A RESOLUTION APPROVING THE ANNUAL INVESTMENT PLAN OF THE
MUNICIPALITY
WHEREAS, Section 354 of Republic Act No. 7160 provides that the Secretary of Budget and
Management and the Chairman of the Commission on Audit (COA) shall jointly promulgate a Budget
Operations Manual for local government units to improve and systematize methods, techniques, and
procedures employed in budget preparation, authorization, execution and accountability;
WHEREAS, Article 410 of the Implementing Guidelines of RA 7160 provides that the Local
Development Council shall submit to the local finance committee a copy of the local development plan
and annual investment program prepared and approved during the fiscal year in accordance with
applicable laws, specifying therein the projects proposed for inclusion in the local government budget;
WHEREAS, the Annual Investment Plan has already been reviewed at the Sangguniang Bayan
and found to have complied with the substantial requirements set forth by law;
NOW THEREFORE, on unanimous motion presented, be it:
RESOLVED, as it is hereby resolved, to approve the 2011 Annual Investment Plan.
RESOLVED FURTHER, to furnish copy of this resolution all agencies concerned for their
information and guidance.

A RESOLUTION RESPECTFULLY REQUESTING THE CHAIRMAN OF THE PHILIPPINE
CHARITY SWEEPSTAKES OFFICE TO PROVIDE FUNDS FOR THE PURCHASE OF ANTI-
RABIES VACCINES FOR THIS MUNICIPALITY
WHEREAS, one of the priority programs of this local government unit (LGU) is the purchase of
anti-rabies vaccines to be distributed to victims of dog bites;
WHEREAS, due to the scarcity of funds or limited financial resources of this LGU, the said
program has not yet been realized;
WHEREAS, due to the said predicament, it has been the consensus of the members of this August
Body to seek assistance from national government agencies, particularly the Honorable Chairman of the
Philippine Charity Sweepstakes Office (PCSO);
NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., Chairman, Committee on Rules,
Privileges and Legal Matters, unanimously seconded, be it:

RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR AND THE ACTING
MUNICIPAL TREASURER AS THE OFFICIAL SIGNATORIES FOR AND ON BEHALF OF
THE PURA MUNICIPAL GOVERNMENT IN ALL BUSINESS TRANSACTIONS WITH THE
LAND BANK OF THE PHILIPPINES, PHILIPPINE NATIONAL BANK AND
DEVELOPMENT BANK OF THE PHILIPPINES
WHEREAS, Section 444, par. (b) (1) (vi), of Republic Act No. 7160, otherwise known as the
“Local Government Code of 1991,” provides that for efficient, effective and economical governance the
purpose of which is the general welfare of the municipality and its inhabitants pursuant to Section 16 of
this Code, the municipal mayor shall upon authorization by the Sangguniang Bayan, represent the
municipality in all its business transactions and sign on its behalf all bonds, contracts, and obligations,
and such other documents made pursuant to law or ordinance;
WHEREAS, pursuant to Section 470, par. ( d ) ( 2), of the said Code also provides that the
treasurer shall take charge of the treasury office, perform the duties provided for under Book II of the
Code, and shall take custody and exercise proper management of the funds of the local government unit
concerned;
WHEREAS, in view of the foregoing, there is a necessity to authorize the Municipal Mayor,
Hon. CONCEPCION A ZARATE, and Acting Municipal Treasurer, MRS. VIOLETA V. SUPAN,
as the official signatories of all business transactions of this local government unit with the Land Bank
of the Philippines, Philippine National Bank and Development Bank of the Philippines;

A RESOLUTION AUTHORIZING THE MUNICIPAL VICE MAYOR AND THE ACTING
MUNICIPAL TREASURER AS THE OFFICIAL SIGNATORIES FOR AND ON BEHALF OF THIS
SANGGUNIANG BAYAN IN ALL BUSINESS TRANSACTIONS WITH THE LAND BANK OF THE

Presiding Officer of the Sangguniang Bayan and sign all warrants drawn on the Municipal Treasury for all
expenditures appropriated for the operation of the Sangguniang Bayan;
WHEREAS, in consonance to the above provision, this body passed a Resolution Authorizing the
Transfer of the Administration of Funds for the Sangguniang Bayan from the Executive Department to the
Municipal Vice Mayor on July 15, 2010;
RESOLVED, as it is hereby resolved, to authorize the Municipal Vice Mayor, Hon. MANUEL I.

WHEREAS, Section 176 of Commission on Audit Circular No. 91-386 allows the

WHEREAS, the Local Chief Executive has endorsed the request of the OIC-Municipal
Treasurer seeking for the adoption of a resolution authorizing the establishment of petty cash for the
Local Government Unit;
WHEREAS, this body, after careful evaluation, had found out the request to be of merit;

RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE TO ENTER INTO A
RICE LOAN AGREEMENT (MOA) WITH THE NATIONAL FOOD AUTHORITY (NFA)
WHEREAS, the National Food Authority (NFA) is the government agency charged with, among
others, ensuring the nation with adequate supply and distribution of grains;
WHEREAS, pursuant to the provisions of the Local Government Code of 1991, local
government units have been vested the authority to discharge the functions and responsibilities of national
agencies and offices devolved to them;
WHEREAS, the local government units are authorized to set aside five percent (5%) of the
twenty percent (20%) of their estimated revenue from regular sources as an annual lump sum
appropriation for Calamity Fund and Special Development Fund, respectively;
WHEREAS, the local government units have been tasked with providing basic social services at
all times, particularly in times of calamities;
WHEREAS, in order to provide basic social services to the populace, the Pura Municipal
Government had requested the NFA to allow them to purchase rice on credit for the following purposes:
(1) for relief operations whenever a state of calamity is declared in their locality; and (2) for stockpiling
purposes in preparation for any eventuality/emergency that may occur at any given time;
NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., unanimously seconded, be it:

WHEREAS, after proper negotiations, the property owner, Mr. Luis Caratiquit, expressed his
willingness to sell his property to the Barangay Government in the amount of TWO HUNDRED FIFTY
THOUSAND PESOS (P250,000,00);
WHEREAS, the sale of the above-described property can only be consummated upon approval of
the Provincial Appraisal Committee;
RESOLVED, as it is hereby resolved, to endorse the intention of the Poblacion 2 Barangay Council
to purchase from Mr. Luis Caratiquit his residential lot, including the house and all the improvements

A RESOLUTION EXTENDING THE TIME OF PAYMENT OF TAXES OF MARKET VENDORS IN
ACCORDANCE WITH CHAPTER II, ARTICLE B, OF THE REVISED TAX CODE OF THE
WHEREAS, the Municipal Tax Code provides that failure to pay the tax prescribed within the time
required shall subject tax payer to a surcharge of Twenty Five Percent (25%) of the original amount of Tax
due;
WHEREAS, Section 2B.05 of Chapter II, Article B of the Revised Tax Code of the Municipality
provides that the sangguniang bayan, through a resolution may extend the time of payment of Business Tax
without penalty or surcharge for a justifiable reason or cause provided that the period of extension shall not
exceed six (6) months;
WHEREAS, the Market Vendors Association have requested for an extension of the time of payment
of their business taxes through a letter dated January 14, 2011;
WHEREAS, upon recommendation of the Committee on Ways and Means the body agreed to extend
the time of payment up to February 28, 2011.

A RESOLUTION ALLOWING THE DEMOLITION ON THE EXISTING PUBLIC
MARKET TO PAVE THE WAY FOR THE CONSTRUCTION OF A NEW ONE
WHEREAS, the Honorable Enrique M. Cojuangco, Congressman of the First District of Tarlac,
provided us the amount of P15,000.000 for the construction of a new and modern public market;
WHEREAS, the Commission on Audit, upon the request by this Local Government Unit, had
given the go-signal for this undertaking based on their report dated February 11, 2011;
WHEREAS, after a thorough investigation and upon the recommendation of the SB Committee
on Public Utilities, Facilities, Market and Slaughterhouse, the request of the Local Chief Executive was
found to be in order;

A RESOLUTION DESIGNATING THE PURA COVERED COURT AS THE
TEMPORARY RELOCATION SITE FOR THE STALL OWNERS OF THE PUBLIC MARKET
WHEREAS, it has been decided by the Executive Department that the temporary relocation site
for the stall-owners of the Pura Public Market will be the Pura Municipal Covered Court;
WHEREAS, pursuant to Section 11, par. (c), of Republic Act No. 7160, local government offices
and facilities shall not be transferred, relocated or converted to other uses unless public hearings are first

WHEREAS, in addition to the powers granted to each local government unit to levy taxes,
Section 18 of the local government code, in consonance with the Constitution, also granted powers to
Local Government Unit (LGU) to create their own sources of revenue in the exercise and furtherance of
its governmental and proprietary powers and functions;
WHEREAS, the municipality acquired Farm Tractors and Multi-purpose thresher in order to
enhance production of the agricultural sector;
WHEREAS, in the exercise of the revenue raising measure, the Municipality, hereby fixes the
fees for the use of the above equipment;
NOW THEREFORE, the Sangguniang Bayan of Pura in session assembled do hereby enact the
following:

“AN ORDINANCE AMENDING THE PRESCRIBED FEE FOR THE USE OF FARM TRACTOR AND MULTI-
PURPOSE THRESHER”
Section 1. TITLE. This ordinance shall be known as the “Ordinance Amending the Prescribed
Fee for the use of Farm Tractor and Multi-Purpose Thresher”
Section 2. DEFINITION OF TERMS. When used in this ordinance, the following shall mean:
a. Gross Output – The total production extracted from the shelled or unshelled corn
expressed in terms of kilos.

b. Shelled Corn – Corn ear without husk

c. Unshelled Corn – Corn ear covered with husk
Section 3. SCOPE – this ordinance shall govern the imposition fee for the operation of the Farm
Tractors and Multi-Purpose Thresher.
Section 4. IMPOSITION OF FEE. There shall be a fee imposed for the use of the Farm Tractor
and Multi-Purpose Thresher prescribed hereunder.
a. Thresher fee – 6% of the gross output
b. Sheller fee – P 15.00/cavan (50 kilos) for shelled corn

P 20.00/cavan for unshelled corn
c. Tractor Services Fee. The amount to be collected shall be ONE THOUSAND PESOS
(P1,000.00) per pass/hectare.
Section 5. TIME OF PAYMENT. The fee imposed in this ordinance shall be paid to the
Municipal Treasurer after completion of work duly authorized by the LGU.
Section 6. ADMINISTRATIVE PROVISIONS. The Office of the Municipal Mayor or the duly
authorized representative shall implement the provisions of this ordinance and, shall promulgate the
necessary guidelines for the operations thereto.
Section 7. APPLICABILITY CLAUSE. All other matters relating to operation of the Farm
Tractor and Multi-Purpose Thresher shall be governed by other existing rules and regulations.
Section 8. EFFECTIVITY. This ordinance shall take effect upon approval.

SUPPLY TO BARANGAY MAUNGIB
WHEREAS, the Sangguniang Barangay of Maungib, thru its Resolution No. 1, Series of 2011,
requested the Sangguniang Bayan to grant permission to the Ramos Water District to extend their services
to the said barangay;
WHEREAS, as provided for by law, the Local Government Unit in the exercise of its proprietary
function may enter into a contract with private or corporate entity for the provision of basic services to the
inhabitants;
WHEREAS, Section 22, Chapter 2, Title 1, of Republic Act No. 7160 provides that unless
otherwise provided in this code, no contract may be entered into by the local chief executive in behalf of
the local government unit without prior authorization from the Sanggunian concerned;
WHEREAS, Section 444, par. (b) (vi), of Republic Act No 7160 provides that for efficient,
effective and economical governance the purpose of which is the general welfare of the municipality and
its inhabitants pursuant to Section 16 of this Code, the Municipal Mayor shall, upon authorization by the
sangguniang bayan, represent the Municipality in all its transactions and sign on its behalf all bonds,
contracts, and obligations, and such other documents made pursuant to law or ordinance;

CREEK
WHEREAS, one of the perennial problems of this local government unit (LGU) is flooding during the
rainy season brought about by the heavy siltation and destruction of natural waterways, especially the
Susubaen Creek, situated in Barangays Buenavista, Maasin, Cadanglaan and Maungib, this Municipality;
WHEREAS, the said problem had caused destruction and erosion of nearby lands rendering the same
unproductive;
WHEREAS, in order to minimize if not totally eradicate the said problem, there is an urgent need for
the desiltation and restoration of the said natural waterways, including the provision of protective earth dikes
along the waterways;
WHEREAS, the restoration of the said waterways will not only control floods, but likewise render the
nearby lands to be productive again and provide livelihood opportunities to the affected residents;
RESOLVED, as it is hereby resolved to allow the desiltation and restoration of natural waterways in
this locality, particularly the Susubaen Creek.

role of this road in facilitating the economic and productive endeavors, but is aware of the financial
capability of the Municipalities of Sta. Ignacia, Gerona and Pura to undertake the function of its proper
maintenance and/or continuous improvement, dependent as it is on locally-generated funds, has filed a
bill seeking the conversion of this local road network into a national road;
WHEREAS, this bill has been approved in the House of Representatives and is now with the
Senate Committee on Public Works;
RESOLVED, as it is hereby resolved, that this Sanggunian strongly and favorably endorses the
approval of the aforementioned measure by the Senate Committee on Public Works;

WHEREAS, in fulfillment of the mandates of section 447 (a)(3)(vi) and Section 458 (a)(3)(vi)
of the Local Government Code of 1991, municipal and city government authorities have granted, and
continue to grant, franchises relative to the operation of tricycles within their jurisdiction;
WHEREAS, it is an acknowledged fact that the public transport sector is one among those most
vulnerable to the economic aftermath of oil price increases;
WHEREAS, in keeping with the principle of compassionate government, the Office of the
President issued Executive Order No. 32, s. 2011, creating the Public Transport Assistance Program as an
urgent intervention aimed at cushioning the impact of high fuel prices on the marginalized sectors of
society;
WHEREAS, in the language of the said Order, in the case of the tricycles, the PTAP shall also
subsidize a portion of their average fuel consumption;
WHEREAS, pursuant to the above-mentioned Executive Order, and its Implementing Rules
and Regulations, the Department of Interior and Local Government, in consideration of its mandate and
organizational reach, is tasked to coordinate with the municipal and city governments in the
implementation of the PTAP;

WHEREAS, it is a declared policy of the State to protect the rights of the children, including
proper care and nutrition and to provide them with special protection against all forms of neglect, abuse,
cruelty, and exploitation, and other conditions prejudicial to their development. Towards this end, there is
hereby established a day care center in every barangay with a total development and protection of
children program as provided for under Republic Act No. 6972;
WHEREAS, Section 4 of R.A. No. 6972 mandates the barangay to implement the provisions of
said law and empowers the barangay to call upon private volunteers, who are responsible members of the
community, and utilize them in assisting the care of children and provide consultative services for their
medical, educational and other needs;
WHEREAS, the pertinent provisions of R.A. No. 6972 and R.A. No. 7160 explicitly states that
the barangay day care workers are within the domain of the barangay;
WHEREAS, the reshuffle of the Day Care Workers as effected by the Municipal Social Welfare
and Development Office has no legal basis and an encroachment to the powers and functions of the
barangay, as provided for by law;
RESOLVED, as it is hereby resolved, to enjoin the concerned officials of the Local Government
Unit to forego the reshuffle of Day Care Workers until the pertinent legal frameworks has been

“recognizing the youth’s vital role in nation-building, the State shall promote civic consciousness among
the youth and shall develop their physical, moral, spiritual, intellectual and social well-being. It shall
inculcate in the youth patriotism, nationalism, and advance their involvement in public and civic affairs;”
WHEREAS, Section 3, paragraph d thereof, defines Civic Welfare Training Service as referring
to programs or activities contributory to the general welfare and the betterment of life for the members of
the community or the enhancement of its facilities, especially those devoted to improving health,
education, environmental, entrepreneurship, safety, recreation and morals of the citizenry;
WHEREAS, Section 2, paragraphs 4 and 9, of Article II of the 2001 Katipunan ng Kabataan and
Sangguniang Kabataan Constitution and By-Laws declares the objective of Sangguniang Kabataan as to
formulate, implement and coordinate activities, projects and programs particularly those that are
beneficial to the members of the Katipunan and/or the general welfare of the people and to initiate and
support programs that are designed to enhance the social, political, economic, cultural, intellectual, moral,
spiritual and physical development of the youth;
WHEREAS, apparently, the principles and objectives of NSTP and Sangguniang Kabataan

WHEREAS, it is a constitutional mandate for the state to adopt an integrated and comprehensive
approach to health development which shall endeavor to make essential goods, health and social services
available to all people at affordable cost;
WHEREAS, consistent with the vision and objective of the state, the Municipal Government had
adopted several health programs including the establishment of a Maternity Lying-In/Birthing station;
WHEREAS, in order to ensure the smooth and efficient operation of the birthing station, there is a
need to adopt an ordinance regulating and imposing fees for its operation;
Now therefore, be it ordained by the Sangguniang Bayan in session duly assembled:
MUNICIPAL ORDINANCE NO. 004
AN ORDINANCE REGULATING AND IMPOSING FEES FOR THE USE OF THE

MATERNITY LYING-IN (BIRTHING STATION) OF THE MUNICIPALITY OF PURA
Section I. TITLE. This ordinance shall be known as “AN ORDINANCE REGULATING AND
IMPOSING FEES FOR THE USE OF MATERNITY LYING-IN (BIRTHING STATION) OF THE
MUNICIPALITY OF PURA.”
0 Section 2. Scope of Application. This ordinance shall govern the use of the Maternity Lying-In
in the Municipality of Pura.
Section 3. Imposition of Fee – There is hereby a fee imposed for the use of the Birthing Station in
the manner prescribed herein, to wit:

a. For eligible Philhealth members – No fee shall be charged
b. For Non-Philhealth members

who are residents of Pura – P 1,000.00
c. For Non-residents of Pura -- P 2,000.00
Section 4. Time of Payment. The fee imposed herein shall be paid to the Municipal Treasurer
before discharge of the patient.
Section 5. Administrative Provision. The Rural Health Unit/Municipal Treasurer shall keep a
registry of persons who have availed of the services of the Birthing Station and shall submit a monthly
report to the Office of the Mayor not later than ten (10) working days after the end of each month.
The Rural Health Unit shall be responsible for the accreditation of the birthing station with the
Philippine Health Insurance Corporation and shall, likewise, submit list of Philhealth members who have
availed of the services of the said Birthing Station to the Office of the Mayor not later than ten (10)
working days after the end of each month.
The Local Chief Executive shall issue the necessary implementing guidelines for the smooth
implementation of this ordinance.
Section 6. Repealing Clause. All ordinances, rules and regulations or parts thereof in conflict with
or inconsistent with any provision of this ordinance are hereby repealed or modified accordingly.
Section 7. Penalty. Any violation of the provisions of this ordinance shall be punished by a fine of
not less than One Thousand Pesos (P 1,000.00) or imprisonment of not less than one (1) month but not
more than six (6) months or both at the discretion of the court.
Section 8. Effectivity. This ordinance shall take effect upon approval.

A RESOLUTION REQUESTING ASSISTANCE FROM THE OFFICE OF THE REGIONAL
DIRECTOR, DEPARTMENT OF AGRICULTURE-REGIONAL FIEL UNIT NO. III FOR THE
ACQUISITION OF THREE (3) HAND TRACTORS FOR THIS LGU
WHEREAS, this local government unit (LGU) realizes that having control over all aspects of the
palay and rice industry is the only way to attain its dream of a genuine agricultural development;
WHEREAS, to improve its productivity and save post harvest losses, there is a need to acquire
basic production and post-harvest facilities, such as hand tractors;
WHEREAS, this LGU has a total of Eight Hundred Eighty Nine and 75/100 (889.75) hectares of
irrigated and One Thousand One Hundred Sixty Eight and 85/100 (1,168.85) hectares of non-irrigated
rice land, which is more or than or equal to the minimum required area of Two Thousand Fifty Eight and
60/100 (2,058.60) hectares to avail of the assistance package from the Department of Agriculture;
WHEREAS, this LGU has an average palay yield of Four (4.0) metric tons per hectare per year;
WHEREAS, this LGU has 1,767 farmers that will directly benefit with the said facilities and has
access to the services of expert personnel to manage and operate the same;
WHEREAS, this LGU has an available warehouse/shed located in Brgy. Matindeg, which can be
legally used as the official garage of such facilities, especially when not in use;
NOW THEREFORE, on motion Coun. Felino C. Millo Jr., unanimously seconded, be it:
RESOLVED, as it is hereby resolved, to request assistance from the Office of the Regional
Director, Department of Agriculture-Regional Field Unit No. III for the acquisition of three (3) hand
tractors for this LGU;

WHEREAS, the Department of Agriculture-Regional Field Unit No. III (DA-RFU No. III)
supports and undertakes activities to assist and promote the development of the agriculture and fishery
post harvest industries in the countryside;
WHEREAS, the DA-RFU No. III is the primary agency of the DA in the region and has the
administrative and technical capability to effectively implement the “On-Farm Mechanization Program:
Provision of Farm Mechanization Facilities and Equipment to Farmer Associations”;
WHEREAS, the PHilMech, through its DA Rice-Mechanization component, provides

mechanization infrastructures and facilities to enable small farmers improve their productivity through
appropriate and efficient mechanization technologies;
WHEREAS, this LGU is among the agriculture sector of the industry which is most in need of
and qualified to receive the mechanization facilities;
WHEREAS, this LGU is willing to collaborate in the implementation of the program as

beneficiary/cooperator;
WHEREAS, Section 22, Chapter 2, Title 1, of Republic Act No. 7160 provides that unless

WHEREAS, Section 445 (1) of the Code grants the Municipal Vice Mayor the power to be the
Presiding Officer of the Sangguniang Bayan and sign all warrants drawn on the Municipal Treasury for
all expenditures appropriated for the operation of the sangguniang bayan;
WHEREAS, in consonance with the above-cited provision, this sangguniang bayan adopted
Resolution No. 15, Series of 2009, and Resolution No. 08, Series of 2010, directing the Transfer of the
Administration of Funds for all expenditures appropriated for the operation of the sangguniang bayan;
WHEREAS, despite the two Resolutions, the Transfer of the Administration of Funds had not
been effected;
WHEREAS, this august body in session assembled agreed to seek the assistance of the
Ombudsman to effect the transfer of the administration of funds for the Sangguniang Bayan from the
Local chief Executive to the Municipal Vice Mayor;
RESOLVED, as it is hereby resolved to seek the assistance of the Office of the Ombudsman to

FOR THE PERFORMANCE CHALLENGE FUND SUBSIDY AND ALLOCATING A
COUNTERPART FUND THEREFOR
WHEREAS, the Department of the Interior and Local Government (DILG), through the Bureau
of Local Development (BLDG), is the Office with primary responsibility in localizing the Millennium
Development Goals (MDG’s) and capacitating LGU’s to effectively discharge their powers and functions
towards improving the delivery of basic services and facilities to their constituents;
WHEREAS, the Development Budget Coordinating Committee (DBCC) of the Department of

Budget and Management (DBM) approved the Performance Based Incentive Policy (PBIC), which
provides for an incentive framework to rationalize national government and intergovernmental transfers
to LGU’s towards improving LGU performance in governance and delivery of basic services;
WHEREAS, the Performance Challenge Fund (PCF) for Local Government Units is an incentive
fund for LGU’s in the form of counterpart funding to high-impact capital investment projects in the
Annual Investment Plan (AIP) and funded out of the 20% Local Development Fund (LDF), consistent
with national development goals and priorities;
WHEREAS, the Performance Challenge fund (PCF) is being administered by the Department of
the Interior and Local Government, in collaboration with the Department of Budget and Management
(DBM), to recognize good governance performance particularly in the adoption of ”good housekeeping”
along the governance areas of development planning, sound financial management, transparency and
accountability, and valuing performance monitoring;

WHEREAS, the Performance Challenge Fund progressive realization to achieve the Millennium
Development Goals (MDG’s), maintenance of core road network to boost tourism and local economic
development and comply with the Philippine Disaster Risk Reduction (DRR) and Management Act of
2010 and Ecological Solid Waste Management Act of 2000, programs and projects is anchored on the
contribution of local government units (LGU’s), as well as non-government and private sector
organizations;
WHEREAS, Local Government Units (LGU’s), as provided under Republic Act 7160, otherwise
known as the “Local Government Code of 1991”, assume the primary responsibility for the provision of
basic services and facilities and the improvement of quality of life of their constituents towards the
achievements of Millennium Development Goals (MDG), Disaster Risk Reduction (DRR) and Climate
Change Adaptation (CCA);
WHEREAS, the Province of Tarlac and the Municipality of Pura, have been awarded the Seal of
Good Housekeeping thereby entitling this LGU to receive the Performance Challenge Fund Subsidy
amounting to a maximum of One Million Pesos (P 1,000,000.00);
WHEREAS, the amount of Two Million Pesos (P 2,000,000.00) was allocated in the LGUs
Economic Development Fund for the construction of a New Public Market, which shall be the counterpart
fund of the Municipality in the availment of the PCF subsidy;

WHEREAS, Article XII, Section I, Ist paragraph, of the Philippine Constitution provides that the
goals of the national economy are a more equitable distribution of opportunities, income and wealth of
life; a sustained increase in the amount of goods and services produced by the nation for the benefit of the
people; and an expanding productivity as the key to raising the quality of life for all, especially the
underprivileged;
WHEREAS, Article XIII, Section 2, of the Philippine Constitution provides that the promotion of
social justice shall include the commitment to create economic opportunities based on freedom of
initiative and self reliance;
WHEREAS, Section 3 of Republic Act 5416, otherwise known as the “Social Welfare Act”
mandates the Department of Social Welfare and Development (DSWD) to provide the comprehensive
program of social welfare and services designed to ameliorate the living condition of distressed Filipinos
particularly those who are handicapped by reasons of poverty;
WHEREAS, pursuant to the above mandate the DSWD has designed the SEA Kaunlaran
Scheme, which focuses on the promotion of viable people’s organizations and effectively address the
livelihood needs of the disadvantage group;
WHEREAS, Republic Act 7160, otherwise known as the “Local Government Code of 1991,”
provides for the consultation and coordination with Local Government Units (LGU’s);
WHEREAS, the Self-Employment Assistance (SEA) Kaunlaran Program is considered as an

innovative approach to livelihood development credit assistance and people empowerment;

Unit believe that the partnership of the LGU’s and the national government agency is necessary to
contrive success in its special/pilot implementation;

WHEREAS, in support of the President’s thrust to alleviate poverty through micro-

entrepreneurial activity, the Secretary of the Department of Labor and Employment (DOLE) issued
Department Order No. 36-02, Series of 2002, Integrated Guidelines in Accessing to Fund and Programs
or Projects Implemented by the DOLE and Department Order No. 81-07, Series of 2007, guidelines in the
Implementation of the “Unlad Kabuhayan Program Laban sa Kahirapan” briefly known as Unlad
Kabuhayan Program or the DOLE Worktrep Program reconstitute to the integrated livelihood program,
the DOLE Kabuhayan Program (DKP);
WHEREAS, the DOLE Kabuhayan Program is packaged with programs for the formation,
enhancement, and restoration of livelihood of informal and formal workers;
WHEREAS, the Program will provide four (4) major services that will help the livelihood
businesses grow into micro-enterprises consisting of training, business advisory, social protection and
networking services;
WHEREAS, the DOLE Kabuhayan Program will provide a livelihood starter kit consisting of a
package of services that will enable the target beneficiaries to start quickly a livelihood undertaking and
become self-employed. It aims to engage them in sustainable self-employment through easy to learn
livelihood undertakings, included in the DKP is the Negosyo sa Kariton (NegoKart) Project;
WHEREAS, the project will provide the beneficiaries with services/assistance that will enable
them to increase, upgrade and/or diversify their products or services and market these to greater number
of buyers or customers;

WHEREAS, the said program provides highlights on collection, segregation, recycling and
transformation of bio-wastes from different sources into organic fertilizer, which is designed to create

WHEREAS, based on the statement made by the local Acting Chief of Police, S/Insp Fernando R.

Municipality;
WHEREAS, the efforts of the local police in maintaining Pura as “gambling-free” Municipality is
worthy of commendations;
WHEREAS, the Status of the Municipality as “gambling-free” can only be protected with the full
support of the citizenry;
RESOLVED, as it is hereby resolved, to declare Pura, Tarlac as “gambling-free” Municipality

and commend the local Acting Chief of Police, S/Insp Fernando R. Ibanez, and all his men in uniform for
their efforts in maintaining this Municipal as such;

WHEREAS, in order to comply with the pertinent provisions of the Republic Act No. 7160,

PARTAKE A PORTION OF THEIR CHRISTMAS BONUS (CHRISTMAS GIFT/PEI) SO AS TO
ALLEVIATE THE SUFFERINGS OF OUR CONTRYMEN IN THE FLOOD-DEVASTATED
AREAS IN MINDANAO AND THE VISAYAS
WHEREAS, it is a common knowledge that some areas in Mindanao and the Visayas,
particularly Cagayan de Oro City, Iligan City, Dumaguete City and Iloilo, were recently flood-devastated
due to the onslaught of Tropical Storm “Sendong”;
WHEREAS, due to the said catastrophe, hundreds of lives were lost and thousands of houses,
crops and livestocks and many roads and bridges and other infrastructures were destroyed;
WHEREAS, in order to alleviate their sufferings, there is a necessity of extending a helping hand
to the said victims;
NOW THEREFORE, on motion of Coun. Timoteo D. Balmores, duly seconded, be it:
RESOLVED, as it is hereby resolved, to request every Municipal Official or Employee to

partake a portion of their Christmas Bonus (Christmas Gift/PEI) so as to alleviate the sufferings of our
countrymen in the flood-devastated areas in Mindanao and the Visayas.

A RESOLUTION APPROVING THE ANNUAL INVESTMENT PLAN OF THE
MUNICIPALITY
WHEREAS, Section 354 of Republic Act No. 7160 provides that the Secretary of Budget
and Management and the Chairman of the Commission on Audit (COA) shall jointly promulgate
a Budget Operations Manual for local government units to improve and systematize methods,
techniques, and procedures employed in budget preparation, authorizing, execution and
accountability;
WHEREAS, Article 410 of the Implementing Guidelines of RA 7160 provides that the
Local Development Council shall submit to the local finance committee a copy of the local
development plan and annual investment program prepared and approved during the fiscal year
in accordance with applicable laws, specifying therein the projects proposed for inclusion in the
local government budget;
WHEREAS, the Annual Investment Plan has already been reviewed at the Sangguniang
Bayan and found to have complied with the substantial requirements set forth by law;
RESOLVED, as it is hereby resolved, to approved the 2012 Annual Investment Plan.
