Geborgenheit
Geborgenheit is used to describe a state of comfort and well-being. It is often
translated as 'security', but in fact it is a feeling which is rather untranslatable.

The theory of Geborgenheit (safety, wellness, wellbeing) in education entails


the notion that effective teaching and learning is enhanced if the places of
learning are safe and secure. School workshops should be secure and be safe
spaces for learners in order for effective teaching and learning to occur.
Geborgenheit
Geborgenheit word gebruik om 'n toestand van gemak en welstand te beskryf.
Dit word dikwels as 'veiligheid' vertaal, maar in werklikheid is dit 'n gevoel
wat nogal onvertaalbaar is.

Die teorie van Geborgenheit (veiligheid, welstand, welstand) in onderwys


behels die idee dat effektiewe onderrig en leer verbeter word as die plekke van
leer veilig en geborge is. Skoolwerkswinkels moet veilig wees en veilige
ruimtes vir leerders wees sodat effektiewe onderrig en leer kan plaasvind.
Common Law
Common law is not promulgated nor codified. Common law can be described
as uncodified legal principles derived from inherited Roman Dutch law which
has been adapted and developed against the unique South African society
(Oosthuizen & De Wet, 2011:56-57).

In section 39(2) and 39(3) of the Constitution (1996) the importance of common
law is acknowledge, while the fact that common law has to be taken into
consideration when courts interpret legislation are emphasised.

Gemenereg word nie gepromulgeer of gekodifiseer nie. Gemenereg kan
beskryf word as ongekodifiseerde regsbeginsels afgelei van oorgeërfde
Romeins-Hollandse reg wat aangepas en ontwikkel is teen die unieke Suid-
Afrikaanse samelewing (Oosthuizen & De Wet, 2011:56-57).

In artikel 39(2) en 39(3) van die Grondwet (1996) word die belangrikheid van
gemenereg erken, terwyl die feit dat gemenereg in ag geneem moet word
wanneer howe wetgewing interpreteer, beklemtoon word.

in terms of Section 2 any law (including a common law
principle) is invalid if it is inconsistent with any provision
in the Constitution.
-Common law principles are therefore used as tools to
interpret the constitutional provisions dealing with the
exercise of public power.
-Die Grondwet is die hoogste reg in Suid-Afrika en
ingevolge Artikel 2 is enige wet (insluitend 'n
gemeenregtelike beginsel) ongeldig indien dit teenstrydig is
met enige bepaling in die Grondwet.
-Gemeenregtelike beginsels word dus as instrumente gebruik
om die grondwetlike bepalings wat oor die uitoefening van
openbare mag handel, te interpreteer.
Common Law
-In loco parentis; Means in the place of a parent.
-Audi alteram partem; Means to “listen to the other side", or "let
the other side be heard as well“
-Locus standi; Means when the person has the right to sue or to
be sued with regards to a particular matter.
-Nemo iudex in propria causa; Means ”no one should be a judge
in their own cause”. It is one of the cardinal rules of natural justice
that no one should act as a judge a case in which they have a
personal (vested) interest.

ander kant ook te laat hoor"
-Locus standi; Beteken wanneer die persoon die reg het om te dagvaar of
gedagvaar te word met betrekking tot 'n bepaalde aangeleentheid.
-Nemo iudex in propria causa; Beteken "niemand moet 'n regter in hul eie
saak wees nie". Dit is een van die kardinale reëls van natuurlike
geregtigheid dat niemand as regter moet optree in 'n saak waarin hulle 'n
persoonlike (gevestigde) belang het nie.

thus you have to keep the best interest of the child at heart when
making decisions concerning the learners.

Jy as onderwyser is in loco parentis vir die leerders in jou klas, dus


moet jy die beste belang van die kind op die hart dra wanneer jy
besluite neem oor die leerders.

An educator can be deemed unfit to teach if he/she cannot complete their duties because of
chronic illness or injury but only after exhausting all the options and evaluating if the teacher
will be able to teach efficiently by implementing certain measures to help the teacher. In the
case Burger v Governing Body of Newcastle Senior Primary School (2005) the applicant won
the case because of unfair dismissal due to injury and was awarded 4 months compensation.
