driven by its driver/respondent
No.1 at a very high speed,
rashly, negligently, without
taking necessary precaution,
without proper lookout,
violating the traffic rule, in a
zigzag manner and without
blowing any horn came from
back side and hit the motor
cycle with great force. As a
result of this the motor cycle
fell down on the road and he
sustained grievous injuries i.e.
CRUSH INJURY LEFT LOWER
LIMB AND AMPUTATION OF
(LT) THIGH and other multiple
injuries. He was immediately
taken to Park Hospital, Q
Block, South City-II, Sohna
Road, Main Sector-47,
Gurgaon, Haryana, where his
MLC No.231/18 was prepared
by the doctor, where he
hospitalized from 18.01.2018
to 19.01.2018, thereafter he
was taken to Paras Hospital, C-
1 Sushant Lok, Phase-I,
Sector-43, Gurgaon (Haryana),
where he hospitalized from
19.01.2018 to 26.01.2018,
thereafter he was taken to RBS
Hospital, U-37, Road Rao
Balbir Singh Market,
Nathupur, DLF Phase-3,
Gurgaon where he hospitalized
from 26.01.2018 to 10.02.2018
where during the course of
treatment his left thigh
amputated. The treatment of
the petitioner is still continuing
as an outdoor patient. within
the jurisdiction of P.S. Udyog
vihar, District Gurugram,
Haryana involving the
deceased and the offending
vehicle being a Fortuner with
registration no.DL-10CE-
5415. Further details about
the accident are enumerated
in para no.27 of the present
petition.

helpful in the disposal of the case:-

i) That the deceased used to work as a Raj mistri


(mason) at District Gurugram and was also taking
part time Mobile repairing on rental mobile shop.

ii) That on 07.02.2021, the deceased went to Harijan


Colony, Sushant Lok on 07.02.2021with his own
Honda bike bearing no.HR26DK-6381 to meet his
maternal uncleSadam Hussain. While he was
returning from the meeting to his local residence
(located at Village Katarpuri, Palam Vihar) at around
12:30/1:00 a.m. on the unfortunate dateof
08.02.2021,as soon as he was about to reach the dam
located ahead of Super Mart-2 mall,the Respondent
no.1 (the driver of a Fortunercar) who was driving the
offending vehicle having registration number DL-10-
CE-5415 in a rash and negligent manner without
caring for traffic rules,hit the bike of the deceased
straight from behind, due to which the deceased got
badly injured. After the accident, some good
Samaritan(s) took the deceased to the hospital.

iii) The deceased expired during the course of reaching


the MaxHospital Gurugram and was declared ‘brought
dead’ on 08.02.2021 at around 01:30A.M. by the
concerned doctors of Max Hospital vide MLC No.4220.
Thereafter, the post mortem of the deceased was
conducted by the concerned doctors of Civil Hospital,
Gurugram vide Post Mortem Report SH/19/21 dated
08.02.2021.

iv) That at the time of the accident, the deceased was a


25-year-old young man in good health and free from
any ailment/disease. The Petitioners lost the sole
earning member of their family. The Petitioners also
incurred around Rs.50,000/- (Rupees fifty thousand
only) on performing last rites of the deceased.

v) That the accident took place due to rash and negligent


driving on the part of the Respondent No.1 who drove
the offending vehicle at a very high speed without
caring for the traffic rules. The fatal injuries sustained
by the deceased had arisen out of the sheer
callousness on the part of Respondent no.1. The
Respondent No.1 is also the owner of the offending
vehicle, while the Respondent No.2 is the insurer.
Thus, both the Respondents are jointly and severally
liable to pay compensation to the Petitioners.

vi) That Petitioners, therefore, claim a sum of


Rs.27,00,000/- (Rupees Twenty Seven Lakhs only) as
compensation on account of unnatural, untimely and
sudden death of the deceased in the accident in
question, mental pain and agony, loss of love and
affection, loss of future income and funeral expenses
incurred. General expenses as admissible under the
various provisions of the Motor Vehicles Act may also
be granted to the Petitioners along with 18% per
annum from the date of realization.

vii) That the accident in question occurred within the


jurisdiction of this Hon'ble Tribunal. Hence this
Hon’ble Tribunal has the jurisdiction to try this
petition.

Respondents jointly and severally.
ii) An interim award of Rs.1,00,000/- (Rupees One Lakh only)
alongwith the interest 09% per annum may kindly be passed
in favour of the Petitioners and against the Respondents
jointly and severally.
iii) Cost of the petition may also be granted.

Such other or further relief which this Hon’ble Tribunal


deems fit and proper in the circumstances and in the interest of
justice may also be granted to the Petitioners against the
Respondents.
