ORDINANCE CREATING THE ADMINISTRATIVE

BOARD FOR PUBLIC NUISANCES IN THE CITY OF
VALENZUELA.

WHEREAS, Article 2, section 4 of the 1987 constitution states that the prime Du ty
of the Government is to serue and protect the peo ple and its for the reason that the national,
Government is adamant in devising ways and means to safeguard the welfare of its people;

WHEREAS, drug abuse has become of the worst social afflictions that has been
plaguing countries all over the world today and thus, gives rise to the upsurge
of deviant and
criminal behavior which causes untold suffering and destruction of precious human lives;

WHEREAS, a percentage of public nuisances, as reflected from the records kept by

the Valenzuela City Police, were caused by individuals under the influence of such prohibited
drugs;

WHEREAS, as stated by Republic Act 9165, othenrise known as the comprehensive

Dangerous Drug Act oI 2002, its primary mission are to eradicate the supply and demand
of
dangerous drugs and their precursors and to stop trafiicking to and from ihe country and to
promote regional and international cooperation in drug abuse prevention and
control;

}yHEREAS, DILG Memorandum circurar No. 9&227 dated December 2, 199g,

mandates the creation of provincial, city, municipal and antidrugs abuse councils which
will
serve as a focal point through which various organizations and individuals work together
cooperatively in the planning, implementation and evaluation of programs on drug abuse
prevention;

WHEREAS, Local Government are the most a ppropriate agencies that should be
designated as lead agencies with the active participatio n of NGO's in the prevention of
drug
abuse and they are vested with the access and authority to act on specific needs and
problems of a particular community;

,Section 52 of RA 9165 states that any city or municipality may, by
an administrative board to hear complaints regarding drug-related public

SECTION 3.Generat Objective. Through this Board, there is an ex pected
develo pment and adoption of a comprehensive, integrated, unified and balanced preventio
and strategy in conkolling the proliferation of drug-related public nuisances.

SECTION 4. Specffic Objectives.

A. lncrease community knowledge about drug-related public nuisances.

B. An understanding of the underlying causes and complexity of drug-related public

nuisances.

C. Ability to determine places of drug-related public nuisance.

D. lmprove communication among various sectors of society in combating drug-
related public nuisances.

E. An understanding of the drug related public nuisance phenomenon and its impact
to the community,

F. An understanding of one's role in the prevention and control of drug-related public

nuisances.

SECTION 5. Roles of the Administative Body for public Nuisances.

A. lssue an order immediately prohibiting the conduct, operation or maintenance of
any business or activity on the premises which is conducive to such nuisances.

B. The Administrative Board may bring a complaint seekin g a permanent injunction

against any nuisances as described under the mplementing Rules and

C. The Administrative Boad, upon showing the plm is no lorqer a place of public
nuisance, may conduct heaing witr he compldnt duly notified, br he pssible
lifting of the order.

SECTIOII 6. Canlrcii/foln. The Boad shall be cornpos€d of the City Health

Officer as Chairperson and the City Legal ffice and the Valenzuela City Police as member.

SECTIOII 7.
Copies of this Ordinance shall be given to trc Sanggunian
, Liga ng mga Barangay, Philippine National Police - Valenzuela, and Department
lnterior and Local Government.
