PADA menjalankan kuasa yang diberikan oleh seksyen 27B, 27C, 27D, 27E dan 66
Akta Keselamatan dan Kesihatan Pekerjaan 1994 [Akta 514], Menteri membuat
peraturan-peraturan yang berikut:
BAHAGIAN I
PERMULAAN
Tafsiran
2. Dalam Peraturan-Peraturan ini—
“bejana tekanan” ertinya bejana tertutup dengan tekanan lebih besar atau kurang
daripada tekanan atmosfera;
“dandang stim” ertinya mana-mana bejana tertutup bagi apa-apa maksud yang stim
dihasilkan di bawah tekanan yang lebih besar daripada tekanan atmosfera dan

termasuklah mana-mana penjimat haba yang digunakan untuk memanaskan air yang
disalurkan kepada bejana dan mana-mana pemanas lampau yang digunakan untuk
memanaskan stim dan apa-apa paip dan pepasangan yang disambungkan kepada bejana
tertutup itu;
“kereta api funikular” ertinya suatu jentera mengangkat yang merupakan sistem
kejuruteraan untuk mengangkut penumpang atau barang di kawasan cerun
menggunakan pembawa atau kenderaan yang bergerak di sepanjang rel dan ditarik
dengan tali pada satu hujung bersama-sama dengan apa-apa jentera, kelengkapan atau
loji lain yang bersambung dengannya;
“kren” ertinya suatu jentera mengangkat, tidak termasuk takal pengangkat, yang—

(a) merupakan peranti berkuasa yang dilengkapi dengan cara mekanikal untuk
menaikkan atau menurunkan beban terampai dengan cangkuk atau peranti
pengendalian beban yang lain yang boleh memposisi semula atau
menggerakkan beban terampai secara menegak atau mendatar dengan
pergerakan kren atau bum, jib, troli atau mana-mana bahagian kren yang
lain; dan
(b) termasuklah semua bahagian kren termasuk tali dawai, cangkuk atau
peranti pengendalian beban, atau peranti lain yang digunakan untuk
menggerakkan cangkuk;
“kren bergerak” ertinya suatu jentera mengangkat yang merupakan kren dengan
kelengkapan pacuan kuasa yang dilekapkan pada tapak beroda atau berantai, yang fungsi
utamanya adalah untuk menaikkan, menurunkan dan menghayun beban pada pelbagai
jejari dengan takal pengangkat yang digantung dari bum kekisi atau teleskopik;
“kren dermaga” ertinya suatu jentera mengangkat yang merupakan kren yang
dipasang di dermaga yang digunakan untuk menaikkan atau menurunkan kontena dan
bergerak pada landasan kekal;
“kren kembara atas” ertinya suatu jentera mengangkat yang merupakan kren
dengan galang yang dilengkapi dengan peranti yang menaikkan dan menurunkan beban
dan bergerak pada landasan yang kekal;
“kren menara” ertinya suatu jentera mengangkat yang merupakan kren dengan
bum atau jib yang dilekapkan pada menara tegak untuk menaikkan dan menurunkan
beban terampai dan pergerakan beban itu dibuat melalui perubahan jejari atau pusingan;
“laluan gerak” ertinya suatu jentera mengangkat untuk mengangkut orang yang
permukaan pembawa pengguna itu kekal selari dengan setiap arah gerakan dan tidak
terganggu;

“lif” ertinya suatu jentera mengangkat dengan pemacu tarikan, positif atau
hidraulik, yang berfungsi pada aras tertentu dan mempunyai pembawa yang bergerak
di sepanjang panduan yang tegar dan condong pada sudut lebih daripada 15 darjah
ke arah mengufuk, atau di sepanjang laluan tetap walaupun ia tidak bergerak
di sepanjang panduan tegar, bagi maksud mengangkut orang sahaja, atau orang dan
barang tetapi ia tidak termasuk lif dengan kelajuan terkadar kurang
daripada 0.15 meter per saat;
“loji yang menghendaki perakuan kelayakan” ertinya semua loji sebagaimana yang
ditetapkan di bawah peraturan 3;
“pemunya” ertinya orang yang menerima sewa atau keuntungan dengan memberi
pajak mana-mana loji yang menghendaki perakuan kelayakan sama ada atas tanggungan
sendiri atau sebagai ejen atau pemegang amanah bagi mana-mana orang lain;

“pengilang asalan” ertinya pengilang asal mana-mana dandang stim, bejana tekanan
atau jentera mengangkat yang diimport;
(a) reka bentuk yang boleh menjejaskan kekuatan, integriti atau keupayaan
fungsi mana-mana loji yang menghendaki perakuan kelayakan;
(b) tekanan kerja selamat bagi dandang stim dan bejana tekanan;
(d) jarak pergerakan, saiz, kelajuan terkadar atau beban terkadar bagi lif;
“takal pengangkat” ertinya apa-apa peranti yang digunakan secara langsung atau
tidak langsung untuk menyambungkan beban kepada jentera mengangkat tetapi tidak
disambungkan secara kekal kepada beban itu, termasuklah anduh rantai atau tali, gelang,
pautan, cangkuk, belenggu, swivel, bolt tindik, rantai, tali, blok takal dan blok rantai;
“tekanan kerja selamat” ertinya tekanan maksimum yang dibenarkan yang suatu
dandang stim atau bejana tekanan yang boleh dikendalikan sebagaimana yang
dinyatakan dalam verifikasi reka bentuk yang dikeluarkan di bawah perenggan 4(1)(a);

(g) jika loji yang menghendaki perakuan kelayakan itu merupakan dandang
stim atau jentera mengangkat sebagaimana yang dinyatakan dalam
Jadual Ketujuh, memastikan bahawa dandang stim atau jentera
mengangkat itu dipasang oleh orang kompeten atau pengilang asalan;
(l) jika permohonan itu berhubung dengan pemasangan kren menara atau
pengangkat penumpang, memastikan penelitian asas tapak, integriti
struktur dan integriti komponen dijalankan oleh orang kompeten
sebelum pemasangan;

(2) Jika kehendak di bawah subperaturan (1) telah dipatuhi, mana-mana orang
boleh memohon kelulusan bertulis bagi pemasangan loji yang menghendaki perakuan
kelayakan daripada Ketua Pengarah dalam bentuk dan cara sebagaimana yang
ditentukan oleh Ketua Pengarah.
(3) Dalam hal loji yang menghendaki perakuan kelayakan yang telah dikeluarkan
perakuan kelayakan bagi suatu lokasi tertentu tetapi akan ditempatkan semula
di suatu lokasi baharu, mana-mana orang yang berniat untuk memasang loji itu di lokasi
baharu hendaklah memohon kelulusan bertulis bagi pemasangan loji itu mengikut
subperaturan (2) dan hendaklah mematuhi semua kehendak dalam subperaturan (1)
kecuali perenggan (1)(a) sehingga (f).
BAHAGIAN IV
PERAKUAN KELAYAKAN DAN PEMERIKSAAN
Perakuan kelayakan
5. (1) Bagi maksud pemeriksaan untuk mendapatkan perakuan kelayakan di bawah
subseksyen 27D(2) Akta, pegawai atau orang berlesen hendaklah mengeluarkan suatu
perakuan kelayakan kepada orang itu selepas semua kehendak di bawah
subperaturan 4(1) dipatuhi dan selepas pembayaran fi sebagaimana yang dinyatakan
dalam Jadual Keenam.

(b) jika dandang stim diperiksa, ujian fungsi terhadap semua peranti
keselamatan dandang stim itu apabila dandang stim itu dikendalikan
pada tekanan kerja selamat hendaklah dijalankan;
(c) jika bejana tekanan diperiksa, ujian fungsi terhadap semua peranti
keselamatan bejana tekanan itu hendaklah dijalankan; dan
(d) jika jentera mengangkat diperiksa, ujian beban pada beban yang
dinyatakan dalam verifikasi reka bentuk dan ujian fungsi terhadap
semua peranti keselamatan jentera mengangkat itu hendaklah
dijalankan.
(3) Jika pegawai atau orang berlesen mendapati bahawa loji yang menghendaki
perakuan kelayakan tidak mematuhi mana-mana kehendak yang dinyatakan di bawah
subperaturan (2), orang yang berniat untuk mengendalikan atau menyebabkan atau
membenarkan untuk dikendalikan mana-mana loji yang telah dipasang di bawah
seksyen 27C Akta hendaklah membayar kepada pegawai atau orang berlesen itu fi
sebagaimana yang dinyatakan dalam Jadual Keenam bagi perkhidmatan yang diberikan
walaupun tiada perakuan kelayakan dikeluarkan selepas pemeriksaan.
(5) Suatu perakuan kelayakan hendaklah tertakluk pada terma dan syarat seperti
yang berikut:

(c) jika pemunya menjual, memajak, memindah milik atau melupuskan loji
yang menghendaki perakuan kelayakan, pemunya hendaklah
memberitahu pegawai atau orang berlesen dalam tempoh
tiga puluh hari selepas penjualan, pemajakan, pemindahmilikan atau
pelupusan itu; dan
Pemeriksaan berkala
6. (1) Tertakluk pada peraturan 5, pemeriksaan berkala loji yang menghendaki
perakuan kelayakan di bawah seksyen 27E Akta hendaklah dijalankan oleh pegawai atau
orang berlesen selepas pembayaran fi sebagaimana yang dinyatakan dalam
Jadual Keenam.

(b) seseorang pegawai atau orang berlesen boleh mengeluarkan suatu notis
bertulis sekurang-kurangnya empat belas hari sebelum tarikh
pemeriksaan berkala kepada seseorang pemunya atau penghuni
mengenai niatnya untuk menjalankan pemeriksaan berkala;
(g) apa-apa jentera mengangkat kecuali lif, eskalator dan laluan gerak
hendaklah bersedia untuk membolehkan jentera mengangkat diuji
dalam keadaan beban kerja selamat dan untuk memastikan semua
peranti keselamatan berfungsi dengan baik;

(h) apa-apa lif, eskalator dan laluan gerak hendaklah bersedia untuk
membolehkan lif, eskalator dan laluan gerak diuji untuk memastikan
semua peranti keselamatan berfungsi dengan baik; dan
(3) Bagi maksud subperaturan (1) dan (2), fi sebagaimana yang dinyatakan dalam
Jadual Keenam hendaklah dibayar oleh pemunya atau penghuni, mengikut mana-mana
yang berkenaan, bagi setiap lawatan pemeriksaan berkala.
Penyenggaraan
8. (1) Seseorang pemunya loji yang menghendaki perakuan kelayakan hendaklah
memastikan loji yang menghendaki perakuan kelayakan disenggara pada setiap masa
supaya loji itu berada dalam keadaan selamat dan berfungsi dengan baik.

(2) Seseorang pemunya hendaklah memastikan lif, eskalator, laluan gerak, kren
menara, kelengkapan akses gantung, gantri pelancaran, kren dermaga dan pengangkat
penumpang disenggara oleh orang kompeten mengikut tatacara sebagaimana yang
dinyatakan dalam Jadual Kesebelas.
Pembaikan
9. (1) Seseorang pemunya atau penghuni hendaklah memberikan suatu notis
bertulis kepada pegawai atau orang berlesen sebelum menjalankan pembaikan
atas mana-mana loji yang menghendaki perakuan kelayakan.
(3) Mana-mana loji yang menghendaki perakuan kelayakan yang dibaiki di bawah
subperaturan (2) hendaklah diuji dan diteliti sebagaimana yang dikehendaki oleh
standard yang diiktiraf dan di bawah pengawasan orang kompeten.
Pembukaan
10. (1) Pemunya atau penghuni hendaklah memastikan hanya orang kompeten yang
diberi kuasa untuk membuka dandang stim dan jentera mengangkat sebagaimana yang
dinyatakan dalam Jadual Ketujuh.

Pengubahan
11. (1) Seseorang pemunya tidak boleh, melainkan jika kelulusan bertulis telah
diberikan oleh Ketua Pengarah, membuat atau menyebabkan supaya dibuat apa-apa
pengubahan kepada loji yang menghendaki perakuan kelayakan dengan mengemukakan
apa-apa butiran dan dokumen sebagaimana yang ditentukan oleh Ketua Pengarah.
(3) Setiap loji yang menghendaki perakuan kelayakan selepas selesai pengubahan
hendaklah tertakluk pada pemeriksaan di bawah seksyen 27D Akta sebelum
dikendalikan.

(3) Orang kompeten yang merupakan operator kren yang mengendalikan kren
menara atau kren bergerak hendaklah—

(b) menjalankan ujian operasi terhadap semua suis had dan peranti
penunjuk tanpa apa-apa beban sebelum apa-apa operasi mengangkat
dijalankan dan keputusan ujian itu hendaklah direkodkan dalam buku
log atau lembar log sebelum permulaan setiap syif kerja; dan

Pembayaran fi
17. (1) Apa-apa fi yang dibayar di bawah Peraturan-Peraturan ini tidak boleh
dibayar balik.
Penandaan loji
18. Pemunya mana-mana loji yang menghendaki perakuan kelayakan hendaklah
membuat penandaan nombor pendaftaran dan mempamerkan secara ketara pada loji itu.
Rekod
19. (1) Seseorang majikan hendaklah menyimpan dan menyenggara rekod
penyenggaraan loji yang menghendaki perakuan kelayakan.

menyeluruh loji yang menghendaki perakuan kelayakan dalam bahasa kebangsaan atau
bahasa Inggeris yang mudah difahami.
Ketidakpakaian
21. Peraturan-Peraturan ini tidak terpakai bagi—
(a) bejana tekanan sebagaimana yang dinyatakan dalam Jadual Kedua; dan

BEJANA TEKANAN
1. Bejana tekanan yang mempunyai tekanan reka bentuk dalaman atau luaran yang
tidak melebihi lima belas paun seinci persegi (15 PSIG) tanpa mengira saiz
bejana tekanan itu.
2. Bejana tekanan yang mempunyai diameter dalaman, lebar, tinggi atau pepenjuru
keratan rentas yang tidak melebihi enam inci tanpa mengira panjang atau tekanan
bejana tekanan itu.
4. Bejana tekanan dengan dua atau lebih kebuk yang mempunyai tekanan
reka bentuk dalaman atau luaran pada setiap kebuk yang tidak melebihi
lima belas paun seinci persegi (15 PSIG) dan tekanan kebezaan antara setiap
kebuk yang tidak melebihi lima belas paun seinci persegi (15 PSIG) tanpa mengira
saiz bejana tekanan itu.

7. Bejana tekanan iaitu penukar haba plat atau penukar haba pilin.
8. Bejana tekanan yang menjadi suatu komponen pakej pendingin bagi bangunan.
9. Bejana tekanan yang berada dalam kotak sejuk pakej lengkap iaitu penukar haba
aluminium di pateri yang terkandung dalam selongsong keluli karbon dengan
sokongan struktur, pembendungan penebat dan perlindungan untuk peralatan
dalaman.
10. Bejana tekanan iaitu silinder gas yang digunakan untuk penyimpanan dan
pengangkutan gas termampat, terlarut dan cecair.

JENTERA MENGANGKAT
3. Jentera mengangkat yang digunakan untuk memacu cerucuk atau cerucuk gerudi
ke dalam tanah untuk membina tiang, jambatan, empangan dan struktur sokongan
tiang lain sebagai sebahagian daripada asas kekal untuk bangunan atau struktur
lain yang dilekapkan di atas roda berantai.
5. Jentera mengangkat yang dipasang sebagai perata dok iaitu kelengkapan kekal
yang diletak di pintu dok yang digunakan untuk menaik atau menurunkan paras
dok.
7. Jentera mengangkat yang digunakan sebagai platform atau laluan bertingkat yang
menyediakan laluan seperti menara laluan.

10. Jentera mengangkat yang menjadi kelengkapan sistem simpanan dan dapat
kembali automatik.
11. Jentera mengangkat iaitu kren yang ketinggian mengangkat tidak melebihi
sembilan meter dan beban kerja maksimanya tidak melebihi lapan puluh kilogram.
12. Jentera mengangkat yang menggunakan udara atau pneumatik dan beban kerja
maksimanya yang tidak melebihi lima ratus kilogram.

Dokumen yang berikut hendaklah dikemukakan sama ada dalam bahasa kebangsaan
atau bahasa Inggeris bagi maksud permohonan bagi verifikasi reka bentuk:
(a) sijil penilaian reka bentuk daripada badan pemeriksaan yang diberi kuasa;
(b) lukisan reka bentuk yang ditentusahkan oleh badan pemeriksaan yang
diberi kuasa;
(c) kiraan reka bentuk yang menggunakan edisi terkini standard yang diiktiraf
dan ditentusahkan oleh badan pemeriksaan yang diberi kuasa;
(d) diagram perpaipan dan instrumentasi bagi autoklaf dan dandang stim
elektrik;
(f) katalog bagi autoklaf dan dandang stim elektrik yang diimport; dan

(b) kiraan reka bentuk yang menggunakan edisi terkini standard yang
diiktiraf; dan
(c) pelan dan pengiraan reka bentuk bagi bejana tekanan yang diimport yang
pendaraban diameter dalaman dengan tekanan reka bentuk berukuran
paun per inci persegi ialah tiga ribu atau lebih hendaklah ditentusahkan
oleh badan pemeriksaan yang diberi kuasa.
(b) kiraan reka bentuk yang menggunakan edisi terkini standard yang
diiktiraf;
(d) sijil dan laporan ujian sistem lif bagi model yang ditentusahkan oleh
badan pemeriksaan yang diberi kuasa;
(f) sijil dan laporan tali dawai daripada pengilang tali dawai.

IN exercise of the powers conferred by sections 27B, 27C, 27D, 27E and 66
of the Occupational Safety and Health Act 1994 [Act 514], the Minister makes
the following regulations:
PART I
PRELIMINARY
Interpretation
2. In these Regulations—
"authorized inspecting body" means any entity listed in the First Schedule;
“safe working load” means the maximum load of lifting machinery as specified
in the design verification approved under paragraph 4(1)(a);
“pressure vessel” means an enclosed vessel with pressure greater or less than
atmospheric pressure;
“steam boiler” means any closed vessel for any purposes which steam is generated
under pressure greater than atmospheric pressure and includes any economiser used to
heat water being fed to the vessel and any super heater used for heating steam and
any pipes and fittings connected to the closed vessel;

(a) is a powered device equipped with mechanical means for raising or lowering
loads suspended by a hook or other load handling device which can reposition
or move a suspended load vertically or horizontally by the movement of
the crane or the boom, jib, trolley or other such part of the crane; and
(b) includes all parts of the crane including wire ropes, hook or load handling
device, or any other device used to move the hook;

"quay crane" means a lifting machinery which is a crane installed at quay used to
raise or lower containers and move on a fixed runway;
"overhead travelling crane" means a lifting machinery which is a crane with a girder
equipped with a device for raising and lowering loads and move on a fixed runway;
"tower crane" means a lifting machinery which is a crane with a boom or jib which
is mounted on a vertical tower to raise and lower a suspended load and for the movement
of such loads by changing the radius or slewing;
"walkalator" means a lifting machinery for the conveyance of person in which the
user carrying surface remains parallel to each direction of motion and is uninterrupted;

"owner" means a person who receives rent or profit by leasing any of the plant
requiring certificate of fitness whether on his own account or as an agent or trustee for
any other person;
"hoist" means a lifting machinery which is a passenger hoist and a material hoist;
(a) the design that may affect the strength, integrity or functional capability of
any of the plant requiring certificate of fitness;
(b) the safe working pressure for steam boilers and pressure vessels;
(d) the travel distance, size, rated speed or rated load for lifts;
"heating surface" means, in respect of a steam boiler, the total surface of all plates
and tubes exposed to heat on one side and in contact with water on the other, measured
on the water or fireside, whichever is the greater, and excluding the heating surface of
any economiser and superheater connected to it;

"lifting tackle" means any device used directly or indirectly to connect a load to
lifting machinery but not permanently attached to the load, including a chain sling or
rope, shackle, link, hook, swivel, eye bolt, chain, rope, pulley block and chain block;

(e) ensure that the plant requiring certificate of fitness is new or has never
suffered from any deterioration if the plant requiring certificate
of fitness is manufactured outside Malaysia;
(f) in relation to any used plant requiring certificate of fitness imported into
Malaysia—

(g) where the plant requiring certificate of fitness is a steam boiler or lifting
machinery as specified in the Seventh Schedule, ensure that the steam
boiler or lifting machinery installed by a competent person or an origin
manufacturer;
(h) ensure the foundation for the installation of any plant requiring
certificate of fitness is adequately designed and constructed to support
and withstand the load imposed on it;
(j) ensure the plant requiring certificate of fitness complies with the
recognized standard;

(n) obtain the required test and examination reports with the particulars as
specified in the Ninth Schedule.
(2) Where the requirements under subregulation (1) have been complied with,
any person may apply for written approval for the installation of a plant requiring
certificate of fitness from the Director General in the form and manner as determined by
the Director General.
(3) In the case of a plant requiring certificate of fitness which has been issued
certificate of fitness for a specific location but will be relocated to a new location,
any person who intends to install the plant at the new location shall apply for
written approval for the installation of the plant according to subregulation (2) and
shall comply with all requirements in subregulation (1) except paragraphs (1)(a) to (f).
PART IV
CERTIFICATE OF FITNESS AND INSPECTION
Certificate of fitness
5. (1) For the purposes of an inspection to obtain a certificate of fitness under
subsection 27D(2) of the Act, an officer or licensed person shall issue a certificate of
fitness to the person upon all requirements under subregulation 4(1) are complied with
and upon payment of the fee as specified in the Sixth Schedule.
(a) the owner shall make preparation for the inspection of the plant
requiring certificate of fitness;

(b) where a steam boiler is inspected, a functional test on all safety devices
of the steam boiler when the steam boiler is operated at safe working
pressure shall be carried out;
(d) where lifting machinery is inspected, a load test at the load specified in
the design verification and a functional test on all safety devices of the
lifting machinery shall be carried out.
(3) If an officer or licensed person finds that a plant requiring certificate of fitness
does not comply with any of the requirements under subregulation (2), the person who
intends to operate or cause or permit to be operated of any plant installed
under section 27C of the Act shall pay to the officer or licensed person the fee as specified
in the Sixth Schedule for the services rendered even though there is no certificate of
fitness issued upon inspection.
(5) A certificate of fitness shall be subject to the following terms and conditions:
(b) the certificate of fitness for any plant requiring certificate of fitness
which operates in portable form without being dismantled shall remain
valid even though the plant is relocated after the certificate of fitness has
been issued;

(d) where an owner finds that his plant requiring certificate of fitness has
fallen into disuse, the owner shall notify the officer or licensed person
within thirty days of becoming aware that the plant has fallen into
disuse.
(6) The certificate of fitness issued under subregulation (1) shall be valid for a
period of fifteen months from the date of inspection.
Periodical inspection
6. (1) Subject to regulation 5, a periodical inspection of plant requiring certificate of
fitness under section 27E of the Act shall be carried out by an officer or a licensed person
upon payment of the fee as specified in the Sixth Schedule.
(2) The inspections under subregulation (1) shall be in accordance with the
following manner:

(d) upon receiving notice under paragraph (b), the owner or occupier shall
be responsible for the preparation for the periodical inspection by
providing their plant requiring certificate of fitness for the periodical
inspection according to the Act, regulations, recognized standard and
any requirements that may be determined by the Director General;
(e) any steam boiler shall be available for internal inspection at each
periodical inspection;
(f) any pressure vessel shall be available for internal inspection at each
periodical inspection unless the pressure vessel has been designed
not subject to internal inspection;
(g) any lifting machinery except for lifts, escalators and walkalators shall be
available to enable the lifting machinery to be tested under safe working
load condition and to ensure that all safety devices are in good working
condition;
(h) any lifts, escalators and walkalator shall be available to enable lifts,
escalators and walkalator to be tested to ensure that all safety devices
are in good working condition; and
(i) any plant requiring certificate of fitness that complies with all
requirements under the Act, regulations, and recognized standard
shall be issued a certificate of fitness by the officer or licensed person
and shall be valid for a period of fifteen months from the date of
inspection.

(2) The owner shall resubmit a written notice for the periodical inspection if the
plant requiring certificate of fitness is not available for periodical inspection.
(3) For the purposes of subregulations (1) and (2), a fee as specified in the
Sixth Schedule shall be paid by an owner or occupier, as the case may be, for each visit of
periodical inspection.
Maintenance
8. (1) An owner of a plant requiring certificate of fitness shall ensure that the plant
requiring certificate of fitness is maintained at all times so that the plant is in a safe and
in good working condition.
(2) An owner shall ensure that lift, escalator, walkalator, tower crane,
suspended access equipment, launching gantry, quay crane and passenger hoists are
maintained by competent person according to the procedures as specified in the
Eleventh Schedule.
(3) An owner shall enter into an agreement with a competent person for the
servicing, adjustment and comprehensive examination of lifts, escalators and
walkalators, and the duration of the agreement shall not be less than one year.
Repair
9. (1) An owner or occupier shall give a written notice to the officer or licensed
person before carrying out repairs on any plant requiring certificate of fitness.

(2) An owner or occupier shall ensure that the repairs of any plant requiring
certificate of fitness are carried out by a competent person in accordance with the
requirement of the manufacturer, recognized standard or good engineering practice.
(3) Any plant requiring certificate of fitness repaired under subregulation (2)
shall be tested and examined as required by recognized standard and under the
supervision of a competent person.
Dismantling
10. (1) The owner or occupier shall ensure that only competent persons are
authorized to dismantle steam boiler and lifting machinery certificate of fitness as
specified in the Seventh Schedule.
(2) The owner or occupier who contravenes this subregulation (1) commits
an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit
or to imprisonment for a term not exceeding one year or to both.
Alteration
11. (1) An owner shall not, unless written approval has been granted by
the Director General, make or cause to be made any alteration to plant requiring
certificate of fitness by submitting any details and documents as determined by
the Director General.
(2) An owner shall ensure any alteration to plant requiring certificate of fitness
is carried out by any party specified in the approval granted under subregulation (1)
according to the manufacturer's requirements, recognized standard or good engineering
practice.
(3) Each plant requiring certificate of fitness after completion of alterations shall
be subjected to inspection under section 27D of the Act before being operated.
(4) For the purpose of subregulation (1), every application for approval of
alterations shall be accompanied with a processing fee as specified in the Sixth Schedule.

(5) The owner who contravenes this regulation commits an offence and shall, on
conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for
a term not exceeding one year or to both.
PART V
CONTROL AND OPERATION OF STEAM BOILER
(2) An owner or occupier shall ensure any steam boiler is operated and be in
charged by a competent person who is a steam boiler operator as specified in
Twelfth Schedule.
(4) Subregulations (1), (2) and (3) shall not apply to—
(e) any other steam boiler that retains the steam that it generates.

PART VI
USE, EXAMINATION AND OPERATION OF LIFTING MACHINERY
(2) The competent person carrying out the comprehensive examination shall
provide a comprehensive examination report with the particulars as specified in the
Fourteenth Schedule.
(2) The owner or occupier shall establish lifting plan by taking into account the
risk assessment report so that the tower crane or mobile crane can be operated safely.

(3) The competent person who is a crane operator who operates tower crane or
mobile crane shall—
(b) carry out operational test on all limit switch and indicator device
without any load before any lifting operation is carried out and the test
results shall be recorded in the logbook or log sheet before the start of
each work shift.
(c) ensure the ground condition especially the surface on which the mobile
crane will be operated is safe for any movement or lifting operation,
and if he deems it unsafe for any movement or lifting operation, he shall
report the matter to the employer or occupier.
(4) Any owner or occupier who contravenes subregulations (1) and (2) commits
an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand
ringgit or to imprisonment for a term not exceeding one year or to both.
(2) The owner or occupier shall, so far as is practicable, to ensure that the lifting
tackle is in good condition before using it on lifting machinery.

PART VII
MISCELLANEOUS
Payment of fees
17. (1) Any fee paid under these Regulations shall not be refundable.
(2) The Government is exempted from making payment for the inspection of plant
requiring certificate of fitness operated and owned by the Government.
Marking of plant
18. The owner of any plant requiring certificate of fitness shall make a marking of the
registration number and display prominently on the plant.
Record
19. (1) An employer shall keep and maintain records of the maintenance of plants
requiring certificate of fitness.
(2) The records of the maintenance referred to in subsection (1) shall contain the
following details:
(a) the condition and effectiveness of any essential fittings or safety devices
installed on plant requiring certificate of fitness;

Non-application
21. These Regulations shall not apply to—
(b) the manual lifting machinery and lifting machinery as specified in the
Third Schedule.

foundation of a building or other structure mounted on a chain wheel.

2. Ensure a lift machinery room and pit is only used for a lift, escalator or walkalator
and equipment related to it.
5. Display a guide in the lift on the way to use emergency button or call button when
malfunctions occur to the lift.
6. Display the following signage in a fixed location adjacent to the entrance of each lift
machinery room:
