MOST RESPECTFULLY SHOWETH:

1. That the above noted case is pending before this Hon’ble Court and
fixed for PE for today i.e. 05.02.2024.
2. That this Hon’ble Court was pleased to impose cost of Rs.2000/-
each to be paid to the Defendant no.3 to 5 and defendant no.8 vide
order dated 01.11.2023 on the plaintiff.
3. That it is submitted that the son of the plaintiff who is of 6.5 years
of age is a patient of asthama and due to this the plaintiff was
taking care of her son and was not in a position to appear before
this Hon’ble court on the 01.11.2023.

4. That the absence of the plaintiff on 01.11.2023 is neither

intentional nor deliberate but due to the above said reason.
5. That the imposing of the cost has caused grave inconvenience and
hardship to the Plaintiff and grave prejudiced will be caused to the
interest of the Plaintiff.
6. That the present application has been filed in the interest of justice.
 PRAYER
It is, therefore, most respectfully prayed before this Hon’ble court
that the cost of Rs.2000/- imposed upon the plaintiff may kindly be
waived off, in the interest of justice and considering the above
mentioned reasons and facts and circumstances of the case.

Affidavit of Ms. Ragini Chawla D/o Sh. Pradeep Kumar Chawla,

aged about 38 years, R/o T-1898, Naiwala, Karol Bagh, New Delhi.

I the above named deponent do hereby solemnly affirm and declare as

under:-

1. That I am the Plaintiff in the above noted matter and well conversant
with the facts of the case and competent to swear the present affidavit.

2. That the contents of the accompanying application under Section 151

CPC has been drafted by my counsel under my instructions and the
contents of the same has been read over to me and the same are true
and correct and the same may be read as part and parcel of the present
affidavit and have not been repeated herein for the sake of brevity.

PLAINTIFF FOR RECOVERY OF COST VIDE ORDER
05.11.2015

MOST RESPECTFULLY SHOWETH:

1. That the above noted case is pending before this Hon’ble Court and
fixed for PE for 20.05.2024.
2. That this Hon’ble Court was pleased to impose cost of Rs.20,000/-
on the Defendant no.3, 4 & 5 while dismissing their application
under Order 39 Rule 1 and 2 r/w Section 151 CPC vide order dated
05.11.2015.
3. That it is submitted that the Defendant no.3, 4 and 5 has not paid
the cost of Rs.20,000/- imposed on them by this Hon’ble Court and
the same has been recorded in the order dated 20.04.2023.
4. That the plaintiff is filing the present application for the recovery
of the above said cost which has not been paid yet by the
Defendant no.3, 4 and 5.
5. That the present application has been filed in the interest of justice.
 PRAYER
It is, therefore, most respectfully prayed that this Hon’ble court may
direct the Defendant no.3, 4 and 5 to pay the cost of Rs.20,000/-
imposed on them to the plaintiff vide order dated 05.11.2015.

Pass such and other further orders as this Hon’ble court may deem fit
and proper in the facts and circumstances of the present case.
