1. Definition
Ocean Bill of Lading (B/L) is a document of carriage of goods
by ship. It is issued by the authorized person to the consignor
after the goods have been loaded on the ship or after the
goods are received for transport.

Vận đơn đường biển (Ocean Bill of Lading – B/L) là chứng
từ chuyên chở hàng hóa bằng đường biển do người có chức
năng ký phát cho người gửi hàng sau khi hàng hóa đã được
bốc lên tàu hoặc sau khi hàng hóa được nhận để chở.

Characteristics of the bill of lading

- When using the bill of lading, the carriage of goods by sea


is required. The kind of goods ownership document is
called the Bill of Lading.
- The time of issuing a bill of lading can be:
+ After the cargo has been loaded on the ship
(Shipped on Board).
+ After goods are received for shipment (Received
for Shipment).

Function.
- The receipt of the carrier's goods issued to the consignor.
- Evidence of the contract of carriage of goods between the
consignor and the carrier.
- The certificate of insurance for goods transported by air when
required by the consignor.
- There is no ownership of the goods
- Do not use the air waybill to pick up goods at the arrival airport.

Insurance means a commitment from the insurer to indemnify
the assured for the loss or damage to the insured subject-matter
by an agreed risk, provided that the assured must pay the
insurance fees for the insurer.

Bảo hiểm là cam kết bồi thường của người bảo hiểm cho người
được bảo hiểm về những tổn thất, hư hỏng của đối tượng bảo
hiểm do một rủi ro đã thỏa thuận gây ra, với điều kiện là người
được bảo hiểm phải trả phí bảo hiểm cho người bảo hiểm.
II. The Insurance Documents

The insurer: collects fee, accepts risk and must indemnify


the insured when any loss occurs within the agreed value.

The insured: pay fees (also known as the buyer of


insurance), who suffers the loss when risk occurs, and will
be compensated by the insurer.

Object insured: property, goods, ...

Insured risk: the risks are negotiated in the insurance


contract.

Fee/Premium: the amount that the insured pays the insurer


for the insured benefit.

Insured value: the value of the insured object.

The amount of insured: the amount that the insurer has to


pay when risk occur

The documents of insurance is the evidence that will be


established by the insurer and provide for the insured in order
to ensure for the insured object.

Function
Evidence of the insurance contract, specifying the liability
and interests of the insurer and the insured.

It has circulating and transferable.

- Made by seller

Main functions:
- Calculating import and export taxes and calculating the
amount of insurance.
- Financial tool for import and export activities when the
invoice has been accepted to pay by the buyer or the bank.
- Comparing and monitoring the process of commercial
contracts.
- To check the content of B/E

- Exporter.

- Chamber of Commerce of the exporting country

Form A:
- Used for exports from slow and developing countries to developed
countries (38 countries in OECD).
- To implement tariff preferences - GSP

Form B: Used for all exported goods in the following cases:


- The importing country does not have GSP preferences.
- The importing country has GSP but it does not allow the exporting
country to use it.
- The importing country has GSP for the exporting country to use, but
the goods of the exporting country are not eligible for this policy.

Form D: implement the Preferential System, that is being applied


between ASEAN countries.

Form E: used for export goods to have tariff preferences
between ASEAN and China.

Form O: creating specifically for coffee products. It is used


among member countries of the International Coffee
Association.

Form S: export to Laos under the Vietnam-Laos preferential


agreement.

Form T: used for textiles and garments to EU's countries in the


Vietnam and EU Agreement on Textiles and Clothing.
