BARANGAY TAX ORDINANCE NO.1079

(SERIES OF 2023)

AN ORDINANCE INCREASING THE REQUIRED PAYMENT OF FEES AND CHARGES ON

APPLICATIONS FOR BARANGAY CLEARANCES AND CERTIFICATIONS AND OTHER
DOCUMENTARY SERVICES RENDERED BY THE BARANGAY
EXPLANATORY NOTE
WHEREAS, the Brookside Barangay passed a Tax Ordinance No. 1078 series of 2017
and it has not been amended for the past years

WHEREAS, Republic Act No. 7160, known as the Local Government Code 1991,
empowers the smallest government unit, which is the Barangay, to have control over activities
within its jurisdiction, seeing to it that they are in consonance with public safety and morality.

WHEREAS, based on the Local Government Taxation, Section 152 – Scope of Taxing
Powers, so states that: The Barangay must levy taxes, fees, and charges as provided in this
Article which shall exclusively accrue to them

WHEREAS, The City Government of Baguio has recognized the role of the Barangay
as it requires the constituents to secure a Barangay clearance from the Barangay before
transacting with the City Government, National Government Agencies and instrumentalists,
and other personalities for such purposes as may be required of them

NOW, THEREFORE , on motion of Kagawad Jonathan N. Villena duly presented and

seconded by all present, be it.

“BE IT ORDAINED BY THE SANGGUNIANG BARANGAY IN SESSION ASSEMBLED

THAT

SECTION 1. TITLE:

This Ordinance shall be known as “ A TAX ORDINANCE AMENDING THE BROOKSIDE TAX
ORDINANCE NO 1078 SERIES SERIES OF 2017 STIPULATING THE AMOUNT TO BE
COLLECTED FOR CLEARANCE AND FEES TO BROOKSIDE BARANGAY

Section 3. Repealing Clause – All ordinances, rules and regulations or part thereof, that are
inconsistent or in conflict with the provisions of this Ordinance, are hereby repealed, amended or
modified accordingly.

Section 4. Separability Clause. If any part, section or provision of this Ordinance is held invalid or
inconsistent with laws or city ordinance, other provisions not affected thereby shall remain in force and
effect.

Section 5. Reflectivity Clause – This Barangay Ordinance shall take effect immediately
upon compliance of all the requirements provided by law
