Approves the Technical Quality Regulation and the


Conformity Assessment Requirements for
Automotive Safety Glass – Consolidated.

THE PRESIDENT OF THE NATIONAL INSTITUTE OF METROLOGY, QUALITY AND TECHNOLOGY -


INMETRO, in the exercise of the competence granted to him by articles 4, paragraph 2, of Law No. 5,966,
of December 11, 1973, and 3, items I and IV, of Law No. 9,933, of December 20, 1999, combined with the
provisions of articles 18, item V, of Annex I to Decree No. 6,275, of November 28, 2007, and 105, item V,
of the Annex to Ordinance No. 2, of January 4, 2017, of the then Ministry of Industry, Foreign Trade and
Services, considering what is determined by Decree No. 10,139, of November 28, 2019, and what is
contained in SEI Process No. 0052600.010992/2020-70, Solves:
Object and scope from application
Article 1 The Consolidated Regulation for Automotive Safety Glass is hereby approved, in the form
of the Technical Quality Regulation, the Conformity Assessment Requirements and the Specifications for
the Conformity Identification Seal, set out, respectively, in Annexes I, II and III.
Art. 2 The Technical Quality Regulation, established in Annex I, determines the mandatory
requirements regarding product safety.
Article 3 Suppliers of automotive safety glass shall fully comply with the provisions of this
Regulation.
Art. 4 Automotive safety glass objects of the Regulation, shall be manufactured, imported,
distributed and marketed, in such a way as not to offer risks that compromise the safety of the user,
regardless of the full compliance with the requirements published herein.
§ 1 This Regulation applies to automotive safety glass.
§ 2 Safety glass used in:
I - agricultural machinery, implements and equipment;

II - off-highway vehicles;
III - assembly lines for motor vehicles; IV - vehicles due to
recall;
V - vehicles of discontinued production until December 31, 1999;
VI - vehicles that have exclusively the power/weight ratio (RPP) greater than 140, calculated as
RPP= (Pn/m)*1000 kg/kW, where "Pn" is the power in the unit in kilowatts (kW) and "m" is the mass in
the unit in kilograms (kg);
VII - vehicles that have exclusively a total gross weight (GVW) equal to or less than 3.5 tons and
that have a maximum power of more than 195 kW;
VIII - vehicles covered by this Ordinance and that are imported as part of an assembled set; and
IX - civil construction, furniture industry and household appliances.
Article 5 The automotive safety glass production chain is subject to the following obligations and
responsibilities:
I – the domestic manufacturer shall manufacture and make available, free of charge or for a fee,
automotive safety glass in accordance with the provisions of this Regulation;
II – the importer must import and make available, free of charge or for a fee, automotive safety
glass in accordance with the provisions of this Regulation;
III – the other entities in the production and supply chain of automotive safety glass, including the
trade in physical or virtual establishments, must maintain the integrity of the product, its mandatory
markings, preserving compliance with the requirements of this Regulation.
Sole paragraph. If an entity performs more than one function in the production and supply chain,
among those previously listed, its responsibilities are accumulated.
Requirements Pre-Market
Article 6 glasses fromsafety Automotive Manufactured import
Distributed and marketed in the national territory, free of charge or for a fee, must
be compulsorily submitted to conformity assessment, through the certification mechanism, in
compliance with the terms of this Regulation and the deadline established in article 10.
§ 1 The Conformity Assessment Requirements for Automotive Safety Glass are set out in Annex II,
available at http://www.inmetro.gov.br/legislacao/.
§ 2 Certification does not exempt the supplier from exclusive responsibility for the safety of the
product.
§ 3 Obtaining certification is a condition for the authorization of the use of the Conformity
Identification Seal on products and for their availability in the national market.
§ 4 The model of Conformity Identification Seal applicable to automotive safety glass can be found
in Annex III, available at http://www.inmetro.gov.br/legislacao/.

Vigilance from Market


Art. 7 Automotive safety glass, which is the object of this Regulation, is subject, throughout the
national territory, to market surveillance actions carried out by Inmetro and public law entities linked to
it by a delegation agreement.
Article 8 An action or omission contrary to the provisions of this Ordinance constitutes an
infraction, and may give rise to the penalties provided for in Law No. 9,933 of 1999.
Article 9 The supplier, when submitted to market surveillance actions, shall provide Inmetro, when
requested, with the required information within a maximum period of 15 days.
Deadlines and provisions Transitional
Art. 10. As of January 25, 2023, domestic manufacturers and importers must manufacture or
import, to the domestic market, only automotive safety glass in compliance with the provisions
contained in this Ordinance.
Sole paragraph. From 25 January 2025, counted from the expiry of the period set out in the
Caputthe Domestic manufacturers and importers must sell to the domestic market only in accordance
with the provisions contained in this Ordinance.
Art. 10. As of January 25, 2023, domestic manufacturers and importers must manufacture or
import, for the domestic market, only automotive safety glass in accordance with the provisions
contained in this Ordinance.
Sole paragraph. As of January 25, 2025, counted from the end of the deadline set in the caput,
domestic manufacturers and importers must sell to the domestic market only automotive safety glass in
accordance with the provisions contained in this Ordinance.
Art. 10-A. Automotive glass manufactured until January 25, 2023, with the Conformity
Identification Seals provided for in Annex D of Inmetro Ordinances No. 156, of June 4, 2009, published in
the Federal Official Gazette of June 5, 2009, section 1, page 162, and Ordinance No. 157, of June 4, 2009,
published in the Federal Official Gazette of June 5, 2009, section 1, page 162, may be imported and
marketed to the domestic market, by domestic manufacturers and importers, until January 25, 2031.
Rectification published in the Official Gazette of December 27, 2022.
Art. 11. As of January 25, 2033, establishments that carry out distribution or trade activities must
sell, in the domestic market, only automotive safety glass in accordance with the provisions contained in
this Ordinance.
Sole paragraph. The determination contained in the Caput It does not apply to manufacturers and
importers, who must comply with the time limits laid down in the previous article.
Art. 12. Suppliers of automotive safety glass must comply with the Regulation approved herein, by
the deadline established in article 10 of this Ordinance, regardless of the validity of the certificate
previously granted.
Art. 13. Even during the established compliance periods, domestic manufacturers and importers
remain responsible for the safety of automotive safety glass available in the domestic market and are
responsible for any accident or incident with the user, due to the risks offered by the product.

Sole paragraph. The liability described in the Caput it does not end and is not transferred to the
Product Certification Body (OCP) or to Inmetro, in any case, as the deadline described in article 10 of this
Ordinance expires.
Art. 14. The certification processes concluded based on Ordinance No. 41, of 2018, will not incur
the need to initiate a new certification process based on the requirements consolidated herein.
Sole paragraph. The certificates already issued should only be reviewed in the next stage of
evaluation, for reference to the Ordinance published herein.
Art. 15. Manufacturers and importers of automotive safety glass, with certificates already issued
based on Ordinance No. 41, of 2018, will have until August 26, 2022 to adapt their processes, in order to
exclude the Registration number of the Conformity Identification Seal, as established in article 4 of
Inmetro Ordinance No. 282, of 2020.

Art. 16. The following are hereby repealed:

Duration
Art. 17. This Ordinance enters into force on March 1, 2021, according to article 4 of Decree No.
10,139, of 2019.

ATTACHMENT I - REGULATION TECHNICIAN OF QUALITY


TOWARDS GLASSES FROM SAFETY AUTOMOTIVE

1. GOAL
This Technical Quality Regulation establishes the mandatory requirements for automotive safety glass
to be met by the entire product supply chain in the domestic market.

3. DOCUMENTS
3.1 DOCUMENTS FROM REFERENCE
Standard ABNT NBR 9491:2015 Safety glazing for road vehicles — Requirements.
Contranº Resolution 254 of 2007. Establishes requirements for safety glass and criteria for the
application of inscriptions, pictograms and films in the glazed
areas of motor vehicles, in accordance with item III, of article 111
of the Brazilian Traffic Code – CTB.

4. DEFINITIONS
For the purposes of this Regulation, the definitions contained in the ABNT NBR 9491:2015 Standard must
be adopted.

5. REQUIREMENTS GENERAL
5.1 All automotive safety glass must be designed and manufactured in such a way that it does not offer
harm to the consumer.
5.2 Automotive safety glass must be permanently marked with information that allows its traceability, in
a place that is easy to see after installation in the vehicle.
5.3 Automotive safety glass applied to windshields should be laminated glass only.
5.4 Automotive safety glass applied to side and rear glazed areas of the vehicle can be either tempered
or laminated glass.

6. REQUIREMENTS TECHNICAL

6.1 Tempered automotive safety glass must ensure safety against shattering after breakage, so that the
fragmentation standard complies with the ABNT NBR 9491:2015 standard.
6.2 Tempered or laminated automotive safety glass must demonstrate impact resistance as described in
the ABNT NBR 9491:2015 technical standard.
6.3 Automotive safety glass must have adequate light transmission (transmittance) and must comply
with art. 3 of Contran Resolution No. 254, of 2007 or substitute and present compliance with the ABNT
NBR 9491:2015 standard.
6.4 The pigmentation strip for laminated glass in windshields, with light transmission of less than 70%,
cannot invade vision areas A and B, according to the ABNT NBR 9491:2015 standard.
6.5 The maximum optical distortion values of automotive safety glass applied to windshields shall not
exceed the following:

6.6 Laminated automotive safety glass applied to windshields must be separated from the secondary
image, according to the ABNT NBR 9491:2015 standard.
6.7 Laminated automotive safety glass must be resistant to radiation, in accordance with the provisions
of the ABNT NBR 9491:2015 standard.
6.8 Laminated automotive safety glass must be resistant to moisture, as provided for in the ABNT NBR
9491:2015 standard, containing the following characteristics:
(a) difficulty index for colourless film equal to 1 and for coloured films, including gradient band film,
equal to 2;
b) No whitish spots or delamination on the intermediate film more than 10 mm from the uncut edges or
more than 15 mm from the cut edges.
6.9 Laminated automotive safety glass must have high temperature resistance, as provided for in the
ABNT NBR 9491:2015 standard, containing the following characteristics:
6.9.1 The hardness index for colourless film is 1 and for coloured films, including gradient band film, is 2,
and bubbles, penetrations, peeling and discolouration shall not occur, except:
(a) in a 10 mm wide strip in the marginal area and on either side of any cracks that may appear in the
glass;
b) in a strip 15 mm wide from the uncut edge (original edge of the windshield glass) and in a 25 mm wide
strip from the other edges.
6.10 Laminated automotive safety glass must have abrasion resistance and light diffusion of no more
than 2%, as provided for in the ABNT NBR 9491:2015 standard.

7. REQUIREMENTS FROM MARKINGS And INFORMATION MANDATORY IN PRODUCT

All automotive safety glass available in the domestic aftermarket must be permanently marked, at a
minimum, with the following information:
I - the brand of the manufacturer of the glass, in accordance with current legislation; and
II - Conformity Identification Seal, in accordance with Annex III of these Regulations.

Establish criteria and procedures for assessing conformity for automotive safety glass, with a focus on
safety, through the certification mechanism, aiming at the prevention of accidents in its use.

4. DEFINITIONS
For the purposes of this RAC, the following definitions are adopted, complemented by those contained
in the complementary documents mentioned in item 3 and in the Technical Quality Regulation for
Automotive Safety Glass.
4.1 Family
Automotive glass, from the same production process and the same manufacturing unit, whose nominal
thickness ranges, in millimeters, are divided as follows:

5. MECHANISM FROM EVALUATION OF COMPLIANCE


The conformity assessment mechanism for Automotive Safety Glass is certification.

6. STEPS OF EVALUATION OF COMPLIANCE


This RAC establishes 2 (two) different certification models, and it is up to the supplier to choose one of
them:
a) Certification Model 5 – Initial evaluation consisting of tests on samples taken from the manufacturer,
including audit of the Quality Management System - QMS, followed by periodic maintenance evaluation
through the collection of a sample of the product in the trade, to carry out conformity assessment and
QMS audit activities.
b) Certification Model 1b – Batch test. 6.1

The supplier must submit a formal request to the OCP, providing the documentation described in the
RGCP, in addition to the descriptive memorial of each product family to be certified, containing its
specifications and application in the product.

The criteria for analyzing the request and the compliance of the documentation must follow the
requirements established in the GDPR.

6.1.1.4.2 Definition Of Sampling


The criteria for the definition of sampling shall follow the requirements set out in the CPR.
6.1.1.4.2.1 The sample collection must be carried out by the OCP randomly in the production process of
the product object of the request, provided that the product has already been inspected and released by
the factory's quality control, or in the dispatch area, in packages ready for commercialization.

6.1.1.4.2.3 All tests, measurements, inspections and simulations of use must be performed on the

The criteria for handling non-conformities in the initial assessment stage must follow the requirements
established in the GDPR.
6.1.1.6Issuance of the Certificate from Compliance
The criteria for issuing the Certificate of Conformity must follow the requirements established in the
GDPR. The Certificate of Conformity must be valid for three (3) years.

6.1.2 Evaluation from Maintenance


After the Certificate of Conformity is granted, the monitoring of the Certification is carried out by the
OCP to verify whether the technical and organizational conditions that gave rise to the initial granting of
the certification continue to be fulfilled.
6.1.2.1Audit from Maintenance
The criteria for maintenance auditing must follow the requirements set out in the GDPR. The
Maintenance Audit must be completed within eighteen (18) months from the date of issuance of the
certificate.
6.1.2.2Plan from Tests from Maintenance
The criteria for the maintenance test plan shall follow the requirements set out in the CPR. Maintenance
tests must be completed within 18 (eighteen) months after the granting of the Certificate of Conformity,
for each certified family. In addition, maintenance tests should also be carried out whenever there are
facts that recommend that they be carried out before this period.

6.1.2.4Confirmation Of Maintenance
The criteria for confirming maintenance must follow the requirements set out in the GDPR.
6.1.3 Evaluation from Recertification
The criteria for recertification assessment are set out in the RGCP. The Recertification Assessment must
be carried out every three (3) years, and must be completed by the expiration date of the Certificate of
Conformity.
6.2 Model from Certification 1b
6.2.1 Evaluation Initial
6.2.1.1Request from Certification
The supplier must submit a formal request to the OCP, providing the documentation described in the
RGCP, in addition to evidencing the identification of the lot size of the family to be certified.
Note: The certification lot is composed of products from the same family, although from different
manufacturing batches. It is up to the OCP to identify the size of the certification lot, based on the
definition of family established in item 4.1 of this RAC.
6.2.1.2Analysis Of Request and Of Documentation
The criteria for analyzing the request and documentation must follow the requirements established in
the GDPR.
6.2.1.3 Plan from Tests
The criteria of the test plan shall follow the requirements set out in the GDPR.
6.2.1.3.1 Definition Of Tests the Be Performed
The tests shall follow the definition in sub-item 6.1.1.4.1 of this
RAC. 6.2.1.3.2 Definition Of Sampling
6.2.1.3.2.1 The sampling criteria shall follow the provisions of the GDPR. The OCP is responsible for
witnessing the collection of samples of the object to be certified.
6.2.1.3.2.2 The sample size, per family, must be determined according to the ABNT NBR 5426 standard,
with a simple sampling plan, normal distribution, inspection level S1 and EQS of 2.5.

6.2.1.3.2.3 The OCP, when collecting the sample, must prepare a sampling report, detailing the date,
place, identification of the lot collected and the conditions under which it was obtained, as established
in the RGCP.
6.2.1.3.3 Definition of the laboratory
The definition of the laboratory must follow the requirements set forth in
the GDPR. 6.2.1.4 Emission of the Certificate from Compliance
The criteria for issuing the Certificate of Conformity must follow the conditions described in the GDPR. In
the Certificate of Conformity, the models of the family must be noted in accordance with the
requirements described in item 6.1.1.6.1 of this RAC.

7. TREATMENT FROM COMPLAINTS


The criteria for handling complaints must follow the requirements set forth in the GDPR.

8. ACTIVITIES PERFORMED BY OCP BELIEVED BY MEMBER OF THE MLA OF THE IAF


The criteria for activities performed by an accredited OCP per member of the IAF MLA must follow the
requirements set out in the RGCP.

9. TRANSFER OF CERTIFICATION
The criteria for transferring certification must follow the requirements set forth in the GDPR.

10. CLOSURE OF CERTIFICATION


The criteria for termination of certification must follow the requirements established in the GDPR.

11. STAMP FROM IDENTIFICATION OF COMPLIANCE


11.1 The general criteria for the Conformity Identification Seal are set out in the GDPR.
11.2 The Conformity Identification Seal shall be affixed to the certified product as set out in Annex III.

12. AUTHORIZATION TOWARDS USE OF THE STAMP FROM IDENTIFICATION OF COMPLIANCE


The criteria for authorizing the use of the Conformity Identification Seal must follow the provisions of the
GDPR.

13. RESPONSIBILITIES And LIABILITIES


The criteria for responsibilities and obligations should follow the requirements set out in the GDPR.

14. ACCOMPANIMENT IN MARKET


The criteria for monitoring in the market shall follow the requirements set out in the GDPR.

ATTACHMENT III – STAMP FROM IDENTIFICATION OF COMPLIANCE

The Conformity Identification Seal must be silk-screened on glass or equivalent technology, provided
that it is permanent and indelible.
The minimum size of the "I" symbol on the Conformity Identification Seal must be at least 5mm.
