CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF SERVICE made and executed this _____ day of ____________,
2017 in the province of Agusan del Sur, by and between:

THE PROVINCIAL GOVERNMENT OF AGUSAN DEL SUR, a public corporation duly

organized and existing under the laws of the Republic of the Philippines with the principal office
at Governor Democrito O. Plaza Government Center, Prosperidad, Agusan del Sur, represented
herein by the HON. ADOLPH EDWARD G. PLAZA, Provincial Governor, duly authorized by the
Sanguniang Panlalawigan as per its Resulotion No. ______, Series of 2016, hereinafter referred
to as the FIRST PARTY.

EDISON P. DAIGDIGAN, of legal age, Filipino, and a resident of Block 4, Lot 10,
Camella Cerritos, Tugbok, Mintal, Davao City, Philippines, hereinafter referred to as the
SECOND PARTY.

WITNESSETH:

WHEREAS, the FIRST PARTY, by virtue of the powers granted it by law, desires to
engage the services of the Licensed Architect for Architectural Design and Construction
Supervision and Management Services for various vertical infrastructure projects of the
SECOND PARTY.

WHEREAS, the SECOND PARTY meets the qualification set forth by the FIRST
PARTY;

WHEREFORE, for and in consideration of the above premises, the FIRST PARTY
hereby enters into a contract of service with the SECOND PARTY subjected to the following
conditions:

1. The terms of this contract commence on July 1, 2017 to December 31, 2017;
2. The FIRST PARTY shall pay the SECOND PARTY a monthly compensation of THIRTY
THOUSAND PESOS (Php 30,000.00) for the Architectural Design services and project
Management and Supervision.
3. The SECOND PARTY shall be under the direct supervision of the Provincial Governor;
4. The SECOND PARTY shall perform the activities and functions of the following project
phases of all vertical infrastructure projects:

A. Architectural Phase
B. Design Development Phase
C. Project Management and Supervision Phase
D. Post Construction Services

5. The SECOND PARTY shall perform work at a time schedule agreed upon by both
parties;
6. The SECOND PARTY shall travel to areas/sites for projects;
7. The SECOND PARTY will undertake any and all jobs required of him by the Provincial
Engineer in accordance with the law;
8. The SECOND PARTY, subject to the discretion of the Provincial Governor, to perform
other functions related to his main work deemed necessary and appropriate to the
purposes for which the contract of service was entered into;
9. This contract does not create an employer-employee relationship between the FIRST
PARTY and the SECOND PARTY; and
10. That the services rendered hereunder are not considered and will not be accredited as
government services; and the latter is not entitled to benefits enjoyed by a regular
personnel of the FIRST PARTY.

IN WITNESS WHEREOF, the parties have hereunto affixed their signatures this _____

Proosperidad, Agusan del Sur.
