The Roles and


Responsibilities of the
Philippine Judiciary
 Systems of court that interprets and applies
the law in the name of the state.
 Provides mechanism for the resolution of
dispute.
 Consists of a court of final appeal together
with lower courts.
 Judicial power rests with the
Supreme Court and the lower courts
as established by the law

Regular Courts
 Regional Trial Courts
• Established among the thirteen
regions (R I-XII and NCR)
• Shall exercise exclusive original jurisdiction in
all criminal cases not within the exclusive
jurisdiction of any court, tribunal or body,
except those now falling under the jurisdiction
of the Sandiganbayan
• Typically try cases of serious crimes
like murder and robbery as opposed
to petty crimes which reduce burden
of court cases
 Metropolitan Trial Courts
• Rule on Summary Procedure in Special
Cases adopted on Aug. 1, 1983:

does not exceed 6 mos. of imprisonment or a
fine of P 1000. in offences involving damage to

• every municipality in the Philippines has
its own municipal trial courts
 Metropolitan Trial Courts
• Municipal trial courts in towns and cities in
the metropolitan Manila are distinguished
from the other political subdivisions of the
Philippines
 Municipal Circuit Trial Courts
• Judicial courts of the Philippine
Judicial System which covers two or
more municipalities in the country
Muslim Courts
o Shari’a District Courts
• Equivalent to Regional Trial Courts.
Muslim Personal Laws of the Philippines
is being enforced
• decide every case on the basis of
evidence and the records transmitted as
memoranda, briefs or oral arguments
• decisions are final
o Shari’a Circuit Courts
• Equivalent to the Municipal Circuit
Trial Courts
• 51 in existence
• has original jurisdiction of the ff:
1. All cases involving offenses defined and
punished under Presidential Decree no.
1083
2. All action and proceedings between parties
who are Muslims or have been married with
Article 13 of the Presidential Decree no. 1083
involving deputes relating to:
a. marriage b. Customary dowry

c. divorce d. Restitution of
marital rights & etc.

3. All cases involving disputes relative


to communal properties
