existence of a conflict of jurisdiction and ‫ ض ر ر ر ر ررد‬ARB-037-2020 ‫نيلضر ر ر ر ر ررل ر ك‬ ‫ ر‬. ‫ني ر ع ب‬
competence between the Dubai Courts and the ‫نيط ع ل على سر د من أن علد ني ل يل من نيب طن ني بن‬
DIFC Courts, especially since both courts have ‫نذنع ةتك يس ةتة عن‬ . ‫ة أنة تع ح‬ ‫د نص‬ ‫ب‬
not abandoned the lawsuit. ‫ةل نختص د نيتحك ك ي نيذ دع‬ ‫طرةق نيتحك ك يك ن‬

registered under the No. ARB-037-2020; And ‫ أن‬ARB-037-2020 ‫نيررردع ى ني س ر ر ر ررتل ررل يح ررت ر ك‬
that the Dubai Courts do not have jurisdiction ‫مح يك دع ي س ي ن ختصر ر ر ر د نيلضر ر ر ر ئع ي ظن نيدع ى‬
nor competence to hear the case registered ‫ أنة ةت‬،‫زئع‬. ‫ يت ري‬2020/2536 ‫ني س ررتلل يحت ر ك‬
under the No. 2536/2020 Commercial Partial. ‫ أن ي ررد‬،‫عل ر ر أن يت ف على ني ر عن نظن ني رردع ى‬
Hence, they should stop perusing the lawsuit ‫نيط ع ل ي ل نيتك ي ف نيت يكبدي ني طع ن ضد‬
with immediate effect and shall oblige the ‫ي ن ةستلذ ي ن ن شنط ن‬ ‫ح ث أنة عن ن ختص د ي‬
‫ح ر يررل ي ر زع نختصر ر ر ر ر ر د ب ن مح ر يك دع‬ ‫أ ي ر أن يل‬

With regards to competence and jurisdiction, .‫نيت زع‬

conditions, the first of which has been that a ‫ب ختصر ر ر ر د ب ظن نيدع ى أ أن‬ ‫ةت سر ر ر ر‬ ‫أن يق م‬
lawsuit of a jurisdictional conflict arising by and ‫ي ر زع ر ب ن‬ ‫ر‬ ‫أن‬ ‫ةع‬ ‫ر ةتخلى عن نظن ر‬ ‫يال‬
between the Dubai Courts and the DIFC Courts, ‫ن أخنى أن يتحلق‬ ‫على نختصر ر ر ر د محك ل‬ ‫نيخصر ر ر ر‬
and that one or both litigants or the attorney ‫يحلق نيت ر ر ر زع ب ن‬ ‫ إ أن ني ع‬،‫حر ر ر ي ر ررل نيت ر ر ر زع‬
general of either body shall submit a request to . ‫ني حك ت ن ي س نيخص‬

courts shall have issued evidence indicating that ‫ أن منيذ دع يلتحك ك ني ررد ع ني ررذي حر رق‬،‫زئع‬. ‫يتر ر ري‬
both of them adhere to the jurisdiction and ‫محررق مؤسر ر ر ر رسر ر ر ر ررل نيتحك ك تع منيذ دع ني ر ع نيعر ي‬
competence to peruse the lawsuit, or that both of ‫ بش ن منيذ دع‬2021 ‫ يس ل‬34 ‫ر ك‬ ‫"ني نس‬ . ‫ب‬

Whereas, since it is established from the what the .‫نيل ن ن متع ن نين ض‬ ‫غ ن أس س من ني ن‬
litigants have submitted, that Dubai Courts shall ‫فلهذه ا سباب‬
peruse the Case No. 2536 of 2020, partial
commercial, and Dubai International Arbitration : ‫ني ئل‬ ‫نر‬
Center, which replaced Arbitration Institution at . ‫نيطعن شكال ر ضة م ض ع‬ ‫ب‬ -1
the Dubai International Financial Center under ‫ر ك‬ ‫مبل ني‬ ‫ إيذن نيط ر عن ب ر ي ص ر ر ر ررن ر‬-2
"Decree No. (34) of 2021 pertaining to the Dubai ‫مل بق نيع ب ني ح م ة‬
International Arbitration Center considers case ‫ مص رة نيت م ن‬-3
ARB-037-2020, therefore the case of conflict of
jurisdiction has not been achieved between the
Dubai Courts and the Courts of the Financial
Centre, because neither of them issued

judgments or decisions, explicit or implicit,
stating that both of them relinquish jurisdiction
or both of them stuck to it, making the dispute
regarding jurisdiction without basis devoid of and
fact and law rendering it to be rejected.
For these reasons
Therefore, the Judicial Tribunal has decided:
1- Accepting the Cassation in form and
rejecting it in subject.
2- The Appellant pays the Costs, and an
amount of Two Thousand Dirham against
advocacy fees.
3- Forfeiting the deposit.
