AN ORDINANCE PROVIDING FOR CAPABILITY BUILDING
AND TECHNICAL SKILLS DEVELOPMENT PROGRAM FOR
OUT OF SCHOOL YOUTH IN THE CITY OF CABADBARAN
AND APPROPRIATING FUNDS THEREOF

Explanatory Note

Republic Act No. 8044 otherwise known as the “Youth in Nation- Building Act”
seeks to maximize the youth’s vital role in society and their active participation in
nation-building. It promotes youth development through conscious exercise of their
rights and duties and inculcating the value of patriotism and nationalism.

The City Government of Cabadbaran recognizes the role of the youth sector in
the socio-economic development of the City. Because of this, plans, programs and
projects are formulated and included as part of the regular affairs of the City, focusing
more on the Out-of-School Youth (OSY).

To uphold the rights of the OSY and ensure their general welfare and
protection, the Sangguniang Panlungsod of this City enacted this Ordinance.

NOW THEREFORE

BE IT ORDAINED, by the 3rd Sangguniang Panlungsod of Cabadbaran City, in


its 85thRegular Session, that:

SECTION 1. TITLE- This ordinance shall be known as the “CAPABILITY


BUILDING AND TECHINICAL SKILLS DEVELOPMENT PROGRAM FOR OUT-OF
SCHOOL YOUTH IN THE CITY OF CABADBARAN”.

SECTION 2. POLICY - It is the policy of this City to protect the youth’s


physical, moral, spiritual, and social well-being and to inculcate in them patriotism and
nationalism and to encourage their involvement in public and civic affairs.

SECTION 3. COVERAGE - This ordinance shall apply to all out-of-school youth


(OSY) ages 18-30 years old and have completed secondary education whose parents’
income is below poverty line as determined by the City Social Welfare and Development
Office.

SECTION 4. DEFINITION OF TERMS-

1. Youth- for purposes of this Ordinance youth shall be referred as those


persons whose ages range from eighteen (18) to thirty (30) years old
2. TESDA (Technical Education and Skills Development Authority) – which
task is to provide technical education and skills training to the youth
3. Focal Person – a person in charge in a particular program

SECTION 5. COMPONENTS OF THE CAPABILITY BUILDING AND


TECHNICAL SKILLS DEVELOPMENT PROGRAM - In order to attain the declared
policy, there is hereby established the Out of School Youth CAPABILITY BUILDING
AND TECHNICAL SKILLS DEVELOPMENT PROGRAM in two (2) levels:

Level 1 – Values Formation cum Spiritual Enhancement (3 days) - with the CSWD
Social Workers and the religious sector.

Level 2 - Actual training of TESDA accredited course (depending on the offered


courses)
- Capability building
- Technical skills development

SECTION 6. MODE OF CASH ASSISTANCE AND PAYMENT SCHEME-

1. Cash assistance for the following:


a. Training fee for TESDA and/or other TESDA accredited learning institutions
b. Assessment fee
c. Training materials/kits, and uniform
d. Transportation allowance
e. Food subsistence allowance
f. Lodging while on training
2. Cash assistance shall depend on the kind of technical skills applied by the OSY.
3. A Statement of Account shall be submitted to CSWD focal person for validation
and assessment before processing of voucher

SECTION 7. MONITORING - For the successful implementation of this


program, the CSWD Office through the focal person is responsible in monitoring the
trainees from graduation to their employment.

SECTION 8. REQUIREMENTS FOR ADMISSION - Before admitting a youth


to the OSY program, the following must be looked into:

1. He/she must be a Filipino.


2. Must be 18-30 years old whether single or married.
3. Must have good moral character as certified by the School Principal/ Head or
Punong Barangay.
4. Must be a bonafide resident of the City for at least six (6) months as certified
by the Punong Barangay.
5. Must be a high school graduate as evidenced by his/her Report Card or
Form 138.
6. Must be an active member of the OSY organization for at least six (6) months
as certified by the President of the Barangay OSY Organization and noted by
the Punong Barangay
7. Must be willing to sign an agreement for the completion of the program.

SECTION 9. THE OUT-OF-SCHOOL YOUTH BARANGAY AND FEDERATED


ORGANIZATIONs- the CSWD office shall organize a barangay and federated OSY
Organization:

C. Functions:
1. Formulate the Internal Rules and Procedures of the organization, subject to
consultation with the focal person of the CSWD.
2. Cause the information dissemination to the barangays regarding the OSY
program.
3. Participate in advocacy workshops and programs on:
o Moral recovery
o Anti-drug abuse
o Anti-trafficking
o Sustainable development of the youth
o Climate change adaptation
o Disaster risk reduction management.
4. Invite for more OSY members.

SECTION 10. IMPLEMENTING RULES AND REGULATION (IRR) - The


CSWD Office is mandated to prepare an IRR for this ordinance.

SECTION 11. APPROPRIATION - An amount of not less than One Million


Pesos (P 1,000,000.00) is appropriated under the CSWD office for the sustainability of
the program.

SECTION 12. SEPARABILITY CLAUSE - Should any provision of this


ordinance be declared unconstitutional or illegal by any court of competent jurisdiction,
those parts that are not so declared shall remain in full force and effect.

SECTION 13. REPEALING CLAUSE - Any previous ordinance or parts thereof,


which are inconsistent with this ordinance are hereby repealed or superseded
accordingly.

SECTION 14. EFFECTIVITY - This ordinance shall take effect after its approval
