 The duties of the employer stipulated in the Regulations are:

1. Identifying chemicals hazardous to health


2. Complying with the permissible exposure limits
3. Carrying out chemical health risk assessment
4. Taking action to control hazardous exposure
5. Labelling and relabelling chemicals hazardous to health
6. Providing information, instruction and training
7. Monitoring employee exposure at the place of work
8. Conducting health surveillance
9. Posting of warning signs
10. Record keeping

Application

These Regulations shall apply to all places of work (which are within the
jurisdiction of the OSHA 1994) where chemicals hazardous to health are
used, except chemicals that are:
 defined as radioactive materials in the Atomic Energy Licensing Act
1984;
 foodstuffs;
 Hazardous to health solely by the virtue of their explosive or flammable
properties, or low temperature or a high pressure; and
 pharmaceutical products

What is Chemical Hazardous to Health?

Chemicals are considered hazardous to health if:


 listed in Schedule I, II and III of USECHH Regulations 2000
 they have one or more classification under the health hazard class in
CLASS Regulations 2013
 defined as pesticide under the Pesticides Act 1974
 listed in the First Schedule of the Environmental Quality (Schedule
Wastes) Regulations 1989

Register of Chemicals Hazardous to Health

a. Employer – shall identify and record in a register all chemicals hazardous


to health used in a place of work
b. Contain of:
i. A list of chemicals hazardous to health used;
ii. Current SDS for each of chemicals hazardous to health except for
pesticides which shall have information as specified in Schedule III
iii. Average quantity used, produced or stored per month/per year
whichever is applicable for each of CHH
iv. The process and work area where CHH are used
v. Name & address of supplier of each CHH

Assessment Of Risk To Health

1. Assessment of risk to health shall be carried out by a registered


assessor (registered with DOSH) before doing any work involving
chemicals hazardous to health.
2. Assessor must furnish the employer the report of assessment within
one(1) month of completion of assessment
3. If result of assessment indicate likely cause immediate danger assessor
must inform employer immediately.

to the lowest practicable level, or for those chemicals to which have been

ACTION TO CONTROL EXPOSURE

Engineering Control
(1) Any engineering control equipment shall be -
(a) inspected at an appropriate intervals by the employer, each interval
being no longer than one month; and
(b) examined and tested for its effectiveness by a hygiene technician at
appropriate intervals, each interval being no longer than twelve
months.
(2) Every engineering control equipment shall be maintained and operated
at all times.

Label and Relabeling

Duty of employer to ensure labelling

(1) An employer shall ensure that all chemicals hazardous to health


supplied or purchased by him and used in the place of work are labelled
and that the labels are not removed, defaced, modified or altered.

(2) When the labels mentioned in subregulation (1) are removed, defaced,
modified or altered while the chemical hazardous to health is being
used at the place of work, the employer shall re-label the chemical.

Information, Instruction And Training

 The employer shall provide information, instruction and training to all


employees who may be exposed or are likely to be exposed to chemicals
hazardous to health.
 From the information, instruction and training given, the employee should
be able to know:
1. The risk to health created by such exposure
2. The precaution that should be taken

 All training programmes shall be documented and kept for inspection by


any occupational safety and health officer.

PART VIII MONITORING OF EXPOSURE AT THE PLACE OF WORK
 Employer shall ensure monitoring of employees’ exposure to chemicals
hazardous to health is conducted by registered technician when:
1. A health risk assessment done indicated that monitoring is required, or
2. Monitoring is necessary to ensure the maintenance of adequate
control from exposure

PART IX HEALTH SURVEILLANCE
 The employer shall carry out a health surveillance programme when the
result of the assessment indicated that health surveillance is necessary
for the protection of employees exposed or likely to be exposed to
chemicals hazardous to health.
 Consist of medical surveillance component which shall be carried out by
occupational health doctor.
 If an employee is exposed or likely to be exposed to chemicals
hazardous to health listed in Schedule II, the health surveillance shall
include medical surveillance conducted at intervals of not more than
twelve months or at such shorter intervals as determined by the
occupational health doctor or an occupational safety and health officer
who is also a medical practitioner.

PART X MEDICAL REMOVAL PROTECTION
 The employer shall not permit any employee to be engaged in and shall
remove the employee from any work involving chemical hazardous to
health if

1. The employee has a detected medical condition that places him at


increased risk of impairment to health from exposure to chemical
hazardous to health
2. The employee becomes pregnant
3. The employee is breast feeding new born child

PART XI WARNING SIGN
 When a chemical hazardous to health is used in any manner that is
affecting the health of any person who may be in that area or is likely to
be at risk by the chemical hazardous to health, the employer shall ensure
that:
1. Warning signs are posted at conspicuous locations at every
entrance of the area to warns the person entering the area
2. Other relevant information are given to person who may be or likely
to be at risk of being affected by the chemical hazardous to health

PART XII RECORD KEEPING
 Whenever an employer ceases to carry on business and another person
succeeds him, the employer ceasing business shall hand over, and the
successor employer shall retain, all records to be maintained.
 Whenever an employer ceases to carry on business and no person
succeeds him, the employer shall transmit the records required to be
maintained.
 At the expiration of the retention period for the records required to be
maintained, the employer shall give the Director General at least three
months notice in writing that he intends to dispose of such records, and
he shall transmit those records to the Director General, if requested to do
so within that period

 Any person who contravenes any provision of this Regulations shall be


guilty of an offence and upon conviction be liable to a fine not exceeding
RM 10,000 or imprisonment of maximum one year.

3.2 OSH (CPL ) Regulation 1997

The CPL Regulations was previously used as a


mechanism to control the supply of hazardous
chemicals to the workplaces in Malaysia and came
into force on 15th April 1997.

However, with the adoption of the Globally


Harmonized System of Classification and Labelling
of Chemicals (GHS) worldwide, Malaysia has taken
proactive measures to implement the GHS at the
workplace through the promulgation of the CLASS
Regulations to replace the current CPL Regulations.

Application

 These Regulations shall apply to a supplier of hazardous chemicals for


use at work except hazardous chemicals which are -
a) defined as a radioactive material under the Atomic Energy Licensing
Act 1984 [Act 304]
b) defined as a pesticide under the Pesticides Act [Act 149]
c) listed as poisons in the Poisons List Order 1993, [P.U.(A) 98/ 93] except
for chemicals which are classified therein as industrial and laboratory
poisons;
d) defined as a drug under the Sales of Drugs Act 1952 [Act 368];
e) listed as scheduled wastes in the First Schedule of the Environmental
Quality (Schedule Wastes) Regulations 1989; [P.U.(A) 139/89];and
f) foodstuff.

Application

 These Regulations shall not apply to -


(a) the transportation of hazardous chemicals by rail, road, inland waterway,
sea or air; and
(b) hazardous chemicals in transit which are stored at a bonded warehouse.

Duty of supplier to classify.

1) It shall be the duty of a supplier to classify hazardous chemicals


according to the specific nature of the risk involved based on the
categories of hazards in Schedule I.

2) Chemicals which fall within more than one category of hazard in Parts A
and B of Schedule I shall be classified under the category which poses
the greatest degree of hazard in each Part.

Packaging requirement

A supplier shall ensure that the hazardous chemicals are supplied in


packaging which satisfies the following requirements:
a) if the packaging is a container, the container shall be so designed and
constructed that its contents cannot escape unless there is a
requirement for safety devices to be fitted into the container;
b) the materials constituting the packaging and the fastenings are not
susceptible to adverse attack by the contents therein or liable to form
harmful or dangerous compounds with the contents;
c) the packaging and fastenings are strong and solid throughout to ensure
that they will not come loose and will safely meet the nomad stress and
strain of handling; and
d) containers fitted with replaceable fastening devices are so designed that
the packaging can be repeatedly fastened without the contents
escaping.

Seal of package

A supplier shall ensure that packages are initially closed with a seal in such
a way that once the packages are opened, the seals are broken and could
not be repaired.

Labelling

(1) A supplier shall ensure that every packaging is labelled clearly and
indelibly with the following information:
a) the name of the hazardous chemical in accordance with the
internationally recognised nomenclature;
b) the name, address and telephone number of the supplier;
c) the danger symbol and indication of danger as specified in
Schedule II;
d) the nature of the special risk associated with the use of the
chemical as specified in Schedule III; and
e) the safety precautionary measures as specified in Schedule IV.

Labelling

(2) Where there is more than one symbol assigned to a chemical –


a) the requirement to indicate the symbol for very toxic or toxic makes
the symbols for harmful and corrosive optional;
b) the requirement to indicate the symbol for corrosive makes the
symbol for harmful optional;
c) the requirement to indicate the symbol for explosive makes the
symbols for flammable and oxidising optional; and
d) the requirement to indicate the symbol for oxidising makes the
symbol for flammable optional.

Labelling

3) In the case of irritant, highly flammable, flammable and oxidising


chemicals, the information on special risk and safety precaution need
not be given where the package contains 125 millilitres or less of the
hazardous substance.
4) An indication such as "non-toxic", "non-harmful" or any other similar
indication shall not appear on the label or packaging of hazardous
chemicals.
5) The information required under subregulation (1) shall be supplied in the
national language and English.

3.4. OSH (prohibition of Substance ) Order 1999
 This order may be cited as the Occupational Safety and Health
(Prohibition of Use of Substance) Order 1999.
 This Order shall come into operation on 2 august 1999
 The substances listed in column (1) of Schedule shall be prohibited from
use to the extent as specified in column (2).
