Today the Ld. counsel for the DH Bank appeared along with
Sh. Nirmal Singh Branch Manager, PCCB. Perusal of the case file reveals
that in the present execution the property bearing Khasra No.64//10(8-0)
has been mortgaged by Harbhajan Singh with the PCCB Bank but the
Jamabandi of the village Dharamheri placed on the case file reveals that
the said Khasra No.64//10(8-0) is in the name of Gurnam Singh. The Ld.
counsel for the DH Bank submitted that the said transfer has been made
by the JD Harbhajan Singh without taking the permission from PCCB
Bank.
At this stage vide separate statement, Sh. Nirmal Singh,
Branch Manager, PCCB, Branch Kamalpur, Tehsil Samana, District
Patiala stated that he withdraws the present execution at this stage as the
JD Harbhajan Singh has intentionally transferred the suit property in the
name of his father Gurnam Singh without taking permission from their
bank. The DH Bank will move fresh application after verifying the
revenue record and after getting the necessary instructions in this regard.
As such, in view of the same, present execution stands dismissed as
withdrawn. File be consigned to record room after the due compliance.
