OFFICE REPORT
The above-mentioned matters were listed before the Hon’ble Court on 12th September,
2023 with Office report dated 11th September, 2023, when the Court was pleased to pass the
following order :
1. Pursuant to the order dated 13.10.2020, the Joint Director,
Directorate of Technical Education has computed the amount payable by
the Management in terms of the order dated 27.05.2020.
2. According to the learned counsel appearing on behalf of the
respondent – State, the amount is Rs.78,87,849/-. The Management has
deposited only a sum of Rs.23,25,978/-.
3. Let the balance amount be also deposited with the Registry of this
Court within four weeks.
4. Upon being deposit of the above-mentioned amount, the Registry
is directed to invest the same in an interest-earning Fixed Deposit Receipt,
in any Nationalized Bank, which fetches maximum rate of interest,
initially for a period of six months with auto renewal facility.

5. Post these matters for hearing on 05.12.2023.”

It is submitted that in view of Order dated 12th September, 2023. Dr. Harsh Surana,
Advocate on behalf of the Petitioner in SLP (C) Nos. 7313-7314 of 2020 has on 12 th
October, 2023 deposited an amount of Rs. 55,41,993/- (Rupees Fifty Five Lakh Forty One
Thousand Nine Hundred and Ninety Three only) alongwith a letter dated 10 th October,
2023 stating therein that in view of Order dated 12 th September, 2023, the amount to be
deposited is Rs. 55,61,871/-, but the client has given the amount of Rs. 55,41,993/- only
(copy of letter dated 10.10.2023 is enclosed). Accordingly, in view of order quoted above,
the amount of Rs. 55,41,993/- (Rupees Fifty Five Lakh Forty One Thousand Nine Hundred
and Ninety Three only) has been invested in an FDR for a period of six months bearing
maturity date of 17th April, 2024.
It is further submitted that Mr. Atul B. Dakh, Advocate has on 25 th November, 2023
filed an application for permission to withdraw the amount of Rs. 78,87,849/- as deposited
by the Petitioners with the Registry of this Hon’ble Court in terms of Orders dated 27 th
May, 2020 and 12th September, 2023 alongwith Annexures A- 1 to A-3. The application has
been registered as I.A. No. 244832 of 2023 and included with the SLP paperboosks.
It is further submitted that in view of Order 27th May, 2020, Dr. Harsh V. Surana,
Advocate for the Petitioner has already on 17th July, 2020 deposited a sum of Rs.
23,25,978/- (Rupees Twenty Three Lacs Twenty Five Thousand Five Thousand Nine
Hundred Seventy Eight only) and the same was invested in FDR, which has been renewed
from time to time and now FDR of Rs. 26, 21, 626 (Rupees Twenty Six Lakh Twenty One
Thousands Six Hundred and Twenty Six only- inclusive of interest) has been renewed for
further period of one year and bears maturity on 29th February, 2024.
Service of notice is complete in both the matters above-mentioned.
The matters alongwith applications in the matters above-mentioned are listed before
the Hon'ble Court with this office report.
