AN ORDINANCE INSTITUTIONALIZING BARANGAY TANODS OF DUMAGUETE CITY EXPANDING ITS


SERVICES TO OTHER COMPONENT BARANGAYS AGAINST CRIMES, LAWLESSNESS AND DISASTERS AND
PROVIDING FUNDS THEREOF FOR ITS OPERATIONS

Be it ordained by the SangguniangPanlungsod of Dumaguete City assembled.

SECTION 1. TITLE. – This ordinance shall adopt the title “An Ordinance Institutionalizing Barangay
Tanods of Dumaguete City expanding its services to other component barangays against crimes
lawlessness and disasters and providing funds thereof for its operations”.

SECTION 2. DECLARATION POLICY – It is the declared policy of the state to promote and enhance
the efficiency and responsiveness of barangay officials, including Barangay Tanods. Barangay Tanods are
duly created under the Local Government Code of 1991, has an indispensable role in barangay
government specifically in the maintenance and peace and order and the promotion of public safety
within the barangay.

SECTION 3. MANDATE – As an offshoot of institutionalizing the Barangay Tanods, there is hereby


a policy to institutionalize the Barangay Tanods and that their services be extended to other component
barangays to suppress criminality, lawlessness and reduce effects of natural and human induce disasters
as elaborated in this ordinance.

SECTION 4. OBJECTIVE – This Ordinance specifically aims to:

a.) Provide the people of Dumaguete City a greater sense of security through the institution of
Barangay Tanods as legitimate “force multipliers”. In unison with the role of the Philippine
National Police (PNP) and Military Personnel, devoted to the maintenance of peace and order
within the various puroks in the respective barangays, and as a whole, the entire City of
Dumaguete;

b.) Provide an enhanced grassroots level of awareness in matters of security and public safety;

c.) Provide an avenue for empowerment among the barangay constituents, particularly Barangay
Tanods in the common drive of promoting a responsive community against crimes, lawlessness
and disasters, hence, the title of this Ordinance; and

d.) Provide adequate welfare for Barangay Tanods in order for them to play an efficient and active
role in the Thirty (30) component barangays of Dumaguete City.

SECTION 5. DEFINITION OF TERMS – For purposes of this Ordinance, the following terms shall mean:
a.) Barangay – the basic political unit, which serves as the primary planning and implementing unit
of government policies, plans, programs, projects, and activities in the community, and as a
forum wherein the collective views of the people may be expressed, crystallized and considered,
and disputes may be amicably settled.

b.) Purok – refers to the community or households found in the barangays

c.) Barangay Tanod – refers to a brigade or body composed of civilian volunteers, duly created at the
barangay level, assisting the barangay officials in the exercise of its law enforcement function
specifically in maintaining peace and order and promotion of public order and safety in the
barangay.

d.) Barangay Tanod Member – refers to a civilian volunteer, duly appointed by the Punong Barangay
and as recommended by the barangay Peace and Order Council and concurred by the
Sangguniang Barangay, which shall be a number not more than twenty (20) in each barangay,
who composed the barangay Tanod.

SECTION 6. BARANGAY TANOD MEMBER/ APPOINTMENT/ TERM OF OFFICE/ REMOVAL AND


TERMINATION – A Barangay Tanod member shall be appointed by the Punong Barangay upon
recommendation of the Barangay Peace and Order Committee (BPOC), which may be renewed
unless earlier revoked by a valid cause by the law or order creating the Barangay Tanod. Renewal of
appointment shall require favorable recommendation of the BPOC.

SECTION 7. DUTIES AND RESPONSIBILITIES. – The Barangay Tanods of Dumaguete City must be
provided adequate continuing skills and knowledge enhancement trainings/seminars in order that
they can perform professionally and with the following expanded services to other component
barangays, viz:

a.) Implement peace and order related programs and projects at their respective barangays and to
other component barangays;

b.) Maintain close coordination with the barangay peace and order committee and city peace and
order council to harmonize actions and programs;

c.) Respond to the needs of other barangays of Dumaguete City to prevent crimes, lawlessness and
to reduce the effects of natural and human induces disasters;

d.) Prepare a report in prevailing peace and order situation in their area of responsibility to be
submitted to the Barangay peace and Order Committee (BPOC) which shall make a summary
thereof and thereafter, submit a report to the City Peace and Order Committee (CPOC);

e.) Conform the code of conduct of a government employee and shall be models as law abiding
public servants;

f.) Recommend measures for the continual improvement in the implementation of peace and order
programs, projects and activities;

g.) Perform such other functions as may be assigned by the Barangay Peace and Order Committee
(BPOC) and City Peace and Order Committee (CPOC);
SECTION 8. SUPERVISION/ MONITORING / EVALUATION – The Barangay Peace and Order
Committee shall have the authority to supervise their respective Barangay Tanod members during
the time of crisis and other activities. The BPOC shall continually monitor and evaluate the Barangay
Tanods and their respective activities and consequently submit reports to the CPOC on a regular
basis

SECTION 9. SOURCE OF FUNDS. – The barangay peace and order committee shall have the
authority to supervise their respective Barangay Tanod members during the time of crisis and other
activities. The BPOC shall continually monitor and evaluate Barangay Tanods ad their respective
activities and consequently submit reports to the CPOC on a regular basis.

SECTION 10. MONTHLY HONORARIUM – All duly-appointed members of the Barangay Tanods
shall be granted an honorarium from their respective barangays during their incumbency; and
additional honorarium in the amount of five hundred pesos (PHP500.00) per month from City of
Dumaguete;

SECTION 11. OTHER ALLOCATION OF FUNDS – An additional honorarium in the amount of five
hundred pesos (PHP500.00) per month from city

SECTION 12. REPEALING CLAUSE - All other ordinances, resolutions, memoranda, orders and
other issuances inconsistent with this ordinance are hereby repealed accordingly;

SECTION 13. SEPARABILITY CLAUSE – If for certain reasons some provisions of this ordinance are
found to be invalid or unconstitutional, all other provisions hereof not affected shall remain in full
force and effect.

SECTION 14. EFFECTIVITY CLAUSE – This ordinance shall take effect after fifteen (15) days
following the completion of its publication in any newspaper of general circulation within the City of
Dumaguete.

My concerns:

Section 1. The title: what do you want to institutionalize, the Barangay Tanods as the members or
the Barangay Tanod brigade which is the group?
Section 2. Is it the role of the BT to maintain peace and order and promote security in the
barangay? Isnt it too heavy for them? What about the PNP?
Section 3. Can you cite an instance whereby the BT refuses to render his services because the
incident happened outside his barangay? Example..gikawatan si Nancy pero wa nitabang si
Gatoy kay Daro na to hehehehe…
Section 4. Please review the objectives.
Section 6. How many years is the term of a BT that he can be renewed or terminated. Please cite.
Section 7. Number 1 duty of the BT…can he implement peace and order programs and projects?
What is his capacity to do so? Di ba ni trabaho sa kapitan? Hehehehe
Section 8. Supervision of BT by BPOC only during crisis and other activities? What about
during other days?

EXPLANATORY NOTE

Barangay Tanod brigades were organized to assist the government in the maintenance of peace and
order in the country. Pursuant to such duty, they conduct rondas or nightly patrols, necessarily
exposing their lives and limbs to danger in the hands of criminal elements and other wayward
members of society. In fact, an alarming number of Barangay Tanods have already been assaulted,
injured and/or killed, leaving their families and dependents to fend for themselves.

This bill seeks to grant hazard pay to all duly appointed members of the Barangay Tanod brigades
during their incumbency as such. It is in recognition of their active participation and constructive role
in the maintenance of peace and order. It will also serve as an incentive for a more faithful
performance and discharge of their duties and functions. It is the aim of this bill to give to the
Barangay Tanods what is due to them. In view of the foregoing considerations, the approval of this
bill is highly recommended. Senator ,

AN ACT GRANTING HAZARD PAY TO ALL DULY-APPOINTED BARANGAY TANOD BRIGADES DURING
THEIR INCUMBENCY, APPROPRIATING FUNDS THEREFOR
Be it enacted by the Senate and the House of Representatives of Congress assembled:

SECTION 1. All duly-appointed members of the Barangay Tanod brigades shall be granted a
hazard pay during their incumbency, in the amount of One Thousand Pesos (P1,OOO.OO) per month.

SEC. 2. The amount necessary for the effective implementation of this Act shall be charged to
the appropriations of the Department of Interior and Local Government (DILG) under the current
General Appropriations Act. Thereafter, such sum as may be necessary for its continued
implementation shall be included in the annual budget of the local government unit concerned.

SEC. 3. Nothing in this Act shall be construed as to diminish, in any manner, any benefit granted
by existing laws, rules and regulations, local ordinances and other issuances especially favorable to
Barangay Tanod brigade members.

SEC. 4. Within six (6) months from the approval of this Act, the DILG shall issue the necessary
rules and regulations for the effective implementation of this Act.

SEC. 5. All laws, decrees, executive orders, rules and regulations inconsistent with the provisions
of this Act are hereby repealed or modified accordingly.

SEC. 6. This Act shall take effect fifteen (15) days after its complete publication in the Official
Gazette or in at least two (2) newspapers of general circulation whichever comes earlier.
