नई द ली, 2 फरवरी, 2017

का.आ. 351(अ).—िन िलिखत ा प अिधसूचना, िजसे के ीय सरकार, पयावरण (संर ण) अिधिनयम, 1986
(1986 का 29) क धारा 3 क उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ प ठत उपधारा (1) ारा
द शि य का योग करते ए, जारी करने का ताव करती है, पयावरण (संर ण) िनयम, 1986 के िनयम 5 के
उपिनयम (3) क अपे ानुसार, जनसाधारण क जानकारी के िलए कािशत क जाती है; िजनके उससे भािवत होने क
संभावना है ; और यह सूचना दी जाती है क उ ा प अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत
के राजप क ितयां जनसाधारण को उपल ध करा दी जाती ह, साठ दन क अविध क समाि पर या उसके प ात् िवचार
कया जाएगा ;

ऐसा कोई ि , जो ा प अिधसूचना म अंत व ताव के संबंध म कोई आ ेप या सुझाव देने म िहतब है, इस
कार िविन द अविध के भीतर, के ीय सरकार ारा िवचार कए जाने के िलए, आ ेप या सुझाव सिचव, पयावरण, वन

भूिम, गुजरात रा य के बनासकांठा िजले म अमीरगढ़ और दांतीवाडा तालुका म कु ल े 18066.28 हे टेयर म िव तृत है
िजसम जेसोर व यजीव अभयार य को अिधसूचना सं. जीएच-के एच-65/78-ड यूएलपी/2077/2077/62041-पी दनांक 6
मई, 1978 के प म घोिषत कया गया था;

जैसे सीपू और बनास का जल हण े है, बनासकांठा िजले क जल को क क रचा जग म एक मह वपूण भूिमका िनभाता
है;

और, अभयार य म 12 उभयचर क जाितयां, 45 सरीसृप क जाितयां, 212 पि य क जाितयां और 30

तनधा रय क जाितयां का वास है, रीछ (मेलोसेरस अरिसनस) जे सोर व यजीव अभयार य क मु य जाित है और
अभयार य े म तदुआ (पथरा पादस) शीष िशका रय म से एक है िजसका वास यहां है और े क अ य मुख हि य
वाली जाितय म धारीदार लकड़ब घा, जंगली िब ली, िसयार, भारतीय लोमड़ी, सामा य लंगूर, नील गाय, चूहा, हाथी,
भारतीय साल, चमगादड़, साही आ द सि मिलत ह;

और, जे सोर व यजीव अभयार य म बृहत वन पित और जीव ज तु िविवधता के साथ कई दुलभ और संकटाप
जाितय सिहत संप है और अभयार य म कु ल 487 पौध क जाितयां है िजसम 110 वृ क जाित, 58 झािड़य क
जाितयां, 83 पवतारोिहय क जाितयां, एक पेटरीडोफाइट क जाित और 235 जड़ी बू टय , सेज और घास क
जाितयां सि मिलत ह;

और, अभयार य के अ यंत बंद आसपास के े म मानव ब ती, चल रही िवकासा मक याकलाप, औ ोगीकरण
और खनन याकलाप अभयार य के चार ओर है, उिचत सुर ा उपाय और िनयं ण क आव यकता को म ेनजर रखते ए
लंबी अविध के व यजीव संर ण क याकलाप ज री है;

और, जेसोर व यजीव अभयार य के चार ओर के े को, िजसका िव तार और सीमाएं इस अिधसूचना के पैरा 1 म
िविन द ह, पयावरण क दृि से पा रि थितक संवेदी जोन के प म सुरि त और संरि त करना तथा उ पा रि थितक
संवेदी जोन म उ ोग या उ ोग के वग के चालन तथा सं करण करने को ितिष करना आव यक है;

अतः, अब, के ीय सरकार, पयावरण (संर ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प ठत पयावरण
(संर ण) अिधिनयम, 1986 (1986 का 29) क धारा 3 क उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप
धारा (3) ारा द शि य का योग करते ए, जेसोर व यजीव अभयार य क सीमा के चार ओर 4.00 कलोमीटर तक
के िव ता रत े को जेसोर व यजीव अभयार य गुजरात रा य म अमीरगढ़ और दांतीवाड़ा तालुक म जेसोर वन म
पा रि थितक संवेदी जोन (िजसे इसम इसके प चात् पा रि थितक संवेदी जोन कहा गया है) के प म अिधसूिचत करती है,
िजसका िववरण िन ानुसार है, अथात् :--

(1) पा रि थितक संवद

े ी जोन का िव तार और उसक सीमाएं--(1) पा रि थितक संवेदी जोन जेसोर व यजीव अभयार य का
े 30254 हे टेयर (अभयार य क सीमा से 4 कलोमीटर) है िजसम अमीरगढ़, दांतीवाड़ा और पालनपुर तालुक के 30
ाम शािमल ह।

(2) पा रि थितक संवेदी जोन का मानिच और भू-मंडलीय ि थित णाली बदु मश: उपाबंध I और उपाबंध II के पम
उपाब है ।

(3) सीमा वणन के साथ पा रि थितक संवेदी जोन के भीतर आने वाले ाम क सूची उपाबंध III के प म उपाब है |

े ी जोन के िलए आंचिलक महायोजना – (1) रा य सरकार, पा रि थितक संवेदी जोन के िलए राजप म

अंितम अिधसूचना के काशन क तारीख से दो वष क अविध के भीतर, थानीय ि य के परामश से और इस अिधसूचना
म संल न अनुबंध के सामंज य से आंचिलक महायोजना तैयार करे गी ।

(2) आचंिलक महायोजना रा य सरकार म स म ािधकारी ारा अनुमो दत होगी ।

(3) रा य सरकार ारा पा रि थितक संवेदी जोन के िलए आचंिलक महायोजना इस तरह, इस अिधसूचना म िविन द ट
प तथा सुसंगत क ीय और रा य िविधय के सामंज य और क ीय सरकार ारा जारी मागिनदश , य द कोई ह , ारा
तैयार होगी ।

(4) आंचिलक महायोजना, पयावरणीय और पा रि थितक िवचार को समाकिलत करने के िलए रा य सरकार के सभी
संब िवभाग के परामश से तैयार होगी, अथात्:--

(i) पयावरण ;
(ii) वन और व यजीव ;
(iii) कृ िष;
(iv) राज व ;
(v) नगर िवकास ;
(vi) पयटन ;
(vii) ामीण िवकास;
(viii) सचाई एवं बाढ़ िनयं ण;
(ix) नगरपािलका;
(x) पंचायती राज;
(xi) लोक िनमाण िवभाग।

(5) आंचिलक महायोजना अनुमो दत िव मान भू-उपयोग, अवसंरचना और याकलाप पर कोई िनबधन अिधरोिपत
नह करे गी जब तक क इस अिधसूचना म िविन द ट न हो और आचंिलक महायोजना सभी अवसंरचना और याकलाप म
और अिधक द ता और पा रि थितक अनुकूलता का संवधन करे गी ।

(6) आंचिलक महायोजना म अना छा दत े के जीण ार, िव मान जल िनकाय के संर ण, आवाह े के बंधन,
जल-संभर के बंधन, भूतल जल के बंधन, मृदा और नमी संर ण, थानीय समुदाय क आव यकता तथा पा रि थितक
और पयावरण से संबंिधत ऐसे अ य पहलू , िजन पर यान देना आव यक है, के िलए उपबंध ह गे ।

(7) आंचिलक महायोजना सभी िव मान पूजा थल , ाम और नगरीय बंदोब त , वन के कार और क म , कृ िष

े , ऊपजाऊ भूिम, ह रत े जैसे उ ान और उसी कार के थान, उ ान कृ िष े , फलोउ ान, झील और अ य जल
िनकाय का अ यकं न करे गी ।

(8) आंचिलक महायोजना थानीय समुदाय क जीवकोपाजन को सुिनि चत करने के िलए, पा रि थितक संवेदी जोन म
िवकास को पा रि थितक अनुकूल िवकास के िलए िविनयिमत करे गी ।

3. रा य सरकार ारा कए जाने वाले उपाय-- रा य सरकार इस अिधसूचना के उपबंध को भावी करने के िलए
िन िलिखत उपाय करे गी, अथात् :--

(1) भू-उपयोग - पा रि थितक संवेदी जोन म वन , उ ान-कृ िष े , कृ िष े , आमोद- मोद के योजन के िलए िचि हत
कए गए पाक और खुले थान का वािणि यक और औ ोिगक संब िवकास याकलाप के िलए उपयोग या संप रवतन
नह होगा:

परं तु पा रि थितक संवेदी जोन के भीतर कृ िष भूिम का संप रवतन, मानीटरी सिमित क िसफा रश पर और रा य
सरकार के पूव अनुमोदन से, थानीय िनवािसय क आवासीय ज रत को पूरा करने के िलए और पैरा 4 क सारणी के तंभ
(2) के अधीन मद सं0 20, 26, 33 और सं. 36 के सामने सूचीब याकलाप को पूरा करने के िलए अनु ात ह गे, अथात् :-

(i) िव मान सड़क को चौड़ा और सुदढ़ृ बनाना;

(ii) दूषण का रत न करने वाले लघु उ ोग;

(iii) वषा जल संचयन;

(iv) कु टीर उ ोग, िजसके अंतगत ामीण उ ोग, सुिवधाजनक भंडार और थानीय सुख-सुिवधाएं ह;

परं तु यह और क जनजातीय भूिम का उपयोग रा य सरकार के पूव अनुमोदन और संिवधान के अनु छे द 244 या
त समय वृ िविध के उपबंध के अनुपालन के िबना, िजसके अंतगत अनुसूिचत जनजाित और अ य परं परागत वन िनवासी
(वन अिधकार क मा यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि यक या उ ोग िवकास याकलाप के िलए
अनु ात नह होगा :

परं तु यह और भी क पा रि थितक संवेदी जोन के भीतर भू-अिभलेख म उपसंजात कोई ु ट, मानीटरी सिमित के
िवचार ा करने के प ात् रा य सरकार ारा येक मामले म एक बार संशोिधत होगी और उ ु ट के संशोधन क सूचना
क ीय सरकार के पयावरण, वन और जलवायु प रवतन मं ालय को देनी होगी ।

परं तु यह और भी क उपयु ु ट का संशोधन म इस उप पैरा के अधीन यथा उपबंिधत के िसवाय कसी भी दशा म
भू-उपयोग का प रवतन सि मिलत नह होगा ।

परं तु यह और भी क िजससे ह रत े म जैसे वन े , कृ िष े आ द म कोई पा रणािमक कटौती नह होगी और

अन यु त या अनु पादक कृ िष े म पुन: वनीकरण करने के यास कए जाएंगे ।

(2) ाकृ ितक जल ोत - आचंिलक महायोजना म सभी ाकृ ितक जल ोत क पहचान क जाएगी और उनके संर ण और
पुन भूतकरण के िलए योजना सि मिलत होगी और रा य सरकार ारा ऐसे े पर या उनके िनकट िवकास याकलाप
ितिष करने के िलए ऐसी रीित से मागिनदश तैयार कए जाएंगे ।

(3) पयटन – (क) पा रि थितक संवेदी जोन के भीतर पयटन संबंधी याकलाप पयटन महायोजना के अनुसार ह गे जो क
आंचिलक महायोजना के भाग प म होगी ।

(ख) पयटन महायोजना पयटन िवभाग, गुजरात सरकार ारा राज व और वन िवभाग, गुजरात सरकार के परामश से तैयार
होगी ।

(ग) पयटन संबंधी याकलाप िन निलिखत के अधीन िविनयिमत ह गे, अथात् :-

(i) पा रि थितक संवेदी जोन के भीतर सभी नए पयटन याकलाप या िव मान पयटन याकलाप का
िव तार क ीय सरकार के पयावरण, वन और जलवायु प रवतन मं ालय के मागदशक िस ांत के ारा तथा
रा ीय या संर ण ािधकरण, ारा जारी पा रि थितक पयटन (समय-समय पर यथा संशोिधत) मागदशक
िस ांत के अनुसार, पा रि थितक पयटन, पा रि थितक िश ा और पा रि थितक िवकास को मह व देते
ए पा रि थितक संवेदी जोन क वहन मता के अ ययन पर आधा रत होगा;

(ii) पा रि थितक संवेदी जोन के भीतर होटल और सैरगाह के नए संिनमाण अनु ात नह ह गे ।

(iii) आंचिलक महायोजना का अनुमोदन कए जाने तक, पयटन के िलए िवकास और िव मान पयटन याकलाप
के िव तार को वा तिवक थल िविन द संवी ा तथा मानीटरी सिमित क िसफा रश पर आधा रत संबंिधत
िविनयामक ािधकरण ारा अनु ात कया होगा ।

(4) नैस गक िवरासत -- पा रि थितक संवेदी जोन म मह वपूण नैस गक िवरासत के सभी थल जैसे सभी जीन कोश
आरि त े , शैल िवरचनाएं, जल पात , झरन , घाटी माग , उपवन , गुफाएं, थल , मण, अ रोहण, पातो आ द क
पहचान क जाएगी और उ ह संरि त कया जाएगा तथा उनक सुर ा और संर ा के िलए इस अिधसूचना के अंितम काशन
क तारीख से छह मास के भीतर, उपयु योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।

(5) मानव िन मत िवरासत थल - पा रि थितक संवेदी जोन म भवन , संरचना , िश प-त य, ऐितहािसक, कला मक और
सां कृ ितक मह व के े क पहचान करनी होगी और इस अिधसूचना के अंितम काशन क तारीख से छह माह के भीतर
उनके संर ण क योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म सि मिलत क जाएगी ।

(6) विन दूषण –पयावरण (संर ण) अिधिनयम 1986 के अधीन विन दूषण (िविनयमन और िनयं ण) िनयम, 2000 म
िनयत उपबंध के अनुसरण म पा रि थितक संवेदी जोन म विन दूषण के िनयं ण के िलए िविनयम को कायाि वत करे गा ।

(7) वायु दूषण -- पा रि थितक संवेदी जोन म, वायु दूषण के िनयं ण के िलए दूषण िनयं ण सिमित वायु ( दूषण
िनवारण और िनयं ण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयम के उपबंध के अनुसार म
मागदशक िस ांत और िविनयम तैयार करे गा ।

(8) बिह ाव का िन सारण - पा रि थितक संवेदी जोन म उपचा रत बिह ाव का िन सारण सामा य मानक के िलए
पयावरणीय दूिषत आ छा दत के िन सारण के अंतगत पयावरणीय (संर ण) अिधिनयम, 1986 और उसके अधीन बनाए
गए िनयम के उपबंध के अनुसार होगा ।

(9) ठोस अपिश - ठोस अपिश का िनपटान िन िलिखत प म होगा -

(i) पा रि थितक संवेदी जोन म ठोस अपिश का िनपटान भारत सरकार के पयावरण, वन और जलवायु
प रवतन मं ालय क समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(आ), तारीख 8 अ ैल,
2016 नगरपािलक ठोस अपिश बंध िनयम, 2016 के उपबंध के अनुसार कया जाएगा ;

(ii) थानीय ािधकरण जैव िन ीकरणीय और अजैव िन ीकरणीय संघटक म ठोस अपिश के संपृथ न के
िलए योजनाएं तैयार करगे ;

(iii) जैव िन ीकरणीय साम ी को अिधमानतः खाद बनाकर या कृ िम खेती के मा यम से पुनःच त कया
जाएगा ;

(iv) अकाबिनक साम ी का िनपटान पा रि थितक संवेदी जोन के बाहर पहचान कए गए थल पर कसी
पयावरणीय वीकृ त रीित म होगा और पा रि थितक संवेदी जोन म ठोस अपिश ट को जलाना या
भ मीकरण अनु ात नह होगा।

(10) जैव िच क सीय अपिश ट- पा रि थितक संवेदी जोन म जैव िच क सीय अपिश का िनपटान भारत सरकार के
पयावरण, वन और जलवायु प रवतन मं ालय क समय-समय पर यथासंशोिधत अिधसूचना सं.का.िन.343 (अ) तारीख 28
माच 2016 ारा कािशत जैव िच क सीय अपिश बंध िनयम, 2016 के उपबंध के अनुसार कया जाएगा ।

(11) यानीय प रवहन - प रवहन क यानीय गितिविधयां आवास के अनुकूल िविनयिमत ह गी और इस संबंध म आंचिलक
महायोजना म िवशेष उपबंध अिधकिथत कए जाएंगे और आंचिलक महायोजना के तैयार होने और रा य सरकार के स म
ािधकारी के ारा अनुमो दत होने तक, मानीटरी सिमित वृ िनयम और िविनयम के अनुसार यानीय गितिविधय के
अनुपालन को मानीटर करे गी ।

(12) औ ोिगक इकाईयां - सरकारी राजप म इस अिधसूचना के काशन के बाद या काशन म, पा रि थितक संवेदी जोन
के भीतर कोई नए दूिषत उ ोग क थापना क अनुमित नह दी जाएगी और े म गैर- दूषणकारी उ ोग क यूनतम
50 मीटर चौड़ी ीन बे ट के ावधान को थािपत करने क अनुमित दी जाएगी ।

(13) लाि टक के उपयोग - पा रि थितक संवेदी जोन े के भीतर कोई भी ि लाि टक थैल का उपयोग नह करे गा
और लाि टक व तु को िनपटाने के िलए स ती से िविनयिमत होगी ।

(14) जाग कता - पा रि थितक संवेदी जोन के अंतगत आने वाले येक ाम म रा य सरकार के पयावरण एवं वन
िवभाग म कृ ित िश ा और पयावरणीय जाग कता अिभयान िविनयिमत कया जाएगा, रा ीय उ ान के मह व और
उपयोिगता पर भी काश डाला जाएगा।

4. पा रि थितक संवद
े ी जोन म ितिष और िविनयिमत याकलाप क सूची - पा रि थितक संवेदी जोन म सभी
याकलाप पयावरण (संर ण) अिधिनयम, 1986 (1986 का 29) के उपबंध और त ीन बनाए गए िनयम ारा शािसत
ह गे और नीचे दी गई तािलका म िविन द रीित म िविनयिमत ह गे, अथात् :--

ितिष याकलाप

1. वािणि यक खनन । (क) सभी कार के खनन (लघु और वृहत खिनज), प थर क खान और
उनको तोड़ने क इकाइयां वा तिवक थानीय िनवािसय क घरे लू
आव यकता के िसवाय नह ह गी ;

(ख) खनन सं याएं, माननीय उ तम यायालय क रट यािचका (िसिवल)

सं. 1995 का 202 टी.एन. गौडाबमन िथ मूलपाद बनाम भारत सरकार के
मामले म आदेश तारीख 4 अग त, 2006, और रट यािचका (सी) सं. 2012
का 435 गोवा फाउं डेशन बनाम भारत सरकार के मामले म तारीख 21
अ ैल, 2014, के अंत रम आदेश के अनुसरण म सवदा चालन होगा ।

2. आरा िमल क थापना । पा रि थितक संवेदी जोन के भीतर नई और िव मान आरा िमल का
िव तार अनु ात नह होगा ।

3. नए उ ोग के कारण दूषण (जल, वायु, कोई नई या पा रि थितक संवेदी जोन म दूषण फै लाने वाले उ ोग के
िम ी, विन, आ द) क थापना। िव तार क अनुमित दी जाएगी।

कृ िष आधा रत लघु उ ोग , को गुजरात सरकार के िनयम के प म

िविनयिमत कया जाएगा ।

4. कसी प रसंकटमय पदाथ का उपयोग या गुजरात सरकार के मानदंड के अनुसार ह गे ।

उ पादन ।

5. नई बृहत ताप िव ुत प रयोजना क लागू िविधय के अनुसार ितिष (अ यथा उपबंिधत के िसवाय) ।
थापना ।

6. म यम धन व के फाइबर बोड/ पा टकल बोड लागू िविधय के अनुसार ितिष (अ यथा उपबंिधत के िसवाय) ।
क थापना।.

7. ाकृ ितक जल िनकाय या सतही े म लागू िविधय के अनुसार ितिष (अ यथा उपबंिधत के िसवाय) ।
अनुपचा रत बिह ाव और ठोस अपिश
का िन सारण ।

8. टभ क थापना करना। लागू िविधय के अनुसार ितिष (अ यथा उपबंिधत के िसवाय) ।

9. वािणि यक हेलीका टर सेवा। लागू िविधय के अनुसार ितिष (अ यथा उपबंिधत के िसवाय) ।

10. जलावन लकड़ी का वािणि यक उपयोग । लागू िविधय के अनुसार ितिष (अ यथा उपबंिधत के िसवाय) ।

िविनयिमत याकलाप

11. वृ क कटाई । (क) रा य सरकार म स म ािधकारी क पूव अनुमित के िबना वन,

सरकारी या राज व या िनजी भूिम पर या वन म कही वृ क कटाई नह
होगी ।

(ख) वृ क कटाई संबंिधत क ीय या रा य अिधिनयम या उसके अधीन

बनाए गए िनयम के उपबंध के अनुसार िविनयिमत होगी ।

12. होटल और रसोट क वािणि यक थापना पा रि थितक पयटन याकलाप से संबंिधत पयटक के अ थायी वसाय के
। िलए आवास के संबंध म संरि त े क सीमा के एक कलोमीटर या
पा रि थितक संवेदी जोन क सीमा तक, जो भी िनकट हो, के भीतर ही नए
वािणि यक होटल और रसोट को अनु ात कया जाएगा अ यथा नह :

पर तु व यजीव अभयार य क सीमा से एक कलोमीटर से परे और

पा रि थितक संवेदी जोन के िव तार तक सभी नए पयटन याकलाप या
िव मान याकलाप का िव तार पयटन महायोजना के अनु प होगा ।

13. पयटन से संबंिधत याकलाप जैसे गम वायु लागू िविधय के अधीन िविनयिमत ह गे ।

14. संिनमाण याकलाप। (क)संरि त े क एक कलोमीटर क सीमा के भीतर कसी भी कार के

नए वािणि यक संिनमाण को अनु ात नह कया जाएगा:

परं तु थानीय लोग को पैरा 3 के उप पैरा (1) म सूचीब याकलाप

सिहत उनके आवासीय उपयोग के िलए उनक भूिम म संिनमाण करने क
अनुमित दी जाएगी ।

ऐसे लघु उ ोग जो दूषण उ प न नह करते ह, से संबंिधत संिनमाण

याकलाप िविनयिमत कए जाएंगे और लागू िनयम और िविनयम , य द
कोई ह , के अनुसार स म ािधकारी क पूव अनुमित से ही यूनतम पर रखे
जाएंगे ।

(ख) एक कलोमीटर से आगे और पा रि थितक संवेदी जोन क सीमा तक

वा तिवक थानीय आव यकता के िलए संिनमाण क अनु ा दी जाएगी
और अ य वािणि यक संिनमाण याकलाप आंचिलक महायोजना के अनु प
ह गे।

15. होटल और लॉज के िव मान प रसर म लागू िविधय के अधीन िविनयिमत ह गे ।

17. वािणि यक जल संसाधन िजसके अंतगत भू- (क) भूिम के अिधभोगी के वा तिवक कृ िष और घरे लू खपत के िलए जल का
जल संचयन भी है । िन कषण (सतही और भूिमगत जल) अनु ात होगा ।

(ख) औ ोिगक, वािणि यक उपयोग के िलए सतही और भूिमगत जल का

िनकासी) के िलए खुले कु आ, बोर कु आ, के िलए स ती क जाएगी, सिहत अ छी तरह से रे लग के संिनमाण अिनवाय
आ द। और याकलाप म उपयु ािधकारी ारा िनगरानी स ती से क जाएगी ।

पा रि थितक संवद
(3) ारा द शि य का योग करते ए (1986 का 29), क ीय सरकार, जे सोर पा रि थितक संवेदी जोन के भावी
मानीटरी के िलए एक मानीटरी सिमित का गठन करे गी जो िन िलिखत से िमलकर बनेगी, अथात् :-

(ख) भारत सरकार के पयावरण, वन और जलवायु प रवतन मं ालय ारा नामिन द कये -सद य;

(ग) पयावरण के े म काय करने वाले गैर सरकारी संगठन (िजसके अंतगत िवरासत -सद य;
संर ण भी है) रा य सरकार ारा नामिन द एक ितिनिध

(घ) े ीय अिधकारी, गुजरात रा य दूषण िनयं ण बोड, बनासकांथा -सद य;

(ड.) े का ये नगर योजनाकार -सद य;

(च) गुजरात सरकार के पयावरण और वन िवभाग ारा नाम िन द एक ितिनिध -सद य;

(छ) पा रि थित िव ान और पयावरण के े म गुजरात सरकार ारा नािमत एक

ितिनिध
-सद य;

(ज) रा य जैव िविवधता बोड का सद य -सद य;

6. िनदश िनबंधन

(1) मानीटरी सिमित का कायकाल तीन वष का होगा।

(2) पा रि थितक संवेदी जोन सिमित इस अिधसूचना के उपबंध के अनुपालन को मानीटर करे गी ।

(3) पा रि थितक संवेदी जोन म भारत सरकार के त कालीन पयावरण और वन मं ालय क अिधसूचना सं. का.आ.
1533(अ) तारीख 14 िसतंबर, 2006 क अनुसूची म के अधीन सि मिलत याकलाप और इस अिधसूचना के पैरा 4 के
अधीन ितिष गितिविधय के िसवाय आने वाले ऐसे याकलाप क दशा म वा तिवक िविन द थलीय दशा पर
आधा रत मानीटरी सिमित ारा संवी ा क जाएगी और उ अिधसूचना के उपबंध के अधीन पूव पयावरण िनकासी के िलए
के ीय सरकार के पयावरण, वन और जलवायु प रवतन मं ालय को िन द क जाएगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन द ितिष याकलाप के िसवाय, भारत सरकार के त कालीन
पयावरण और वन मं ालय क अिधसूचना सं यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 क अिधसूचना के अनुसूची
के अधीन ऐसे याकलाप , िज ह सि मिलत नह कया गया है, परं तु पा रि थितक संवेदी जोन म आते ह, ऐसे याकलाप
क वा तिवक िविन द थलीय दशा पर आधा रत मानीटरी सिमित ारा संवी ा क जाएगी और उसे संब िविनयामक
ािधकरण को िन द कया जाएगा ।

(5) मानीटरी सिमित का सद य-सिचव या संब उपायु त, ऐसे ि के िव , जो इस अिधसूचना के कसी उपबंध
का उ लंघन करता है, पयावरण (संर ण) अिधिनयम, 1986 क धारा 19 के अधीन प रवाद फाइल करने के िलए स म
होगा ।

(6) मानीटरी सिमित मु ा दर मु ा के आधार पर अपे ा पर िनभर रहते ए संब िवभाग के ितिनिधय या
िवशेष , औ ोिगक संगम या संब पणधा रय के ितिनिधय को अपने िवचार-िवमश म सहायता के िलए आमंि त कर
सके गी ।

(7) मानीटरी सिमित येक वष क 31 माच तक क रा य के मु य व यजीव वाडन को अपनी वा षक कारवाई रपोट
उपाबंध IV पर उपाब प िवधान के अनुसार उ त वष के 30 जून तक तुत करे गी ।

NOTIFICATION
New Delhi, the 2nd February, 2017
S.O. 351(E).—The following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-
section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under
sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected
thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry
of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to
the Public;
Any person interested in making any objections or suggestions on the proposals contained in the draft
notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification
WHEREAS, with the prime aim of long term protection and conservation of Sloth Bear and the rare and endangered
biological diversity, the 3674.59 hectares of Reserve forest and 14104.368 hectares protected forest, including 287.33
hectares of Revenue land, totally 18066.28 hectares in Taluka of Amirgadh and Dantivada in Banaskantha district in the
state of Gujarat was declared as Jessore Wildlife Sanctuary vide Notification no. GH-KH-65/ 78- WLP/ 2077/ 62041-P
dated the 6th May, 1978;
AND WHEREAS, Jessore forest is categorised as Tropical Dry Deciduous and Desert Thorn Forest, with rich plant
biodiversity and also varieties of mammals, reptiles, insects and avifauna and the area is catchment of important rivers
like Sipu and Banas, playing an important role in recharging the water table of Banaskantha district;
AND WHEREAS, the sanctuary is home to 12 species of amphibians, 45 species of reptiles, 212 species of birds, and 30
species of mammals, sloth bear (Melursus ursinus) is the flagship species of the Jessore Wildlife Sanctuary and the
leopard (Pathera pardus) is one of the top predators inhabiting the sanctuary area and the other major vertebrate species
of the area include the striped hyaena, jungle cat, jackal, Indian fox, common langur, nilgai, rats, hedgehog, Indian
pangolin, bats, procupine etc.;
AND WHEREAS, the Jessore Wildlife Sanctuary is endowed with a great floral and faunal diversity including many rare
and endangered species and the sanctuary has a total of 487 species of plants which include 110 species of trees, 58
species of shrubs, 83 species of climbers, one species of pteridophyte and 235 species of herbs, sedges and grasses;
AND WHEREAS, the extremely closed vicinity of the sanctuary to human habitation, ongoing developmental activities,
industrialisation and mining activities around the Sanctuary, necessitate the requirement of proper safeguards and control
over such activities in view of long term wildlife conservation;
AND WHEREAS, it is necessary to conserve and protect the area around the protected area of Jessore Wildlife
Sanctuary as Eco-sensitive Zone from ecological and environmental point of view;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of sub
- section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the
Environment (Protection) Rules, 1986, the Central Government hereby notifies the area up to 4.00 kilometers from the
boundary of the protected area of the Jessore Wildlife Sanctuary in the Jessore Forest in Amirgadh and Dantivada
Talukas in the State of Gujarat as the Jessore Wildlife Sanctuary Eco-sensitive Zone (herein after called as Eco-sensitive
Zone).
1. Extent and Boundaries of Jessore Wildlife Sanctuary Eco-sensitive Zone.- (1) Jessore Wildlife Sanctuary
Eco-sensitive Zone shall be with a peripheral area of about 30254 hectares (4 kilometers from the boundary of the
sanctuary) including 30 villages of Amirgadh, Dantivada and Palanpur Talukas.
(2) The map and Global Positioning System points of the Eco-sensitive Zone is appended to this notification as
Annexure-I and Annexure-II, respectively.
(3) The list of the villages along with their boundary description within the proposed Eco-sensitive Zone is appended as
Annexure-III.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification.

(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as
is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued
by the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating
the ecological and environmental considerations into the said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj;
(xi) Public Works Department.
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,
management of catchment areas, watershed management, groundwater management, soil and moisture conservation,
needs of local community and such other aspects of the ecology and environment that need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types
and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,
orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone as to ensure Eco-friendly
development for livelihood security of local communities.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Land use.-Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the
residential needs of the local residents, and for the activities listed at item numbers 20, 26, 33 and 36 specified under
column (2) of the Table in paragraph 4, namely:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) small scale industries not causing pollution;
(iii) rainwater harvesting; and
(iv) Cottage industries including village industries, convenience stores and local amenities:
Provided further that no use of tribal land shall be permitted for commercial and industrial development
activities without the prior approval of the State Government and without compliance of the provisions of article 244 of
the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest
Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by
the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as
provided under this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural
area and efforts shall be made to reforest the unused or unproductive agricultural areas.
(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State
Government in such a manner as to prohibit development activities at or near these areas as which are detrimental to such
areas.
(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,
which shall form part of the Zonal Master Plan.
(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Gujarat in consultation
with Department of Environment and Forest, Government of Gujarat.
(c) The activity of tourism shall be regulated as under, namely:-
(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time)
with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-
sensitive Zone;
(ii) new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities
shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation
of the Monitoring Committee.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and
preserved and plan shall be drawn up for their protection and conservation, within six months from the date of
publication of this notification and such plan shall form part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,
aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be
prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or State Pollution Control Board shall
implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions the
Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for
the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and
Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental
(Protection) Act, 1986 and rules made therein.
(9) Solid wastes. - Disposal of solid wastes shall be as under:-
(i) the solid waste disposal in the Eco-sensitive Zone shall be carried out as per the provisions of the Solid Waste
Management Rules, 2016 published by the Government of India in the erstwhile Ministry of Environment and Forests
vide notification number S.O. 1357 (E), dated the 8th April, 2016 as amended from time to time;
(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable
components;
(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;
(iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-
sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the
provisions of the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the erstwhile
Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016
as amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is
prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(12) Industrial Units. - On or after the publication of this notification in the Official Gazette, no new polluting
industries shall be allowed to be set up within the Eco-sensitive Zone and the non-polluting industries in the region may
be considered with the provision of a minimum of 50 meter wide green belt.
(13) Use of Plastics. - No person shall use plastic carry bags within the Eco-sensitive Zone area and the disposal of
plastic articles shall be strictly regulated.
(14) Awareness. - The Environment and Forests Department of the State Government shall regularly carry out nature
education and environmental awareness campaigns in each village falling in Eco-sensitive Zone, highlighting the
importance and usefulness of the National Park.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made
thereunder and be regulated in the manner specified in the Table below, namely:-

5. Eco-sensitive Zone Monitoring Committee:- In exercise of the powers conferred by sub-section (3) of section
3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a Committee to be
called the Jessore Eco-sensitive Zone Monitoring Committee to monitor the compliance of this notification and the
Monitoring Committee shall consist of following members, namely:-
(a) Collector, Banaskantha - Chairperson;
(b) A representative of the Ministry of Environment, Forest and Climate Change, Government of India -
Member;
(c) A representative of Non-governmental Organisations working in the field of environment (including
heritage conservation) to be nominated by the Government of India - Member;
(d) Regional Officer, Gujarat State Pollution Control Board, Banaskantha - Member;
(e) Senior Town Planner of the area - Member;
(f) A representative of the Department of Forest and Environment, Government of Gujarat - Member;
(g) One expert in the area of Ecology and Environment to be nominated by the Ministry of Environment,
Forest and Climate Change, Government of India - Member;
(h) Member, State Biodiversity Board – Member;
(i) Deputy Conservator of Forests (In Charge of the Jessore Wildlife Sanctuary), Banaskantha - Member
Secretary.
6. Terms of Reference:-
(1) The tenure of the Monitoring committee is for a period of three (3) years.
(2) The Monitoring Committee shall monitor the compliance of the provisions of this notification.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the
Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental
clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the
concerned regulatory authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be
competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person
who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from Industry Associations or concerned stakeholders to assist in its deliberations depending on the
requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every
year by 30th June of that year to the Chief Wildlife Warden in the state as per pro- forma given at Annexure-IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions,
as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. The Central Government and State Government may specify additional measures, if any, for giving effect to
provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
