Objectives of PSC
• To explore and develop the petroleum resources in
the shortest possible time.
• To provide the government with a fair share of
income from the operations.
• To ensure that in case of favourable circumstances,
the government automatically earns a large share of
the benefits.
• To provide a reasonable rate of return to the oil
company, taking into account geological and other
risks.
• To provide an incentive to the oil industry to evaluate
properly the petroleum potential of the country, and
to encourage as much as possible the development
of marginal fields.
• To provide for a system that can be easily
administered with the foreseeable technical
capabilities of the country involved.
Attractive Incentives Granted in PSC
• Duties on import of petroleum industry
equipment / material are exempted.
• 3 year Tax Holiday is automatically granted.
• Corporate Tax is 30% on taxable income.
• No export duty levied on export of petroleum.
• Accelerated depreciation (25%) per year is
allowed.
• Domestic Market supply is priced at not too far
reduced from fair market value.
• Renegotiation clause specifically allows
necessary adjustment/ amendments, in the
event job situations arising not envisaged in the
original contract.

GENERAL TERMS AND CONDITIONS OF
PRODUCTION SHARING CONTRACTS

The Salient Points of the Terms and Conditions of Production Sharing


Contract (PSC) are as follows:-

1. Data Fee - Payment within 20 days after Signing


of the Contract.
2. Study Period

4. Exploration Period - 3 years with Seismic and Drilling
program.
5. Extension - 1 year x 2 times.
6. Development - 20 years for each Commercial

7. Royalty - 10% of Available Petroleum.
8. Cost Recovery - ( Onshore ) Maximum 40% of
all Available Petroleum.

Exploration Period = US$ 25,000 per yr.
Production Period = US$ 50,000 per yr.
(Offshore)
Exploration Period = US$ 50,000 per yr.
Production Period = US$100,000 per yr.
 
15. Research & Development - 0.5% of CONTRACTOR's share of
Fund Profit Petroleum.
16. Governing Law - Laws of the Union of Myanmar.
 

17. Arbitration - Myanmar Arbitration Act, 1944.

18. Rights and Obligations - Be responsible to pay to appropriate


authorities import duties, customs
duties, sales tax and other duties
levied on motor vehicles brought into
Myanmar for personnel use and for
field use by CONSTRACTOR, its
contractors and subcontractors. The
cost and expenses incurred shall be
Cost Recoverable as Petroleum
Costs under Section 9.4.
19. Sharing of Profits from the Sale or Transfer of Shares of the
Company
 If the Company formed under the provisions of the Contract sell or transfer
its Shares of the Company and if a Profit is being made, CONTRACTOR is
liable to pay to the Government of the Union of Myanmar the following
trenches out of the Profit made on the sale or transfer of the shares of the
Company :-
 
(a) If the amount of Net Profit is up to $100 million USD 40%
(b) If the amount of Net Profit is between $100 million and 45%
$150 million USD
(c) If the amount of Net Profit is over $150 million USD 50%

PSC Application Procedure
• Interested Parties can make General Data Review at
MOGE free of charge.
• If required for detailed data review of specific block
or blocks, MOGE will charge US$ 25,000 per block
allowing 6 men 6 hours to study all available data in
the block.
• Interest party then prepare a proposal of Principle
Terms and Conditions and shall submit to Ministry of
Energy.
• Myanmar Negotiation Committee for Petroleum
Contracts review and assess the proposal.
• If improvement are required the interested company
will be informed of the out standing issues and invite
for negotiation
PSC Application Procedure
(cont.)

• Once the principal terms and conditions has been


reached, the Draft PSC contract prepared and submit
to the Ministry of Energy.
• Negotiation Committee then seek the comment from
Attorney general office on the Draft Contract.
• The case together with the final PSC will be
submitted to Myanmar Investment Committee, Trade
Counsel and the Cabinet for necessary approvals.
• After gathering all approvals, PSC signing and the
Contractor shall commence the petroleum operation
in the awarded block.

The second drilling campaign focused only on M9 to evaluate HC potential in


three areas, M9W, M9C and M9NE with the encouraging drilling plan of 7 wells
by end 2007.
Zatila # 1 drilled in western part of Block M-9 discovered and some amount of
condensate and gas.
