FOOD SAFETY AND STANDARD

ACT 2006
It extend to whole of India .
SOME TERMS RELATED TO ACT
1. Adulterant – means any material which is or could be employed for making the
food unsafe or sub standard or misbranded or containing extraneous matter .
2. Advertisement – means any audio or visual publicity , representation or
prouncement made by means of any light , sound , smoke gas , print , electronic
media , internet or website .
3. Chairperson – means chairperson of food authority .
4. Claim – means any representation which states , suggest or implies that a food
has particular qualities relating to its origin , nutrition and processing .
5. Commissioner of food safety- appointed under sec 30
6. Contaminant – means any substance whether or not added to food but
contaminate the food through process of manufacture , processing ,preparation
and treatment .
7. Designated officer- appointed under sec 36.
8. Food analyst – appointed under sec 45.
9. Food laboratory – means any food laboratory or institute established by central
or state govt or any other agency accredited by national accredition board for
testing and callibration laboratories and recognised by food authority under sec
43.
10. Food safety – means assurance that food is acceptable for human consumption .
11. Food safety audit – means systematic and functionally independent
examination of food safety measures adopted by manufacturing units to determine
whether such measures and related results meet with objectives of food safety and
claims made in that behalf.
12. Food safety management system – means the adoption of good manufacturing
practices , good hygienic process , hazard analysis and critical control point and such
other practices as may be specified by regulation for the food business.
13. Food safety officer – appointed under sec 37.
14. Hazard – means biological , chemical or physical agent in or condition of food ,
with the potential to cause an adverse health effect .
15. Improvement notice – under sec 32 of the act .
16. Infant food and infant milk substitute – assigned in clause (f) and (g) of sub
section (1) of sec (2) of infant milk substitutes , feeding bottles and infant foods act
1992 .
17. Label – means any tag , brand ,mark , pictorial or other descriptive matter ,
written , printed , stencilled , marked , embossed , graphic , perforated stamped or
impressed on or attached to container , cover , lid or crown of any food package
and includes a product insert.
18. License – granted under sec 31.
19. Local area – means any area whether urban or rural notified by the
commissioner of food safety to be a local area for the purpose of this act .
20. Member- means members of food authority and includes chairperson .
21. manufacture- means a process or adoption or any treatment for conversion of
ingredients into an article of food for sale and includes any person who obtains such
article from another person and pack and labels it for sale or any labels it for such
purposes .
22. Misbranded food – means an article of food
a) If it is purported or is represented to be or is being : offered or promoted for
sale with false , misleading or deceptive claims either;
upon the label of the package; or
through advertisements ;or
sold by a name which belongs to another articles of food ;or
offered or promoted for sale under the name of a fictitious individual or
company as the manufacturer or producer of the articles as borne on the
package or containing the article or the label on such package ;or
b) If the article is sold in package which have been sealed or prepared by or at the
instance of the manufacturer or producer bearing his name and address but –
the article is an imitation of , or is a substitute for , or resembles in a manner
likely to deceive , another article of food under the name of which it is sold , and
is not plainly and conspicuously labelled so as to indicate its true character ; or
the package containing the article or the label on the package bears any
statement , design or device regarding the ingredient or the substances
contained therein , which is false or misleading in any material particular , or if
The package is otherwise deceptive with respect to its contents ; or
The article is offered for sale as the product of any place or country which is false ;or
C) If the article contained in the package
Contains any artificial flavouring , colouring or chemical preservative and the package is
without a declaratory label stating that fact or is not labelled in accordance with the
requirements of this act or regulations made thereunder or is in contravention thereof ;
or
is offered for sale for special dietary uses , unless its label bears such informations as
may be specified by regulation, concerning its vitamins , minerals or other dietary
properties in order sufficiently to inform its purchaser as to its value for such use ; or
Is not conspicuously or correctly stated on the outside thereof within the limits of
variability laid down under this act .
23) Premises – include any shop , stall , hotel , restaurant , airline services and food
canteens , place or vehicle or vessels where any article of food is sold or manufactured or
stored for sale .
24) Primary food – means article of food being a produce of agriculture or horticulture
or animal husbandry or dairying or aquaculture in its natural form , resulting from
growing , raising , cultivation , picking , harvesting , collection or catching in the hands of
person other than a farmer or fisherman .
25) Prohibition order – order issued under sec 33 of act .
26) Risk – probability of an adverse effect on health of consumers of such food and the
severity of that effect consequential to food hazard .
27) Risk analysis – consist of three components –
risk assessment
risk management
risk communication
28) Standard - notified by food authority
29) Substance – includes any natural or artificial substance or other matter whether it
is in solid or liquid or gas form .
30) Tribunal – means food safety appelate tribunal under sec 70.
31) Sub standard – if food does not meet the specified standard:-
a. packaged in poisonous substance
b. Rotten , unhygenic food
c. Addition of ingredient which is not permitted
d. Coated , coloured or polished
e. Infected with worms , weevils or insects.
f. Packaged , prepared or kept under insanitary conditions.
g. Containing pesticides
ESTABLISHMENT OF FOOD SAFETY AND STANDARD AUTHORITY OF INDIA
By central govt by issuing notification in official gazette
HQ- delhi
It may establish office at any other place in india.
FOOD AUTHORITY
Consist of chairperson and 22 members out of which one third be women
7 members – not below the rank of joint secretary to govt of india which is
appointed by central govt representing ministries or departments of central
govt dealing with :
a. Agriculture
b. Commerce
c. Consumer affairs
d. Food processing
e. Health
f. Legislative affairs
g. Small scale industries who shall be ex officio members
3 members- food technologist or scientist
2 members- consumer organisation
2 members- food industry of which one shall be from small scale industry
5 members – appointed in rotation in every 3 yrs from zones specified in first
schedule to represent states and UT
IN FIRST SCHEDULE ZONE 1 – South
ZONE 2 – North
ZONE 3 – Central
ZONE 4 – North east including sikkim
ZONE 5 – Union territories
2 members – farmers organisation
1 members- retailers organisation
CHAIRPERSON – appointed by central govt from amongst the person of eminence in the
field of food science and not below the rank of secretary to the govt of india.
 Chairperson and the members other than ex officio members of food authority shall
be appointed by central govt on recommendation of selection committee. The
chairperson or members other than ex officio members of food authority shall not hold
any other office .
SELECTION COMMITTEE FOR SELECTION OF CHAIRPERSON AND MEMBERS OF FOOD
AUTHORITY : consist of :-
a. Cabinet secretary
b. Secretary in charge of the ministry or department responsible for administration of
this act or department of central govt dealing with health , legislative and personnel
members.
c. Chairman of public enterprises selection board
d. An eminent food technologist to be nominated by central govt ( from any national
research or technical institution )
 The central govt shall within 2 months from the date of occurrence of any vacancy by
reason of death , resignation or removal of chairperson or a member of food
authority and 3 months before completion of the term of office of chairperson or
any member of that authority make a reference to selection committee for filling up
the vacancy .
 The selection shall finalize the selection of the chairperson and members of the food
authority within 2 months from the date on which the reference is to be made .
The selection committee shall recommend a panel of two names for every vacancy
referred to it .
Before recommending any person for appointment as a chairperson or other members
of food authority , the selection committee shall satisfy itself that such person does not
have any financial or other interest , which is likely to affect prejudicially his function as a
member.
No appointment of the chairperson or other member of food authority shall be invalid
merely by reason of any vacancy in the selection committee .
TENURE
3 Yrs or 65 yrs for chairperson
3 yrs or 62 yrs for members
Elligible for reappointment
SALARY AND ALLOWANCE
As prescribed by central govt except ex officio member
OATH
Before such authority as prescribed by central govt
RESIGNATION
Chairperson or any member gives resignation in writing to central govt a notice of not
less than 3 months.
REMOVAL
According to provisions of sec7(1) by the central govt
CENTRAL ADVISORY COMMITTEE
Appointed by food authority
Consist of 2 members
All commissioners of food safety and chairperson of scientific committee shall be
ex officio members
Chief executive officer shall be ex officio chairperson
Representatives of concerned ministry are invitees.
Functions of central advisory committee is to advise food authority on
performance of its duties , on priortization of work , identifying potential risk ,
pooling of knowledge.
They meet at invitation of chairperson or at request of one third of its members
and not less than 3 times a year .
SCIENTIFIC PANELS – est by food authority on :-
a. Food additives, flavouring, processing aids and material in contact with food
b. Pesticides and antibiotics residues
c. Genetically modified organism and foods
d. Functional foods , nutraceuticals , dietic products and other similar products
e. Biological hazards
f. Contaminants in food chain
g. Labelling and
h. Method of sampling and analysis
NEW MEMBERS AND OLD MEMBERS are replaced by food authority.
SCIENTIFIC COMMITTEE – by food authority
Consist of chairperson and 6 scientific experts
scientific committee and scientific panel
Tenure – 3 yrs
Chairperson is chosen among themselves.
Recruitment is available on food authority website.
FOOD AUTHORITY
1. Meets at head office or at any office decided by chairperson .
2. Chairperson preside at the meeting and if chairperson not present then any
member nominated by chairperson on his behalf or members chosen by
members present among themselves.
3. Chairperson shall have the right to exercise a second or casting vote .
4. Food authority may invite chairperson of scientific committee but without right
to vote.
5. All orders are authenticated by chief executive officer . Chief executive officer
participate in meeting but have no right to vote .
FOOD BUSINESS OPERATOR
6. All rules and regulations made for production , processing , import , distribution
and sale within business under his control .
7. No food business operator himself or by any person on his behalf manufacture ,
store , sell or distribute any food which is
• Unsafe
• Misbranded
• No license
• Prohibited by food authority or central or state govt .
3) He shall not employ any person who is suffering from infectious , contagious or
loathsome disease.
4) He shall have to provide guarantee in writing of any article of food sale to vendor .
5) When any food is found to be unsafe then consignment or batch of food is also
declared unsafe .
6) Food business operator shall recall back any food if he found to be unsafe or he can
inform competent authority .
