Domestic Violence
In light of our ongoing problem with domestic violence and repeat pending
offenders in our community and court system, I am informing all agencies of T.C.A. § 40-
11-142, - Due Diligence to Determine Persons Criminal History which also includes arrest
history and failure to appear. (See Attached)
‘The purpose is to get these repeat pending offenders in front of a General Sessions
Court Judge as soon as possible to set bond pursuant to T.C.A. §40-11-118. (See Attached)
My office needs officers and deputies to now place the most recent pending
domestic assault arrest within their affidavit. Then inform the night clerk of same. Once
informed, the night clerk can call a General Sessions Court Judge to set the appropriate
bond.April 9, 2024

Pursuant to T.C.A. § 40-11-1085, night clerks are only allowed to set bonds on
misdemeanors to a maximum of $1,000.00, These caps on bond amounts by night clerks
are simply not appropriate, and the victims and our community are not being protected.
