EREAS, the Philippine Constitution declares as a state policy to provide i

territorial and political subdivisions genuine and meaningful local autonomy to
enable them to attain their fullest development as self-reliant communities and as
effective partners in the attainment of national goals;

WHEREAS, the state likewise declares that the vesting of duty, responsibility
and accountability in local government units (LGU) shall be accompanied with
provision for reasonably adequate resources in order to effectively carry out their
functions;
WHEREAS, under Section 34- A, in relation to Section 36, of RA 7875
( National Health Insurance Act of 1995), as amended by R.A. 9241, and further
amended by R.A. 10606 ( National Health Insurance Act of 2013) it is expressly
ovided that -

"SEC. 34-A Other Provider Payment Guidelines. - No other fee or

expense shall be charged to the indigent patient, subject to the guidelines
issued by the Corporation.

"All payments for professional services rendered by salaried public

providers shall be allowed to be retained by the health facility in which \
/
services are rendered and be pooled and distributed among health
personnel. Charges paid to public facilities shall be retained by the
individual facility in which services were rendered and for which payment
was made. Such revenues shall be used to primarily defray operating costs
other than salaries, to maintain or upgrade equipment, plant or facility, and
to maintain or improve the quality of service in the public sector."

"SEC. 36. Role of Local Government Units ( LGUsJ ent with \ v / \
the mandates for each political subdivision under Republic Act No. 7160 or \
'The Local Government Code of 1991', LGUs shall provide basic health care \
services.

“ To augment their funds, LGUs shall invest the capitation payments

given to them by the Corporation on health infrastructures or equipment,
professional fees, drugs and supplies, or information technology and
database:

Provided, That basic health care services, as defined by the DOH and
the Corporation, shall be ensured especially with the end in view of
improving maternal, infant and child health: Provided, further, That the
capitation payments shall be segregated and placed into a special trust fund

created by LGUs and be accessed for the use of such mandated purpose."

WHEREAS, under Title V, Sub -title C par. 2 (c) and (d ) of Philhealth Circula

No. 2020-0012 providing for the "Guidelines on the COVID 19 Community Isolation
Benefit Package (CCIBP )” , it is also expressly provided that:

"c. The corresponding reimbursement rate is a maximum of

Php22,449.00 per claim.

d. The claims from government health care facilities shall be utilized

to cover all services, medicines and diagnostics provided for in this
Circular and other operating expenses to support delivery of care,
including hiring of additional personnel, internet subscription,
/ service provider subscription fee and IT hardware. Any remaining
fund may be utilized for incentives for human resource involved in its
operation with sharing based on internal guidelines.”

NOW, THEREFORE, be it ORDAINED, as it is hereby ORDAINED, by the

Sangguniang Panlungsod, in a session duly assembled that:

SECTION 1 TITLE. - This Ordinance shall be known as "AN ORDINANCE
EATING A PHILHEALTH TRUST FUND" .

SECTION 2 CREATION. A Philhealth Trust Fund is hereby created on the
proceeds from Philhealth's Covid -19 Community Isolation Benefit Package (CCIBP)
for Community Isolation Units (CIU).

SECTION 3 TERMS AND CONDITIONS FOR THE RELEASE OF FUND. - The
proceeds from Philhealth's Covid -19 CCIBP for CIU shall be released under the
following terms and conditions:

3.1 The disbursement and liquidation of the TRUST FUND shall be in accordance
with pertinent government accounting and auditing rules and regulations;

3.2 A separate book of accounts shall be maintained by the local government

unit

3.3 The proceeds of the funds consisting of Twenty-Two Thousand Four

Hundred Forty-Nine Pesos (P22,449.00) per case shall be allocated and
utilized to cover all services, medicines and diagnostics provided within the
entire episode of care at the CIU and other operating expenses to support%,>^ ) '
delivery of care, including hiring of additional personnel, internet NJ
subscription, service provider subscription fee and IT hardware. Arw\
remaining fund may be utilized for incentives for human resource involved i\
its operation with sharing based on internal guidelines as provided in the

provisions of Philhealth Circular No. 2020-0012, and subject to existing COA
Rules.

The release of the said fund may be withheld under any of the
following conditions:

3.4.1 Delay or non-payment of premium contributions; /"X ,

3.4.2 Violation of government accounting and auditing rules and I \
regulations on disbursement and liquidation of the TRUST \-s
FUND; and
3.4.3 Non-submission of the required reports.

SECTION 3- A. REPORTING REQUIREMENTS. - The CIUs through the City
Health Office shall submit expenditure and utilization reports on a monthly basis.

SECTION 4. REPEALING CLAUSE. - All City ordinances, implementing rules

and regulations, and executive orders, or parts thereof, which are inconsistent with
e provisions of this Ordinance are hereby repealed and/or modified accordingly.

SECTION 5. SEPARABILITY CLAUSE. - If, for any reason or reasons, any part
or provision of this Ordinance shall be held to be unconstitutional or invalid, other
parts or provisions hereof which are not affected thereby shall continue to be in full
force and effect

) SECTION 6. EFFECTIVITY CLAUSE. - This Ordinance shall take effect

immediately upon its approval.
