Dear RD Agustin:

This pertains to your Memorandum dated 24 January 2022 forwarding to the Central
Office the letter dated 20 January 2022 of Engr. Mario D. Cruz, Jr., Acting Punong
Barangay (PB) of Barangay Carmona, Makati City, requesting from the Department an
authority to appoint vacant positions in Barangay Carmona, Makati City.

Per your Memorandum, various appointive positions in Barangay Carmona, Makati

City were vacated due to resignation. Hence, Acting PB Cruz, Jr. is requesting for an
authority to authorize him to make appointments for the vacant positions in the
barangay citing as reference Section 46 of the Local Government Code of 1991 (LGC)
in relation to DILG Memorandum Circular (MC) No. 2019-21, re: “OPERATIONAL
GUIDELINES AND RULES IN IMPLEMENTING ADMINISTRATIVE ORDER NO. 15
SERIES OF 2018”.

Per City Resolution No. 2021-0481 passed by the Sangguniang Panlungsod of Makati,
a 12-month suspension is thereby imposed against elected PB Joselito M. Salvador
and seven (7) other Sangguniang Barangay Members.

Thereafter, acting PB Cruz and several other Acting Sangguniang Barangay Members
were designated by the DILG Secretary.

Hence, the request of Acting PB Cruz, Jr. for an authority to appoint the following
vacant positions in Barangay Carmona: (1) 1 Bantay Bayan; (2) 1 Rescue; (3) 2
Administrative Aide 1; (4) 2 Administrative Aide III; (5) 1 Administrative Aide IV; (6) 1
Administrative Aide V; and (7) 5 Tagalinis.

RULES AND ETHICS IN ADMINISTRATIVE CASE NO. 2021-002, ENTITLED AS, “RENEIL DE
GUZMAN VS. PUNONG BARANGAY JOSELITO M. SALVADOR AND BARANGAY KAGAWADS
JASON S. LAYUG, ANDRES F. CHUA, JEFFREY L. SORDAN, CHRISTOPHER B. GUERRA,
ROSALIE DL. GARCIA, MARIA ANDREA PAULA S. VICENTE AND VIRGILIO S. GUILLERMO OF
BARANGAY CARMONS”, WHICH IS TO IMPOSE THE PENALTY OF SUSPENSION FOR A PERIOD
OF TWELVE (12) MONTHS AGAINST ALL RESPONDENTS, SUBJECT TO EXISTING LAWS, RULES
AND REGULATIONS.”
