Federationvide its letter dated 0410112018 brought to the notice of Railway Board, a case of
incorrect and illogical implementationof Board's instructionsby the Divisional Authorities in the caseof
Shd Y. Josephretired SSE (C&W), PuneDivision of Central Railway. A period of more than two months
has passed,however,there is no responseto Federation'scommunication.

Federation reiterates below in brief the facts of the case for proper appreciationat Railway
Board's level:-

o Shri Y. Joseph,SSE (C&W), Pune Division, Central Railway retired from Railway service on
3110312010 on superannuation. He was placedunder suspensionw.e.f. 2410312010 while the D
& AR casewas initiated againsthim.
o The D & AR case of Shri Joseph had been finalized, after retirement, at the level of the
Presidentof India and orders communicatedto the retired employeevide Board's letter dated
24t08t20r5.
o Vide order dated 2410812015, the Presidenthad orderedimposition of penalty of reductionof the
monthly pensionto the minimum admissibleon pennanentbasis.
o The Divisional Authorities have failed to appreciatethat when the employeehas been working
in GP 4600/- (PB-2) at the time of retirementhow the minimum pensionat the rate of Rs. 3500
in GP 1800/-canbe grantedw.e.f.01ll2l20l5.

While enclosing copy of Federation's letter dated 0410112018,


NFIR once again requeststhe
Railway Board to issue necessary clarification to the General Manager, Central Railway to grant
minimum pensionto Shri Josephin GP 46001-+ PB-2 as againstRs. 3500 in GP 1800/-,being given at
present.

A copy of the instructionsissuedmay be endorsedto the Federation.

A caserelating to the DisciplinaryProceedingsagainstShri SanjayKumar Choudhary,


Sr. Clerk working under Sr. DPo/Vijayawada Division of SouthCenrralituit*uy was broughtio
the notice of Railway_Board highlightingthe injusticemetedout to the staff by the authorities
ignoring their own findings. Aggrieved with the wrong decision taken by ihe Revisionary
Authority, the employeehad no other option exceptto suLmitPetitionto the Hon'ble president
underRule 31 of the D&A Rules witlasubmission for quashingthe punishment.A copy of the
PetitiondatedI8e January2017 sentUy StrriChoudharyaddressed to the Hon'ble presidentwas
also forwarded to the Railway Board together with Federation'sletter daied 06/0412017.
Federationfeels disappointedto note that thougha periodof over eight monthshaspassed,the
decision of the Hon'ble President for exoneratingthe employee of the wrongly initiated
DisciplinaryProceedingsis yet to be communicated.

Federationtherefore,onceagainurgesuponthe RailwayBoardto kindly processthe case


for obtainingthe approvalof the Hon'ble Presidentfor exoneratingthe .*pioyr* be obtained
soon.Progressmadein the mafiermay kindly be advisedto the Fedeiationsoon.
