saidloantheborrowershavedepositedon 04-04-2024 (date of deposit of title deeds)
thedocumentsfullymentionedintheSchedule-IIhereunderrelatingtotheir
immoveablepropertydescribedinSchedule-III (hereinafterreferredtoas the “schedule
property “) with the HFS with an intent to thereby to create an equitable mortgage
infavouroftheHFSbythewayofdepositoftitledeedsofthepropertyfor
thepurposesecuringrepaymenttotheHFSofthealltheamountsowingtotheHFS
underloanfacilities/advancesmadeandcontinuedtobeenjoyedand/orto bemade from
timetotime to theMortgagors by the HFSbywayof loan facilities ofRs.10,38,713/-( Rupees
ten lakhs thirty eight thousand seven hundred thirteen only) together with
interest,cost,charges,the reonunder Section58(f)oftheTransfer of PropertyAct,1882 and
also to secure all otherindebtedn ess of the executantsto the HFS that may arise in the
future.
TheMortgagor(s)furtherstatedthattheTitleDeedssodepositedtheSchedule-II
hereunderaretheonlydocumentsoftitlerelatingtothescheduledpropertiesinthe
possession, power and control of the Mortgagor and that the Mortgagor had a free,
clearandmarketabletitletothesaidschedulePropertyandsaidscheduledproperty
isnotsubjecttoanylispendens,attachmentorotherprocess issued by any Courtor
TribunalorAuthority.
This Memorandum including Schedules attached hereto and all cross references
referredtoherein, shall be deemed to be part of the Mortgage Loan Agreement and
alltheterms&conditionscontainedthereinshallconstituteapartandparcelofthis
Memorandu
