Rules for 3rd Intra-Department Moot Court

Competition 2022
1) Eligibility

The 3rd Intra-Department Moot Court Competition 2022 is restricted to students who are
currently enrolled in their 3rd semester or above at the Department of Law, East West
University.

2) Team composition

A. Each team shall comprise a maximum of 3 members and a minimum of 2


members, consisting of either 2 oralists and 1 researcher (ideal), or just 2 oralists
(bare minimum). This rule cannot be modified under any circumstances.

B. Teams shall identify the speakers and researchers during registration.

3) Dress code

A. Participants shall be in formal wear while appearing for the oral rounds.

B. Female participants must wear either a full suit consisting of a black formal blazer
and trousers, full-sleeved white shirts or white kurta, black bottom wear, black
blazer/overcoat with formal footwear, or saree with the colour code.

C. Male participants are requested to wear a full suit consisting of a black formal
blazer and trousers, full-sleeved white shirts, black tie and formal footwear.

4) Identification of participating teams

Each team will be assigned a team code (e.g. T1, T2) that will be used to identify them
throughout the tournament.

5) Inauguration and Draw of lots

The formal inauguration and draw of lots for the 3rd Intra-Department Moot Court Competition
2022 shall be held on the first day of the competition after the registration of the participating
teams.
6) Memorial

A. All the teams are required to submit memorials for the Appellant and the
Respondent on the basis of the Moot Problem in both PDF and MS Word formats
via email by the date and time as announced by the Organising Committee to be
notified in due course.

B. While submitting the soft copies of the Memorials, the teams should name the
files with their team code and the side the Memorial represents. For example:
T1-A, T1-R. This should be the same for both PDF and MS Word formats.

C. Name, Student ID, semester of members of the participating teams should not
be mentioned anywhere inside the Memorials. Any other mark, character or text
that reveals the identity of the participants or of the participating teams shall be
considered as violation of this rule which will attract 5 marks as penalty and may
include disqualification.

D. The written pleadings for each Memorial shall be within 4000 words excluding
footnotes. Failure to adhere to the word limit shall result in a deduction of 1 point
for every 100 words over the limit.

E. For footnotes, teams shall follow the Oxford University Standard for the Citation
of Legal Authorities (OSCOLA) 4th edition:

F. Teams are not permitted to raise arguments in the oral pleadings that are not
present in the Memorials. However, while answering the questions of the
honourable judges, they can refer to new materials.

G. 1 point shall be deducted from each side of a team's memorial scores for every 1
hour delay in submission of the memorials. Any team failing to submit the
memorials within 12 hours of the deadline shall be disqualified from the
competition.

H. Memorials must be submitted in a single email. Submission of memorials in


multiple emails and not in the proper mode mentioned in rule 6(A) will result in
deduction of 1 point from the team’s memorial scores.
I. Each memorial shall consist of the following details only;

▪ Issues/ Questions Raised

▪ Summary of Arguments/Pleadings

J. Each memorial shall consist of and only the following details on the cover page:

▪ Team code on the top right hand corner of the cover page

▪ Name and place of the forum (Court/ Tribunal etc.)

▪ Name of the parties and their status (Appellant/ Respondent etc.)

▪ Memorial filed and appearing on behalf of … (the Party)

K. The following content specification must be adhered to:

▪ Language: English

▪ Font and Size (Body): Times New Roman, 12 pts

▪ Line Spacing (Body): 1.5 lines

▪ Font and Size (Footnotes): Times New Roman, 10 pts

▪ Line Spacing (Footnotes): Single line


▪ Page Margins: 1 inch on all sides

▪ Page Limit: 25 pages maximum

▪ Paper Specification: White A4 sized paper

▪ Body of the Memorial: Justified

L. Every team shall be required to submit 5 printed copies of each of the team’s
memorials (5 copies of the team’s Appellant Memorial and 5 copies of the team’s
Respondent Memorial) in due time to be notified by the Organising Committee.

M. The Memorial for the Appellant shall have a ‘blue’ cover page and the Memorial
for the Respondent shall have a ‘red’ cover page.

7) Exchange of Memorials

There shall be an exchange of memorials between the respective opponents after the draw of
lots in all the rounds of the competition. Teams shall also be emailed the memorials of their
opposition teams before the start of each round.

8) Evaluation of Memorials

Memorials will be judged by a special panel of judges on the basis of the following criteria:

Quality and Extent of Research 20 marks

Overall Presentation (Language, structure, format, citations) 20 marks

9) Oral Rounds

Each team shall participate in at least two oral matches in the Preliminary Rounds, once as
Appellant and once as Respondent. Quarter-Finals, Semi Finals and Grand Finale Rounds will
be held in knock-out format or double-legged matches for each round at the discretion of the
Organising Committee considering the number of teams and time constraints. When there are
two matches in any round, every participating team shall be required to argue at least once as
the Appellantand once as the Respondent. The role of the teams for every round will be
decided on the basis of drawing lots.

10) Time Limit

A. Each team will be given a maximum of 20 minutes to present their oral


submissions in the Preliminary Rounds and Quarter-Finals, 25 minutes in the
Semi-Finals and 30 minutes in the Grand Finale. All the aforementioned time
limits include rebuttals and sur-rebuttals.

B. The division of time is left to the discretion of the team members. However, each
oralist can speak for a maximum of 9 minutes in Preliminary and the
Quarter-Final rounds, 11 minutes in Semi-Final round and 14 minutes in Final
round. The time of Question-Answer shall not be deducted from the time count.

C. Division of time (including rebuttal/sur-rebuttal) between two speakers and


rebuttals/sur-rebuttals shall be informed to the Bench Officer before the
beginning of each Round.

D. In case any speaker continues to speak after the completion of his/her time, the
additional time that is used, will be deducted from the time allocated to his/her
co-speaker, or from the time allotted for the rebuttal/sur-rebuttal, as the case
may be. The final decision as to the structure and the right to rebut/sur-rebut will
vest with the respective judges on the bench.

11) Delay in Appearance/Presentation

If a team scheduled to take part in the oral submissions of a round is not present in the
courtroom within 10 minutes after the scheduled commencement of such a round, the other
team shall be allowed to submit ex-parte.
12) Evaluation of the Oral Presentation

Evaluation of oral Round shall be adjudged on the following criteria:

13) Penalties

Violation Penalty

Additional content (other than those mentioned in rule 6(H)) 1 point (one-time deduction)

Missing section 1 point per violation

Incorrect order of sections 2 points per violation

Incorrect font type or font size or incorrect spacing 2 points (one-time deduction)

Breach of memorial anonymity rule 5 points (one-time deduction)

Missing or unnecessary information on front page 2 points (one-time deduction)

Substantive legal argument outside the Arguments section 2 points (one-time deduction)

Exceeding the word limit of the Arguments section 1 point for every 100 words
over the limit

Improper citation standard 2 points (one-time deduction)

Re-submission of memorial not contained in single file 1 point (one-time deduction)


Improper Attire during oral submission 5 points (one-time deduction)

14) Miscellaneous

A. All interpretations and/or modifications are at the complete discretion of the


Organising Committee. The Organising Committee may change any rules at any
given time. The decisions so made shall be final and binding on all participating
teams.

B. Communications regarding any clarification as to the fact or these rules may be


sought through email to the Organising Committee within the specified time.

C. A Researcher Test shall be held for the participating researchers. The test will be
based on the facts, the relevant laws, cases and legal principles.
