1. OBJECTIVES

The objective of this document is to support Contractors, Subcontractors and Suppliers of Eni in Nigeria in:

preparing bid documentation for Tender participation;


meeting and implementing minimum acceptable HSE requirement for Contracts.

1.1 HSE Disciplinary Policy


Contractors shall be informed that any deviation from the communicated HSE requirements will be subject to HSE
Disciplinary Policy
Eni in Nigeria shall apply the provisions contained in the “HSE Disciplinary Policy” (Annex A1 of the present procedure)
whenever deviations from HSE requirements are observed.

2. SCOPE OF APPLICATION

This procedure applies to the Contracts awarded by Eni in Nigeria for:

Services;
Engineering;
EPC/EPIC/EPF;

Purchase of goods with services (e.g. installation, maintenance);


Purchase of goods with no additional services.

and for activities to be performed within Eni in Nigeria or Contractors/Subcontractors premises.

3. DEFINITIONS, ABBREVIATIONS AND ACRONYMS

TERM/ACRONYM DESCRIPTION

In accordance with the general conditions of Contract, Eni in Nigeria shall have right of
access to any Contractor site. Eni in Nigeria reserves the right to take part in or conduct

achieve those objectives. The system elements include the organisation’s structure, roles
and responsibilities, planning and operation, performance evaluation and improvement.

HSE performance HSE measurable results (ISO 14001, ISO 45001).

Overall intentions and direction of an organization related to its HSE performance as

MoC Management of Change

MoM Minutes of Meeting.

MR Minimum Requirement.

Defines the modus operandi of the company’s business that must be followed. Procedures
describe the tasks and responsibilities of the organizational roles involved, management
Procedure (pro) and control methods, and communication flows. They govern local operations, also for the
purpose of compliance with local regulations. The content is defined in accordance with
the Policies and MSGs, as implemented by the company.

Procurement Acquisition process (purchasing) of goods and/or services.

Requirement A need or an expectation that is stated, generally implied or mandatory.

Effect of uncertainty, deviation from the expected (positive or negative). Risk is often

4. ACTIVITIES AND OPERATING METHODS

Eni in Nigeria applies to Contracts HSE management the key principles and the most influential success factors for
working together in the Contract environment.
These are:
Leadership:

 communicate clearly expectations and accountabilities;

 plan, arrange and attend the kick-off meetings;

 participate in site visits and meetings;

 recognize and reward positive behaviour, or intervene and address behaviour that does not meet expectations.
Risk management: before entering into a Contract and starting any operations or project activities, it is important
to establish the context and assess the risks;
Implementation: responsibilities, accountabilities and authorities need to be maintained to effectively implement
the requirements of the Contract;

Continuous improvement: periodic monitoring, auditing and reporting with the aim to achieve continuous
improvement of the HSE management system and performance.

Contractors, Subcontractors and Suppliers shall be responsible:


through their organization, for applying the measures required to carry out the work assigned by Eni in Nigeria so
as to prevent accidents/incidents or events which jeopardize both personnel, the environment and
plants/installations;

for the correct selection of the personnel to be assigned to the tasks in all working disciplines.

Moreover, Contractors, Subcontractors and Suppliers shall (list not exhaustive):


comply with all national laws, codes and international standards, Eni in Nigeria HSE Management Systems and HSE
standards which apply to the contracted activities;
ensure that all potential HSE hazards and risks are identified, evaluated and mitigated prior to the commencement
of any activity;

possess all the equipment needed to carry out the work as well as all safety devices and Personal Protective
Equipment (PPE) as per manufactures requirements for the equipment;
plan all actions, controls and inspections aimed at ensuring that HSE requirements are observed, applying the
measures defined in his own HSE Management System;
be fully aware that they are expected to bring to the immediate notice of their supervisor all HSE risks, which they
believe not to be under adequate control, so that any action may be taken to prevent potential injuries,
environmental or property damage and provide a safe and healthy workplace;
be fully aware of current Eni in Nigeria procedures and practices which the Contractor shall comply with, such as
the Permit-to-Work system, Emergency Plan, etc.;

obtain and maintain at his own cost, in compliance with Applicable Laws, all Government authorizations necessary
for the performance of the contracted activities, for Contractor’s personnel and equipment, including all visas,
residence permits, clearance certificates and all applicable licenses; even though Company may provide assistance
in obtaining such authorizations, the Contractor shall remain solely liable for the delay or failure in obtaining such
authorizations.

In accordance with the general conditions of Contracts, Eni in Nigeria shall have right of access to any Contractor and
Subcontractor’s site. Eni in Nigeria reserves the right to take part in or conduct accident investigations, site inspections,
competency checks, safety meetings or HSE activities, with participation of appropriate personnel.
It shall be Contractor’s responsibility to ensure that any Subcontractor and/or joint venture partners has appropriate
HSE policies, management systems, plans and procedures and that these comply with Eni in Nigeria HSE requirements.
Eni in Nigeria retains the right to audit and/or approve these HSE management systems, plans and procedures.
The Subcontractors may use the main Contractor’s operating procedures and Safety manuals if they don’t have their
own. In this case the main Contractor will be responsible that these standards are duly given and implemented by its
Subcontractors.

This document presents the documentation to be provided and the operating methods for HSE management by
Contractors and Subcontractors all along the main Contract phases.

These phases are:

Pre-Tender Qualification;
Bid submission;
Contract execution;

Final evaluation and Close-out.

4.1 Pre-Tender Qualification


Bidders/Tenderers who have not previously worked with Eni in Nigeria shall undergo through a pre-qualification process
in order to demonstrate they have the necessary capability and experience and be possibly included in the “Vendors
List” as per pro sg hse 001 eni spa - Appendix H.

The Tenderer should submit the filled “Pre-tender HSE Qualification Questionnaire” provided by Eni in Nigeria (refer to
Annex A2). The “Pre-tender HSE Qualification Questionnaire” is not due in case of the Tenderer is already included in
the list of qualified Contractors, prepared based on oil and gas industry standards in Nigeria and inclusive of HSE
requirement for Vendors.

4.2 Bid submission


Bidders shall develop and submit a bid documentation package in compliance with Eni in Nigeria HSE requirements as
per Invitation to Tender (ITT).
More in detail, Bidders shall:

submit HSE documents in order to demonstrate how the service, personnel, processes and/or equipment will meet
Eni in Nigeria HSE requirements and how these are communicated and monitored to any Subcontractors. Bidders
shall demonstrate, for themselves and their potential Subcontractors, to be able to provide the necessary and fit-
for-purpose procedures (e.g. permit to work, hazard identification and risk assessment, emergency response plans)
and controls in place (e.g. audit, inspection) to achieve the work program without compromising HSE performance,
being always in line with Company HSE requirements;
review all the Eni in Nigeria HSE requirements as per defined ITT and formally request an exception when a
requirement cannot be fulfilled, together with the proposed remedial actions. Exceptions, variation orders or
additional costs should have been addressed before Contract award as well as clarifications closed during the
tender phase;

develop and implement a specific draft HSE Plan (“HSE Plan specific requirements” are provided in Annex A3) to
demonstrate how the HSE management system for the contracted scope of work will be implemented. “HSE Plan
Template” is provided in Annex A4).

In the case of Groupings of Contractors, all Grouping members shall have the above documentation. This documentation
shall be submitted to the Awarding Authority by the Lead Supplier/Contractor (Mandate Holder) at the time of
submitting the offer. In the case of Consortia, the above documentation shall refer to the Consortium as a whole.

4.3 Contract Execution Phase


This process is composed by the following phases:
re-mobilization activities;

Mobilization activities;
Work execution;

Work completion and Demobilisation.

4.3.1 Pre-mobilization activities

Task Responsible Description Form/Record

Once the Contract has been awarded, a Kick-off Meeting (KoM) shall be
held to ensure mutual understanding of Contract requirements and of
HSE risks related to the contracted activities. Contractors shall participate
to the KoM. Subcontractors shall be invited to take part to the KoM as
well, if requested.
The meeting shall be held immediately after Contract award, with
sufficient time before execution of any work (as a minimum 15 days
before the commencement of the service) to avoid delays or unforeseen
problems.
Contractors shall inform Eni in Nigeria of any changes to what has been
declared in the Bid or Contract, in a timely manner. Any deviation shall be
Contractors / agreed and approved by Eni in Nigeria before any work execution.
Subcontractors Before the KoM, Contractors shall provide in advance required documents
for Eni in Nigeria approval. During the KoM, Eni in Nigeria will confirm the
Kick-off Contract Holder completeness of the documentation provided by Contractor or request
Meeting additional missing Contract specific documents (e.g. specific operative
procedure as bunkering, crew change, SIMOPS), specific plans (e.g. MERP,
HSE Division ERP) and/or HSE records (Fitness to Work, BOSIET, CVs), if necessary. The
necessary arrangement for the finalization of the final revision of the
documents (e.g. HSE plan, Bridging Document) shall be taken. Contractors
shall commit to delivery dates of the required documents in final version,
which address any Eni in Nigeria comment. The overall documentation, all
arrangements and agreements taken during the KoM shall be finalized
and fixed before the start of the operations.

provided in Annex A5.

Note: If the Contract scope of work is referred to:


professional/consultancy services performed within Eni in Nigeria or
Contractor premises;
engineering services performed within Eni in Nigeria or Contractor
premises;
purchase of goods with no additional services.
Contractor / the applicable minimum HSE requirement are those identified with the
Subcontractors abbreviation “MR”, in parenthesis, in the following list, otherwise for all
Documents the other categories of Contracts, the entire list is applicable.

Contractor is compatible and aligned with Eni in Nigeria’s HSE MS.
This document shall demonstrate the effective interfacing of the
Contractor and Eni in Nigeria HSE Management Systems and the
share of responsibilities. It shall provide a clear demonstration that
controls are in place in order to promote safe activities/operations.

This document includes a review of the procedures operated by


both parties in order to identify areas of incompatibility or areas that
require specific instructions not covered by existing procedures. This
is a controlled document, which is signed and accepted by both
parties. This document shall cover key aspects of Management
Responsibilities, HSE, Communications, Schedule, Equipment,
Fitness and Monitoring, Auditing and Review.
Risk Assessment documentation (updated version, if any) (MR);
Radiation Protection Risk Assessment (updated version, for
contracted activities which impact with ionizing radiation);
Signed Eni in Nigeria Disciplinary Policy for Contractors and
Subcontractor (Annex A9);
HSE training evidence (e.g. certificates, training program);
Any other HSE documents as per Tender Phase’s requirements
(MR);
Any other documents as per Contract’s HSE clauses (MR);
Any other documentation required by local HSE legislation (MR).

4.3.2 Mobilization activities

A Start-up Meeting shall be held at site (where the contracted


activity is to be performed) to ensure understanding of risks related
to planned activities.
The meeting shall ensure that all personnel involved in the operation
is aware of the HSE requirements and that the latest risk
assessments, controls, barriers, and HSE Management System are in
place to minimize HSE risks.
For HSE mobilization acceptance, some of the main principal
Contractor / activities are:
Subcontractors reviewing and approving of HSE Plan;
Start up reviewing and approving of Bridging Document;
meeting Contract Holder reviewing of risk assessment process;
communication of the roles and responsibilities to Eni in Nigeria
and Contractor (and Subcontractors);
HSE Division
checking equipment certification to ensure it is tested and fit for
purpose and repeat the test for acceptance by Eni in Nigeria side;
checking that personnel are competent for the tasks they will
perform, having received appropriate HSE and technical training,
including HSE induction;
approving the CVs of key HSE and operative personnel;
verifying the effectiveness of the emergency response plan,
including dedicated medical emergency response plan.

Contractor / Depending on the nature of the Contract, fully support Contract


Mobilization Subcontractors
Audit Holder’s Mobilisation Audit to check and accept Contractor’s

Contract Holder the commencement of the work should equipment be rejected once
on site.
HSE Division An HSE audit aimed at verifying and accepting that all contractually
required personnel are present, facilities are in working order,
procedures, work instruction and plans are in place and
implemented, HSE risk assessment are communicated to all relevant
personnel including Eni in Nigeria, Contractor and Subcontractors.

Carries out the following:


Mobilisation of Contract personnel and equipment;
Communication of the roles and responsibilities to client and
Contractor personnel;
Commencement of induction, orientation and site specific
training.
Shall ensure:
HSE requirements are compliant with laws, regulations, Eni in
Nigeria and internationally recognized international standards;
organization satisfies the requirements mentioned in the final
HSE Plan;
implementation of all the actions identified to reduce HSE and
radiation protection risks;
identification of any potential environmental and health impacts
related to his own activities and relevant mitigation and
management measures;
workforce is aware of risk control measures and HSE procedures,
work instructions and plans;
site emergency plans are in place;
a drill before operation start, including a medical emergency
scenario;
personnel have the necessary training certificates
Contractors /
Mobilization (e.g. BOSIET, Survival Course) for personnel scheduled to work
Sucontractors
offshore or appointed for safety critical jobs (e.g. First Aid, H2S,
work at height, defensive driving). Training certificates are made
available to Eni in Nigeria to cross check all of them before the
operations commencement;
personnel are medically fit for the job they are assigned to.
Medical fitness certificates, issued by a recognized authority in
compliance with Eni in Nigeria’s requirements, shall be made
available to Eni in Nigeria to cross check before starting of the
operation;
medical organization and health facilities provided at the site are
able to ensure an effective first aid, medical assistance,
depending on the expected workers peak and detailed health risk
assessment, and medical emergency response;
personnel and visitors present on the worksite attend an HSE
induction session;
personnel and visitors wear adequate PPE, in accordance with
risk evaluation, so required for the specific type of work being
carried out or for the area to be visited. For PPE that requires
specific training, Contractor shall ensure the evidence that
adequate training has been provided (registers, certifications,
etc.);
relevant information regarding HSE aspects of the worksite and
the contracted activities are properly communicated to all
personnel;

Health surveillance program, in line with the results of the Health


Risk Assessment, for the workers present at Eni in Nigeria
premises is in place;
radiation protection surveillance program, in line with the results
of the Radiation Protection Risk Assessment, for the workers
present at Eni in Nigeria premises is in place.

4.3.3 Work execution


The primary goal of execution phase is to complete the contracted activities’ programme in accordance with established
plans, HSE requirements and contractual obligations.

Contractors and Subcontractors shall conduct activities in accordance


with HSE Plan and Bridging Document and shall guarantee all the HSE
requirements defined for the mobilization phase, plus:
guarantee the implementation of Eni HSE Golden Rules;
organize HSE performance meetings at the work site, at least on
weekly basis, with a Safety Committee Meetings involving
technical and HSE key personnel;
take all actions necessary to protect all
Contractor/Subcontractor/Interest Parties from any exposure to,
or hazard from, hazardous situation and adopt all measures
needed to reduce, as low as reasonably possible, any injury or
damage to people or property in according to the HSE risk
assessment;
ensure that a Permit to Work system has been established and
understood by those involved before any work and that these
works are carried out to qualified personnel only upon provision
of adequate training;
Contractors / ensure that a Tool Box Meeting with relevant involved personnel
Execution
Subcontractors is conduced prior to the starting of any activities;
ensure that all relevant information regarding HSE and radiation
protection aspects are properly handed over from shift to shift
through formalized and documented handover notes and
meeting in overlapping for the key HSE and technical personnel;
immediately notify Eni in Nigeria of any incidents (real and/or
potential) that occur in the performance of the contracted
activities;
develop and implement an effective Management of Change
(MoC) process to manage changes to the contractual scope of
work, personnel, equipment or other pre-agreed criteria;
provide and maintain in good operating conditions all safety and
environmental critical equipment identified in the risk
assessment;
take all necessary measures in order to prevent and/or limit

be responsible for proper tracking and disposing of all waste


from any source under his care, custody or control and generated
through the execution of the contracted work and produce as
well a waste management plan. The disposal of waste shall
comply with applicable laws and Eni in Nigeria requirements. A
key aspect of the Waste Management is effective recycling and
shall include the following:
 proper identification and classification of each individual
waste stream and expected quantities;
 segregation of individual waste streams (hazardous and
non-hazardous);
 proper labelling, markings, manifesting, storage, shipping
and disposal at authorized facilities, for each waste stream.
be responsible for the identification, handling and storage of
chemicals/hazardous materials, according to each specific SDS
(Safety Data Sheet), that shall be kept up to date and easily
accessible by all employees;
ensure that HSE KPIs are correctly measured and recorded
according to agreed reporting process.
Eni in Nigeria and Contractors shall agree on appropriate KPIs to
measure the effectiveness of monitoring and verification activities.
Any change to the scope of work arising during the execution of the
work shall be reviewed to ensure that it is covered by the agreed HSE
Plan and HSE Bridging Document. Changes to agreed Bridging
arrangements shall be included in a formal MoC process and shall be
approved by the Eni in Nigeria.

Contractors/Subcontractors shall allow and assist Eni in Nigeria


Representatives in:
access to any document relevant to the Contract;

Worksite Contractors / access to any work-site where contractual activities are carried
Inspections Subcontractors out (with documented limitations due to safety and military
secrecy);
attendance (as observer) of any meeting, inspection and formal
test session relevant to the Contract and conducted under
Contractor’s or Subcontractors’ responsibility.

HSE meetings shall be held at least once a week (and for project sites
daily) at Eni in Nigeria worksite offices, to discuss HSE aspects and
concerns in the contracted job. All key personnel of the Contractor
and its Subcontractors shall attend these meetings. In general
terms, HSE meetings cover the following:
close-up of actions from previous meetings;
Contractor / risks co-ordination;
Subcontractors
personnel training;
HSE Meetings
drills results review;
Contract Holder
analysis of accidents, dangerous occurrences and non-
conformances, in order to prevent their recurrence and define
HSE Division corrective actions;
suggestions, ideas or proposals, aimed at increasing awareness,
risk perception and the general level of safety;
operating procedures for particular operations;
emergency procedures.

Progress Meetings and other meetings to be held in the ambit of Eni


in Nigeria Surveillance Activity will be defined in advance during the
Kick off Meeting and, if necessary, updated in the following meeting.
The Minutes of the Meetings (MoM) shall be taken by the
Contractor, with a copy sent to Eni in Nigeria and Subcontractors.

The Contractor shall develop and implement an internal and


external Audit Plan in order to evaluate the efficiency of his own HSE
system applied to the Contract activities.
The Audits may also involve the Subcontractors.
The Audits shall be conducted by qualified personnel not directly
involved in the activities to be audited. Non compliance shall require
necessary actions from the Contractor to ensure that the
Contractor /
HSE Audits requirements of HSE Plan are met. Contractor actions shall include,
Subcontractors but not be limited to, additional training of employees, revision of
procedures, development of additional procedures, and
procurement of equipment, material and supplies.
The results of the audit shall be reported in a document (Audit
Report). A copy of this document shall be sent to Company upon
request. Eni in Nigeria shall reserve the right, when deemed
necessary, to directly conduct Audits at the worksites of the
Contractor and Subcontractors.

Contractor shall issue at least the following kinds of reports, based


on the type of activity to be performed and in accordance to what pro hse 001 attA
established during the KoM and as further determined by Eni in anxA7 eni ng r00 Monthly Report_Tab
Nigeria during the course of the Contract:
HSE
Contractors / daily report;
Performance
Subcontractors
Reporting weekly report;
monthly report (A template is available in Annex A7).

Contractors, with the approval of Eni in Nigeria, shall promptly take


such steps as necessary to maintain good relations with the public
with whom they will come into contact during the course of the
Work. This shall include, but not be limited to, information about
the execution and timing of the Work, and, where necessary and
allowed by Eni in Nigeria, education of the public (e.g. by talks given
to the local communities, at schools etc) about the dangers of and
need for safety precautions near the work, such as keeping clear of
Community / aircraft, and drilling and construction operations, etc. Contractors
