INTRODUCTION

• A SEXUAL MINORITY IS A GROUP WHOSE SEXUAL


IDENTITY,ORIENTATIONS OR PRACTICES DIFFER FROM
THE MAJORITY OF SURROUNDING SOCIETY.
• INDIVIDUALS WHO IDENTIFY AS GAY, LESBIAN ,BISEXUAL
OR WHO HAVE SEXUAL CONTACT WITH PEOPLE OF THE
SAME GENDER.
WHO ARE CONSIDERED AS SEXUAL
MINORITIES

• LESBIANS - WOMEN WHO ARE ATTRACTED TO ANOTHER WOMEN.


• GAY - MEN WHO ARE ATTRACTED TO OTHER MEN
• BISEXUALS - MEN OR WOMEN WHO ARE ATTRACTED TO BOTH MEN
AND WOMEN.
• TRANSGENDERS - PERSON WHOSE APPEARANCE OR IDENTITY
DIFFER FROM THE SEX THEY WERE BORN WITH
• QUEER - QUEER IS A WORD THAT DESCRIBES SEXUAL AND GENDER
IDENTITIES. LESBIANS,GAY,BISEXUAL AND TRANSGENDER PEOPLE
MAY ALL IDENTIFY WITH THE WORD QUEER .
LGBT RIGHTS IN INDIA

• LGBT RIGHTS IN INDIA HAVE BEEN EVOLVING RAPIDLY IN


RECENT YEARS.HOWEVER THEY STILL FACE CERTAIN
SOCIAL AND LEGAL DIFFICULTIES.
• TRANSGENDER PEOPLE IN INDIA ARE ALLOWED TO
CHANGE THEIR LEGAL GENDER POST-SEX REASSIGNMENT
SURGERY UNTIL LEGISLATION PASSED IN 2019 AND HAVE A
RIGHT TO REGISTER THEMSELVES UNDER A THIRD
GENDER.
• SOME STATES PROTECT HIJRAS THROUGH HOUSING PROGRAMS,
OFFER WELFARE BENEFITS,PENSION SCHEMES AND FREE
OPERATIONS IN GOVERNMENT HOSPITALS.
• THERE ARE APPROXIMATELY 48000 TRANSGENDER PEOPLE IN
INDIA.
• IN 2018, THE SUPREME COURT OF INDIA DECRIMINALISED
CONSENSUAL HOMOSEXUAL INTERCOURSE UNDER IPC 377.
DISCRIMINATION PROTECTION

• ARTICLE 15 OF INDIAN CONSTITUTION STATES THAT


PROHIBITION OF DISCRIMINATION ON GROUNDS OF
RELIGION,RACE,CASTE,SEX OR PLACE OF BIRTH.
• NO LEGISLATIVE LAWS HAS ENACTED TO BAN
DISCRIMINATION ON THE BASIS OF SEXUAL ORIENTATION
IN EMPLOYMENT SINCE ARTICLE 15 ONLY EXTENDED TO
DISCRIMINATION FROM THE STATE OR GOVERNMENT
BODIES.
• ON FEBRUARY 2021,THE ALLAHABAD HIGH COURT RULED
THAT FIRING AND DISCRIMINATING AGAINST A PERSON
ON THE BASIS OF SEXUAL ORIENTATION IS VIOLATION OF
SUPREME COURT JUDGEMENT, HENCE EXTENDING THE
ANTI-DISCRIMINATORY PROVISIONS TO EMPLOYMENT
EVERYWHERE.
• IN CASE OF PHYSICAL ATTACKS SECTION SECTION 307
AND 323 OF IPC IS USED .
• THE TRANSGENDER PERSON(PROTECTION OF
RIGHT)ACT,2019 BANS DISCRIMINATION AGAINST
TRANSGENDER IN EDUCATIONAL ESTABLISHMENT AND
SERVICES , EMPLOYMENT ,HEALTHCARE SERVICES,
ACCESS TO” THE USE OF ANY
GOODS,ACCOMMODATION,SERVICES,FACILITY ,BENEFIT,P
RIVILEGE,OR OPPORTUNITY DEDICATED TO THE USE OF
GENERAL PUBLIC OR CUSTOMARILY AVAILABLE TO
• THE RIGHT TO MOVEMENT,THE RIGHT TO”
RESIDE,PURCHASE,RENT OR OTHERWISE OCCUPY ANY
PROPERTY “
• THE OPPORTUNITY TO STAND FOR OR HOLD PUBLIC OR

JAGDAMBIKA PAL INTRODUCED A BILL TO THE INDIAN
PARLIAMENT TO AMEND THE ARMY ACT 1950,THE NAVY
ACT 1957 AND THE AIRFORCE ACT 1950, THAT WOULD
ALLOW LGBT PEOPLE TO SERVE IN THE ARMED FORCES.

• IT HAS BEEN SUGGESTED THAT ONLINE MEDIA HAS DEVELOPED INTO A
SPACE IN WHICH SEXUAL MINORITIES MAY USE” SOCIAL ARTILLERY
“.THIS DESCRIPTION CENTERS ON HOW SOCIAL NETWORKING AND
CONNECTIONS OPPOSE INSTANCES OF HOMOPHOBIA.
• SOME INDIVIDUALS HAVE MADE THEIR WAY INTO MEDIA THROUGH
TELEVISION AND MUSIC.
• WHILE SEXUAL MINORITIES DO HAVE A PLACE IN MEDIA,STILL THEY ARE
LIMITED IN REPRESENTATION
• THEY GET OFTEN A VERY SHALLOW CHARACTER ONLY
FOR A COMIC RELIEF OR AS A PLOT TWIST.

13.5%.
• SEXUAL MINORITIES IN SOUTH AFRICA HAVE SEXUAL-
ORIENTATION-RELATED HEALTH INEQUITIES WHEN
COMPARED TO OTHER COUNTRIES.
• ONE OF THE HIGHEST PREVALENCES OF SEXUAL VIOLENCE
DIRECTED TOWARD WOMEN OF A SEXUAL MINORITY OCCURS
IN SOUTH AFRICA.
