AFFIDAVIT OF WITNESS

I, NESTOR B ANDRES, 30 years old, married, barangay kagawad and presently

residing at San antonio ,ormoc City after having been duly sworn to in accordance with
the law, do hereby deposes and state:

That on December 30, 2019 at about 10:30 in the evening while conducted my
duty on our Barangay Hall I saw the victim ANTONIO P, LINA together with the suspect
MARIO SANTIAGO living with the conversation ultered these words to quote against the
former PAPATAYIN KITA WALANG YAKA!.

Thereat I saw the victim shot by the said suspect and sustained gun shot wound
on his head and was rushed to Ormoc Doctors Hospital but pronounced dead on arrival
by Dr. Tomas Nicolas III attending physician.

That I executed this affidavit/statement to attest the veracity of aforementioned

facts and to support file charge/s in court against the suspect.
