Thanks for providing us an opportunity to quote for your enquiry of columns for your IOCL, Aishwarya Project at
Haldia refinery, West Bengal project and we are glad to submit our techno-commercial budgetary proposal as
detailed below.
1. PRICE

Prices indicated in the price schedule are for FCA EHES Hazira, excluding taxes & duties, etc. which
will be charged extra as applicable.
Our base price is inclusive of packing and forwarding charges.
Commissioning and start up spares price is included in the base offer.
Prices indicated in the price schedule is applicable for entire quantity and therefore part order is
subjected to our prior confirmation.
Any change in our terms & conditions will be accepted sub to price impact.

Manufacturing location will be Essar heavy engineering Services (A unit of Essar Projects (I) Limited).
All material will be procured under 3.1 material certificates.
As a 2 years operational spares and Commissioning and start up spares we have considered 10%
(min 2 nos. of each type) spare fasteners and 1 set of spare gaskets for each nozzle as operational
spare.As a commissioning and start up spares are considered only for nozzle having blind flange only.
We have not considered any constrain in vendors in procurement of material. However
Chinese and East European origin material will be used.
Fittings and Pipe above 10 will be fabricated from plate with 100% radiography.
Special tools and tackles like BTD and Torque wrench are not required and hence not
considered in our scope of supply.
Our offer is based on the weight, MOC, Thickness indicated in ENGINEERING TABLE FOR
COLUMNS provided along with enquiry. Complete detailed designed shall be done by us during
firm enquiry and any changes in the same will have price impact.
Lip type Self Reinforce nozzle, Integral flanges and Y ring forging is not considered.
Dish ends can be of crown and petal construction.
We will supply complete equipment in single piece and hence we have not considered any site
work, site supervision, erection & commissioning works in our scope.
Code stamping and CCOE approval is not considered.
Radiography is considered by gamma ray.
Hydro test will be carried out in horizontal position as per ASME CODE.
All stiffening ring and channel structures shall be fabricated from plate.
PWHT if required will be carried in Oil fired modular furnace.
Blasting will be done with copper slag.
All type of internals is excluded from scope of supply. Kindly provide the complete details of
the internals to include the same in the offer.
Any change in design/ material/ scope of work/ sizing /nozzle additional from the scope of
work shall have bearing on the above price which shall be claimed extra.
We have only considered saddles (EHES Standard) tarpaulins and lashing in packing.
Cladding will be done through explosion bonding process.
Cladding thickness considered is 3mm.
5. INSPECTION & TESTING:

A comprehensive Inspection & test plan will be submitted considering the technical
requirements and in line with ASME for approval after the receipt of the order.
6. GURANTEE:

We will give guarantee for Material & Workmanship for a period of 18 Months from the date of
supply or 12 Months from the date of commissioning whichever is earlier.
7. DELIVERY:
x
We will start delivery of the equipments from 10 months (FCA EHES HAZIRA) and complete
delivery of all the equipments within 16.

LIQUIDATED DAMAGE
In event of delay from agreed delivery time mentioned above we accept liquidate damage and
not as a penalty, an amount of half percent (0.5%) per week of the purchase order value for
the only undelivered (not on total PO value) up to maximum of five percent (5%) of the
purchase order value. Any delay from the TPI/Client in inspection and approval will not be
considered as our delay.

Our preferred payment terms are as under however this can be discussed during finalization of
the order.
20% of advance along with order.
30% against proof of ordering of plates & forging.
Balance 50% along with taxes and duties within 15 days from the date of dispatch of
equipments from our Works, progressively.
All payment shall be made through irrevocable at sight LC on pro rata basis.
Corporate guarantee will be provided for first two milestone payment terms.
Payments shall not be set-off from other SBU or other units of ESSAR Group.
10. SUSPENSION

If the purchaser suspend the work under the Contract (part/full) for its convenience and the
supplier suffers delay and/or incurs costs on account of such suspension, the supplier shall be
entitled to
(a) An extension of time for such delay
(b) Payment of such costs which shall be added to Contract Price within 2 weeks of our
submission of price & delivery change request.
The supplier entitlement for such suspension shall be as per the following plan:
Suspension within 1 week from PO acceptance: No price implication. However, the delivery
will get automatically extended for the period, contract remained on suspension.
Suspension after 1 week of PO acceptance: The price and delivery implications will be mutually
discussed and settled.
Suspension for more than aggregate 30 days in totality, after order acceptance, which includes
suspension by single intimation or multiple intimation by purchaser, but in totality aggregate
suspension days exceeds 30 days :- Price and delivery are to be renegotiated between
Purchase and Supplier, and in case of any dispute (whether financial or otherwise), supplier
can choose to withdraw from the contract/order and in such a case of withdrawal/opting out
of the contract, the cost (direct & indirect both) which had already borne/incurred by supplier
towards execution of the said contract along with committed cost of supplier to various
supplier/sub-contractor for execution of the said order plus 10 % suppliers overheads charges
are required to be paid by the purchaser, within a week of submission of such request by the
supplier. In case of delay, interest will be charged at 15% p.a. basis.

11. TERMINATION
x
If the purchaser permanently terminates the work under the contract for its convenience or by
any reason whatsoever or purchaser fails to perform their obligations under the Contract &
therefore supplier has to annul the contract, the supplier shall be entitled to (a) for any items
of Work delivered in accordance with the Contract prior to or pursuant to the purchasers
termination, an amount equal to the value of such items and (b) an equitable amount to cover
the suppliers direct & indirect cost which are unavoidable in nature and which are incurred or
committed by supplier, for the execution of the contract under termination plus 10% suppliers
overhead charges. These charges are required to be paid by the purchase within a week of
submission of such request. In case of delay, interest will be chargeable at 15% p.a. basis.
As advised earlier, in order to safeguard our payments, the clause for not to set-off our
payments from other SBU or other units is also to appear in our proposal and customers
LOI/PO.
12. EFFECTIVE DATE OF P.O.:

It will be reckoned from the date of receipt of techno-commercially clear order along with LC,
PO acceptance, requisite advance & subject to turn around time for the drawing approval/final
inspection 1 week from the date of first submission.
It will be reckoned from the date of receipt of complete fabricated drawings.
13. VALIDITY:
x
This offer is valid till 15th December 2014.
