CONSTITUTION AND BY-LAWS

Preamble

We, the Better Educators Students Today (BEST), members and officers of the Mindoro State
College of Agriculture and Technology – Bongabong Campus, imploring the aid of Divine
Providence, in order to promote better understanding and aspiration, secure an atmosphere
through which we can pursue academic excellence, virtue of being vibrant, forward looking,
equitable and responsible under the existing law of this institution, do ordain and promulgate this
Constitution and By-laws.

ARTICLE I

NAME, OFFICE AND TERMS

Section 1 The name of the organization shall be called Better Educators for Students Today,
herein referred to as (BEST).

Section 2 The BEST shall have its own office and it shall be within the MinSCAT –
Bongabong Campus

Section 3 The BEST shall promote interaction between all members of College of Teacher
Education through education-related events and other institutional activities.

Section 4 The Official Logo of the BEST was drawn below, it shall serve as the insignia of
the said organization

ARTICLE II

AIMS AND OBJECTIVES

Section 1 To promote the general welfare of Education Department students by finding their
needs through regular forum.

Section 2 To protect the interest of the members by upholding the democratic rights of the
students to organize themselves, to exercise freedom, and due process provided
that they are in accordance with the existing law.

Section 3 To participate in governance of the institution through BEST organization in the


policies that directly affects them.

Section 4 To provide channel and an outlet for the development of the student skills and
talent through extra-curricular activities.

Section 5 To carry out meaningful project that will benefit BEST organization members and
MinSCAT-Bongabong Campus students as well.
ARTICLE III

FUNCTIONS OF THE ORGANIZATION

Section 1 Formulate and implement policies and general action of the program as may be
necessary for the pursued realizations of the aims and objectives in accordance
with this constitution and by-laws.

Section 2 Initiate and implement programs designed for enhancing the social, political, and
cultural, intellectual, moral and spiritual development of its members.

Section 3 Discuss and decide vital issues affecting the organization.

Section 4 Perform or do such other deeds as may be necessary for the attainment of the
goals and objectives of the organization.

ARTICLE IV

MEMBERSHIP

Section 1 The qualified members of BEST organization shall be those officially enrolled in
Bachelor of Secondary Education and Bachelor of Elementary Education
(Education Department) of MinSCAT-Bongabong Campus regardless of major
and specialization.

Section 2 The membership shall be effective only as long as the student is officially
enrolled.

Section 3 The membership shall be lost temporarily in the case of the student’s suspension.

Section 4 The right to vote qualified for a position, to be voted upon.

ARTICLE V

DISCIPLINARY ACTION FOR MEMBERS

Section 1 Any member or officer who violates this Constitution and By-laws shall be
subjected to disciplinary action.

Section 1a Any member or officer who fails to attend activities without


justifiable reason shall pay fines.

Fines:

Officer: Php 50.00

Member: Php 20.00


ARTICLE VI

OFFICERS AND QUALIFICATIONS

Section 1 The BEST shall compose of President, Vice-President, Secretary, Treasurer,


Auditor, and seven (7 ) committees namely; Press and Advertisement, Ways and
Means, Finance and Production, Civic/Peace and Order, Socio-Cultural, Sports,
External and Internal Affairs, and GAD coordinator to be elected by the BEST
organization.

Section 2 All officers of the Organization shall have a general weighted average not less
than 2.25 in the previous semester without failing grades except the First Year
students.

ARTICLE VII

OFFICERS, DUTIES AND RESPONSIBILITIES

Section 1 The President shall be the chief Executive Officer of the Organization. It shall be
his or her duty to:
a. Preside the meeting of the Organization.
b. Sign all communication, resolution and papers of the Organization.
c. Create other committees and appoints the chairman and members thereof.
d. Represent the council in and out of the campus activities, in all occasions, and
every events where the organization needs such representations.
e. Perform all duties as may be necessary an incidental to the discharge and
performance of the functions of his office with diligence and responsibilities.
f. Appoint the Vice-President to act as Chairperson in time of his absence.

Section 2 It shall be the duty of the Vice President to:


a. Take function over the duties of the President whenever that office is vacant
by reasons of absence, resignation, impeachment, death and physical and
mental disabilities.
b. Assist the president in all matters where his assistance is required.
c. Performs such other duty as the President may assign to him.

Section 3 It shall be the duty of the Secretary to:


a. Record and keep the minutes of the meetings and all the proceedings of the
Organization.
b. Prepare and keep all the records, papers, correspondents and statements of the
council.
c. Keep all the members of the Organization informed of all meetings and
activities of the organization.
d. Performs such other duty as the President may assign to him.

Section 4 It shall be the duty of the Treasurer to:


a. Collect and keep the funds of the organization.
b. Sign the budgeting in accordance with the approval of the organization.
c. Make and present the financial statement of the Organization.
d. Be the property custodian of the Organization
e. Performs such other duty as the President may assign to him.

Section 5 It shall be the duty of the Auditor to:


a. Audit the funds of the Organization and promulgate accounting and auditing
rules and regulation consistent with the school policy.
b. Monitor the financial transaction of the organization.
c. Take charge on the duties of Chairman of the Ways and Means Committee as
additional job for him/her.
d. Performs such other duty as the council President may assign to him.

Section 6 It shall be the duties of the Chairman of the Ways and Means Committee to:
a. Plan and supervise all business transaction and fundraising of the
Organization.
b. Take charge of all the properties and supply of the organization and
inventories thereof.
c. Performs such other duty as the council President may assign to him.

Section 7 It shall be the duty of the Chairman of the Press and Advertisement Committee:
a. Submit/follow-up and process the communication of the Organization within
and out of the said campus.
b. Update and moderate the contents of the official web page of the
Organization.
c. Make press release about BEST activities.
d. Act as the spokesperson of the organization.
e. Perform such other function as may be assigned from time to time.

Section 8 It shall be the duties of the Chairman of the Finance and Production Committee
to:
a. Spearhead ideas for IGPs at school
b. Coordinate all efforts to promote IGP of the Organization
c. Facilitate booklet production and sales
d. Perform such other function as may be assigned from time to time.

Section 9 It shall be the duties of the Chairman of the Civic/Peace and Order Committee to:
a. Coordinate with all efforts to promote community service activity of the
school.
b. Monitor students’ community service.
c. Monitor the beautification and cleanliness/sanitation of the school.
d. Help in maintenance of peace and order in every meeting and of the campus.
e. Take place the duties of the Liaison Officers in terms of his/her absence.
f. Perform such other function as may be assigned from time to time.

Section 10 It shall be the duties of the Chairman of the Socio-Cultural Committee to:
a. Coordinate all effort to promote culture emphasis of Filipino heritage in the
school.
b. Spearhead the socio-cultural activities in the school.
c. Perform such other function as may be assigned from time to time.

Section 11 It shall be the duties of the Chairman of the Sports Committee to:
a. Coordinate with all efforts to promote sports activities in the school.
b. Spearhead the sports campaign activities in the school.
c. Perform such other function as may be assigned from time to time.

Section 12 It shall be the duties of Chairman of the Committee of External and Internal
Affairs to:
a. Head the Committee on students’ organizations.
b. Evaluates students’ Organization Activities, Programs and Projects and their
Objectives.
c. Form Committee to help different organization achieve their set objectives.
d. Perform such other function as may be assigned from time to time.

Section 13 It shall be the duties of GAD Coordinator to:


a. Coordinate with all efforts to promote Gender and Development activities of
the school and Organization.
b. Perform such other duty as the President may assign to him.

ARTICLE VIII

ELECTION

Section 1 The election of the Organization shall be conducted during General Election Day.

Section 2 The manners of voting shall be done in simplest form by raising hands of the
recognized member.

Section 3 The positions or designation to be filled for officers are as follows: President,
Vice–President, Secretary, Treasurer, Auditor, Committee on External/ Internal
affairs, Committee on Sports, Committee on Socio – Cultural, Committee on
Civic Peace and Order, Committee on Finance and Production, Committee on
Press and Advertisement, Committee on Ways and Means, and Student GAD
Coordinator.

Section 4 The position for president, vice–president, secretary, and treasurer will be allowed
only for old students and not for the freshmen and transferees.

Section 5 The adviser of the Organization shall administer the election and act as a
chairperson.

ARTICLE IX

TENURE OF OFFICE

Section 1 All the officers of the Organization shall hold an office for one year subject to one
re-election.

ARTICLE X

ADVISER, QUALIFICATION AND DUTIES

Section 1 The adviser must be a College Instructor/Professor and must have been with the
institution for at least three (3) years as College Instructor/Professor.

Section 2 The Adviser of the organization shall be appointed by the Administration two (2)
weeks preceding the election of the Organization officers.

Section 3 The following are the duties of Adviser:


a. Must see to it that the purpose of the Organization is not against the existing
rules and regulations of the College
b. Must confer with the officers of the Organization from time to time and act as
mediator between education students and Administration
c. Must act as moderator in every meeting of the Organization officers/members.
d. Must guide the student in achieving the optimum goal of the organization.
ARTICLE XI

MEETING AND QUOROM

Section 1 There shall be regular meeting to be called by the President every first
Monday of the month to find out the needs of the Organization and discuss
with them the things needed to attain the objectives of the Organization.
Section 2 In case of urgent matters that need in immediate decision of the members,
a special meeting may be called by the President with at least 50% of the
regular members present.
Section 3 The required attendance to constitute a quorum for the regular meeting
shall be 50% + 1 of all the members of the organization.
Section 4 Any officer who incurred absences shall pay fines worth P25.00 per
meeting and additional one notebook, one pencil or a book to be donated
during outreach program of the Organization.

ARTICLE XII

FINANCE

Section 1 No membership fee shall be collected from any bona fide students of Mindoro
State College of Agriculture and Technology. This is pursuant to the Rules and
Regulations of Republic Act 10931, known as the “Universal Access to Quality
Tertiary Education Act of 2017”, however;

Section 2 The organization has the power to impose contributions if and only if the body
and the members ratified upon the agreement supported by their signatures.

Section 3 Excess funds in the semester shall be added to the revolving funds of the
Organization.

Section 4 Excess funds shall be deposited at the office of the Director for Student Welfare
Services at the end of school semester.

Section 5 The fund shall be withdrawn upon the request of the Organization with Treasurer
and Adviser signatories.

ARTICLE XIII

IMPEACHMENT

Section 1 Any officer of the organization who is proven guilty of the act of negligence of
his duty shall be subjected to impeachment.

Section 2 Any officer of the Organization may initiate a move to convene hearing for the
purpose of impeachment.
Section 3 Ninety percent (90%) of the total population of the members is needed to approve
any recommendation for impeachment.

Section 4 Any officer recommended for impeachment shall be granted a fair hearing to
defend himself.

ARTICLE XIV

TRANSPOSITORY PROVISION

Section 1 All incumbent officers shall continue to hold office until such that the newly
elected officers shall have qualified and assumed office in accordance with this
constitution and by-laws.

ARTICLE XV

AMENDMENTS

Section 1 Amendments or revisions of the constitution shall be proposed by the officers of


the organization.

ARTICLE XVI

EFFECTIVITY

This constitution and by-laws shall take effect after it has been submitted to the Campus
Administrator for final approval.
