. Rabia Basri Ebrahim Haji Habib, (2) Abdul Karim Ebrahim Haji
Habib, (3) Mohamed Ubedullah Ebrahim Haji Habib, (4) Mohamed Farook Ebrahim Haji

Habib, (5) Shakir Ebrahim Haji Habib were entitled as Lessees and occupied land

with structure admeasuring 4345.4 Square Metres having CTS No. B/727 of

Bandra B Village, MSD situated at Mount Mary Road, Bandra (West), Mumbai –

4000_____,Taluka Andheri, MSD (hereinafter referred to as the “said Lands” , which is

more particularly described in the schedule hereunder written (hereinafter

referred to as "the said property").

2. That Shri Shakir Ebrahim Haji Habib with existing co-lessees as confirming parties

did under an indenture dated 18/03/1985 and registered under Serial No. BBJ /1319/1985

transfer his right title and interest in favour of our mother Smt. Zahida Mohamed

Obedullah Ebrahim Haji Habib.

3. Further Aforesaid Shri Mohamed Farook Ebrahim Haji Habib with remaining co-

lessees as confirming parties did under an indenture dated 21/03/1985 and registered

under Serial No. BBJ /1497/1985 transfer his right title and interest in favour of one of us

(Mohamed Aakif Obedullah Ebrahim ) (then Minor) through our father Late

Mohamed Obedullah Ebrahim Haji Habib.

4. Further aforesaid Abdul Karim Ebrahim Haji Habib with still remaining co-lessees

as confirming parties did under an indenture dated 09/05/1985 and registered under Serial

No. BBJ /1866/1985 transfer his right title and interest in favour of other of us

(Mohamed Aamir Mohamed Obedullah Ebrahim) (then Minor) through our father

Late Mohamed Obedullah Ebrahim Haji Habib.

5. Aforesaid Smt. Rabia Basri Ebrahim Haji Habib, our grand mother expired in Mumbai

on 30.03.2006, and she has executed undertaking dated 19th Day of February, 1987 under

which she has relinquished all her right title and interest for consideration received by her

in our favour and in favour of our parents (since deceased). Further she has also signed a

letter dated 25/06/1986 addressed to the Additional Collector, BSD under which she has

requested for the transfer of her undivided one fifth share in favour of us and our parents.

6. Our father Mohamed Obedullah Ebrahim Haji Habib expired in Mumbai on 16th

February 2014 without making any Will and we are his ONLY legal heirs.

7. Our mother Smt. Zahida Mohamed Obedullah Ebrahim Haji Habib expired on 25 th

Oct. 2017 in Mumbai without making any Will and we both are her ONLY legal heirs.

8. Requisite permissions vide identical letters No. 11/3-D/L-206 dated 27/8/1991, have

been given to all the Lessees by the Office of the Collector, BSD, Bandra East permitting

transfer of the said Property to family members..

9. The Obligors herein have represented to the City Survey Officer-Bandra,

Superintendent-City Survey and Land Records and Collector-Mumbai

Suburban District that they in view of the various transactions mentioned

hereinabove they as Lessees of the 2/5th part and that of next 2/5th part as

being legal heirs of their parents and that of remaining 1/5 th part belonging

to Late Smt Rabia Basri Ebrahim Haji Habib in view of her declaration are fully

entitled to the said Property. AND FURTHER the Obligors herein are

applying to the City Survey Officer-Bandra by their letter dated

_________day of ____________, 2022 to delete the names of (1) Smt. Rabia


Basri Ebrahim Haji Habib, (2) Abdul Karim Ebrahim Haji Habib, (3) Mohamed

Ubedullah Ebrahim Haji Habib, (4) Mohamed Farook Ebrahim Haji Habib, (5) Shakir

Ebrahim Haji Habib in their records as well as in the Property Card pertaining

to the said property. The Obligors execute this Affidavit cum Indemnity

Bond in favour of the City Survey Officer-Bandra, Superintendent-City

Survey and Land Records and Collector-Mumbai Suburban District which

the Obligors have agreed to do so.

NOW THIS DEED WITNESSETH that WE, (1) Mohamed Aamir Mohamed

Obedullah Ebrahim & (2) Mohamed Aakif Mohamed Obedullah, the Obligors

herein, hereby agree to indemnify and keep indemnified the City Survey

Officer-Bandra, Superintendent-City Survey and Land Records and

Collector-Mumbai Suburban District against any claim made upon deletion

of aforesaid names of (1) Smt. Rabia Basri Ebrahim Haji Habib, (2) Abdul

Karim Ebrahim Haji Habib, (3) Mohamed Ubedullah Ebrahim Haji Habib,

(4) Mohamed Farook Ebrahim Haji Habib, (5) Shakir Ebrahim Haji Habib,

on the strength of their Application, Registered Deeds and respective Index-

II documents, Affidavit and this Indemnity Bond from the property card

pertaining to the said property admeasuring 4345.4 Square Metres having CTS

No. B/727 of Bandra B Village , MSD situated at Mount Mary, Bandra West, by

any other person or persons and against any loss, cost, charges and

expenses incurred or suffered by the City Survey Officer-Bandra,

Superintendent-City Survey and Land Records and Collector-Mumbai

Suburban District in respect of the said property.

This affidavit cum Indemnity bond is sworn to be presented to City Survey

Officer-Bandra to enable them to Delete the names of (1) Smt. Rabia Basri
Ebrahim Haji Habib, (2) Abdul Karim Ebrahim Haji Habib, (3) Mohamed Ubedullah

Ebrahim Haji Habib, (4) Mohamed Farook Ebrahim Haji Habib, (5) Shakir Ebrahim Haji

Habib resulting in the transmission / transfer of their respective undivided

right, title, interest and share in the said property equally between the

deponents herein.

Whatever is stated hereinabove is true and correct to the best of our own

knowledge and belief and we believe the same to be true.
