PROCEEDS FROM THE PHILHEALTH FOR OUTPATIENT
HIV / AIDS TREATMENT (OHAT) PACKAGE.

WHEREAS, Philhealth through board Resolution No. 1331, series of 2009, has \
approved the implementation of an HIV/ AIDS Benefit Package for confirmed
HIV/ AIDS cases requiring treatment;

WHEREAS, This Benefit aims to increase the proportion of the pop,

WHEREAS, With the new HIV treatment guidelines, rules on eligibility, d

WHEREAS, Philhealth Circular 2021- 0025, is issued to provide guidelines on

accreditation of HIV treatment hubs and primary care facilities, and availment of
Outpatient HIV/AIDS treatment (OHAT) Package.

NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the

Sangguniang Panlungsod, in session duly assembled.

SECTION 1. This Ordinance shall be known as "AN ORDINANCE CREATING A

PHILHEALTH TRUST FUND".

SECTION 2. A Philhealth Trust Fund is hereby created on the proceeds from

Philhealth OUTPATIENT HIV / AIDS TREATMENT (OHAT) PACKAGE.

SECTION 3. The disposition of the TRUST FUND shall be governed by the

a.) Eighty percent (80%) - for the facility to be used as revolving fund for the
delivery of the required service / s such as, but not limited to drugs (ARV,
TB preventive therapy, drugs for opportunistic infection) vaccines,
supplies, laboratory reagents and cartridges, equipment (includinj
procurement and maintenance of viral load and CD4 machines), payment
for outsourced services and referrals like laboratory test, couriers services
for ARV delivery, and other necessary services.

b.) Twenty percent (20%) - for the professional fee shall be divided among
the HIV/ AIDS Core Team (HACT) and other staff directly providing the
services composed of, but not limited to the following: doctors, dentist,
nurses, medical technologist, pharmacists, medical social workers, HIV
managers, counselors, and data encoders.

Uninterrupted supplies and continues intake of ARV are the key to viral N
suppression and survival of PLHIV's ARV and other drugs procured by the
facility in cases of national stock-outs or supply, should be charged to the
OHAT Package. ^^o^

3.1 The Disbursement and liquidation of the TRUST FUND shall be in

accordance with pertinent government accounting and auditing ruj(§5v and
regulation;

3.2 A separate book of accounts shall be maintained by the local government

unit;

3.3 The proceeds of the funds consisting of SEVEN THOUSAND FIVE

HUNDRED PESOS (Php7,500.00) per quarter. Annual reimbursement is set at a
maximum of THIRTY THOUSAND PESOS (Php30,000.00) per case shall be
llocated and be utilized to cover all services, medicines and diagnostics. Any
remaining fund maybe utilized for incentives for human resource involved in its
operation with sharing based on internal guidelines as provided in the provision of
Philhealth Circular 2021-0025, and subject to existing COA Rules.

SECTION 4 PhilHealth may withhold the release of the subsequent quarterly
PCFs due to any of the following:
Delay or non-payment of premium contribution;
Violation of government accounting and auditing rules and regulations on
disbursement and liquidation of the TRUST FUND; and
Non-submission of the required reports.

SECTION 5 REPEALING CLAUSE All city ordinances, implementing rules
and regulations, and executive orders, or parts thereof, which are inconsistent with
the provisions of this Ordinance are hereby repealed and/ or modified accordingly.

SECTION 6. SEPARABILITY CLAUSE. If, for any reason or reasons, any part
or provision of this Ordinance shall be held to be unconstitutional or invalid, other
parts or provisions hereof which are not affected thereby shall continue to be in full
force and effect

SECTION 7. EFFECTIVITY CLAUSE. This Ordinance shall take effect

immediately upon its approval.
