Rules & Regulations

1. CONSTITUTION OF AN ORGANIZING COMMITTEE


a) An organizing committee for the conduct of internal national ranking rounds shall be
constituted and entrusted with the sole responsibility of hosting, regulating and
releasing the ranks for the internal national ranking rounds 2021-22.
b) The Organizing Committee shall be headed by the Convenors of Moot Court Society
and shall be aided by members selected by way of call for applications. The selection
of such members shall be made by the Convenors in consultation with the Faculty
Coordinators of the committee.
c) The Organizing Committee is an independent body and shall work in isolation from the
functioning of the Moot Court Society.

2. CONDUCT OF THE INTERNAL NATIONAL RANKING ROUNDS


The Internal National Ranking Rounds will be conducted by the Organizing Committee in the
pursuance and in accordance with the following provisions:
a) Each team shall comprise of a minimum of two members and a maximum of three
members. In a team consisting of three members, two members shall be designated as
‘Speakers’ and the third member shall be designated as ‘Researcher’. No change in
team composition or swapping between the Speaker and the Researcher shall not be
allowed unless the same is approved by the Faculty Coordinators.
b) The Internal Ranking Rounds will be a two-phased process comprising of Memorial
Submissions and Speaker Rounds.
c) Draw of Lots: There will be a ‘draw of lots’ conducted by the Organizing Committee
virtually to determine the fixtures. The date on which the draw of lots to be conducted
shall be intimated by email to the student body.
d) Each team shall argue on both sides i.e. as a petitioner/appellant/plaintiff/applicant
and as the respondent/defendant, and memorials for BOTH SIDES are required to be
submitted.

e) Each petitioner/appellant/plaintiff/applicant and respondent/defendant memorial will
be evaluated out of a score of 100.
f) During the oral rounds, EACH speaker will be evaluated out of a score of 100.
g) The memorials submitted shall be evaluated for a total of 100 marks i.e. 50 marks for
each side.
h) The total final score of the team would be out of 300 marks.

3. ROUND POINT SYSTEM


In order to minimize the differences in scoring patterns across Court Halls, the scoring criteria
for the preliminary rounds shall be as follows:

a) Each round shall be for a total of 42 minutes. Each team will be given a total time of
21 minutes for oral pleadings & rebuttals. Time management is at the discretion of the
team subject to a maximum of 12 minutes per speaker and a minimum of 1 minute
reserved for rebuttals. The same must be communicated to the designated Court Officer
of the Virtual Court Hall prior to the commencement of each round.
b) Each round shall have the following points:
Difference in oral scores: 5 points
Points for speaker scores (for each speaker): up to 5 points
Difference in memorial scores: 2 points
c) Each round will be judged by a single judge. Each judge shall score every speaker on a
scale of 0-100 and if the cumulative oral score (speaker 1 score + speaker 2 score) of
one team exceeds the cumulative oral score (speaker 1 score + speaker 2 score) of the
other team by Ten (10) marks (inclusive of difference of 10 marks), the team with the
higher cumulative score shall be awarded five (5) points and the team with the lower
cumulative score shall be awarded zero (0) points. If the difference is less than ten (10)
marks, the team with the higher cumulative score shall be awarded three (3) points and
the team with the lower cumulative score shall be awarded two (2) points. In case of a
tie, the Teams shall be awarded two point five (2.5) points each. Thereby, the judge
shall have 5 points at his discretion to adjudge the cumulative score of each team.

d) Each speaker shall be awarded points based on the following criteria:

e) Additionally, 2 points shall be awarded based on memorial scores. If the difference between
the memorial score obtained by the two teams (who go up against each other in the
respective round) is greater than five (5) marks (inclusive of five (5) marks), the Team
with the higher score shall be awarded two (2) points and the Team with the lower score
shall be awarded zero (0) points. If the difference between the score obtained by the two
teams is lesser than five (5) marks, the Team with the higher score shall be awarded one
point five (1.5) points and the Team with the lower score shall be awarded zero point five
(0.5) points. If the two Teams are tied in their memorial score, the team with a higher oral
score shall be awarded one point five (1.5) points and the Team with the lower oral score
shall be awarded zero point five (0.5) points.
Example: Team X argues on behalf of the Petitioner and Team Y argues on behalf of
the Respondent in Round 1. The Judge awards the following scores to Team X: Speaker
1= 93 & Speaker 2 = 94. The cumulative oral scores for Team X = 93 + 94 = 187. The
Judge awards the following scores to Team Y: Speaker 1 = 55 & Speaker 2 = 70. The
cumulative oral score for Team Y = 55 + 70 = 125. Since the difference of cumulative
oral score between Team X and Team Y is greater than 10 marks, Team X shall be
awarded 5 points whereas Team Y shall be given 0 points. Similarly, the following
points shall be given for the respective speaker scores: - Speaker 1 of Team X shall get
5 points and Speaker 2 of Team X shall get 5 points. Similarly, Speaker 1 of Team Y
shall get 1 point and Speaker 2 of Team Y shall get 3 points.
Similarly, if the memorial of Team X has been graded with 90 marks and the memorial
of Team Y has been graded with 75 marks. Since the difference between the memorial
scores is greater than 5 marks, Team X shall be given 2 points and Team Y shall get 0
points.

The total points accumulated by the teams in the above example are as follows:
Team X: 5 points (for the difference in oral scores) + 5 points (based on speaker 1 oral
scores) + 5 points ((based on speaker 2 oral scores) + 2 points (for the difference in
memorial scores) = 17 points
Team Y: 0 points + 1 point + 3 points + 0 points = 4 points

4. RULES FOR MEMORIAL SUBMISSION:


a) Each memorial must contain, in the following order, a Cover Page, Table of Contents,
Index of Authorities, Statement of Jurisdiction, Summary of Facts, Issues Raised, Summary
of Arguments, Arguments Advanced and Prayer.
b) The memorials shall have a page limit of 25 pages inclusive of all sections mentioned
above. The Cover Page, Table of contents, Statement of Jurisdiction, Summary of Facts,
and Issues raised and Prayer will not exceed one page each.
c) The Summary of Arguments must not exceed two pages.
d) The Cover Page of the Memorial must have only the following information, which should
be in the following order (this information should be centred, except where stated
otherwise):
• The Team Code allocated by the Organizing Committee in the top right hand corner
of the Memorial cover page;
• The forum being approached;
• Nature of the case. (i.e., Special Leave Petition or Writ Petition ...etc.);
• The name of the Case (X v Y)
• The title of the document (i.e., “Memorial for Respondent” or “Memorial for
Petitioner”)
e) Identity of the team and/or the names of the participant’s should not be revealed in the
memorial in any manner whatsoever. The teams disclosing their identity through memorial
will be automatically disqualified.
f) The memorial shall be formatted in the font type Times New Roman, Font Size 12, with
1.5 line spacing and justified alignment.
g) Footnotes must be used to identify the source of statements or propositions made in the
body of the memorial.
h) Endnotes are not permitted. Footnotes should not include substantive pleadings, examples,
or any text other than the citation itself.

i) All footnotes must adhere to the 20th edition of Bluebook citation format. No other styles
of citations will be permitted.
j) The softcopies of memorials shall be submitted in both “.docx” and “.pdf” formats. The
deadline for the same is 22nd Oct 2021 (Petitioner Memorial Submission); 24th Oct 2021
(Respondent Memorial Submission).
k) The online submission of the memorials must be submitted through g-form and shall be
shared at a later date.
l) The penalties shall be as follows:

Delay in submission of memorial 5 marks for every 15 minutes of delay

Failure to include all the sections in 2 marks for every such section
the memoranda
Failure to use the prescribed citation 20 marks per memorial i.e.
format Applicant/Petitioner and Respondent
Excessive length of any section of the 2 marks for each extra page
Memorials
Use of incorrect font style, font size 1 mark per violation, maximum of 10
or line spacing marks per side

5. RULES FOR ORAL ROUNDS:

a) Before the start of a round, the teams will inform the court-clerk of their time split, which
will include time occupied by both speakers, as well as time reserved for rebuttal (in case
of Applicant/Petitioner/Plaintiff) or sub-rebuttal (in case of Defendant/Respondent). Both
the speakers will make oral presentations from each Team. No Speaker will take more than
Twelve (12) minutes of the court’s time.
b) Judges will, if required, for further elaboration on facts and arguments advanced, have the
discretion to extend the time limit of either team further than the time upon request.
c) Students who are participating must distance themselves from any/all aspects of
organization as determined by the faculty coordinator.

6. RULES REGARDING VIRTUAL ROUNDS
a) High speed internet along with a working webcam and a microphone is necessary to attempt
the rounds.
b) The rounds cannot be attempted through a phone/tab.
c) Cisco Webex shall be used as the primary platform for the sake of the internal rounds.
d) Detailed instructions regarding the online rounds i.e. regarding the registration link, posture
during the online rounds, etc, will be shared shortly and shall form a part of the ‘Rules and
Regulations’.

7. DISQUALIFICATION CRITERIA
a) Scouting

Scouting is defined as:

• When a team or one or more of its members attend a hearing in which they are not
participants.
• Instances where students or spectators discuss with or pose questions of substantive
issues of law to the participants/court-clerks/judges. A team’s disqualification is
final and irrevocable.
b) Attempting to contact the drafter of the moot proposition.
c) Any other activities deemed fit by the faculty coordinators.
