WHEREAS, Section 354 of Republic Act No. 7160 provides that the Secretary of Budget and
Management and the Chairman of the Commission on Audit (COA) shall jointly promulgate a Budget
Operations Manual for local government units to improve and systematize methods, techniques, and
procedures employed in budget preparation, authorization, execution and accountability;
WHEREAS, Article 410 of the Implementing Guidelines of RA 7160 provides that the Local
Development Council shall submit to the local finance committee a copy of the local development plan
and annual investment program prepared and approved during the fiscal year in accordance with
applicable laws, specifying therein the projects proposed for inclusion in the local government budget;
WHEREAS, the Annual Investment Plan has already been reviewed at the Sangguniang Bayan
and found to have complied with the substantial requirements set forth by law;
RESOLVED FURTHER, to furnish copy of this resolution all agencies concerned for their
information and guidance.

WHEREAS, one of the priority programs of this local government unit (LGU) is the purchase of
anti-rabies vaccines to be distributed to victims of dog bites;
WHEREAS, due to the scarcity of funds or limited financial resources of this LGU, the said
program has not yet been realized;
WHEREAS, due to the said predicament, it has been the consensus of the members of this August
Body to seek assistance from national government agencies, particularly the Honorable Chairman of the
Philippine Charity Sweepstakes Office (PCSO);
NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., Chairman, Committee on Rules,

WHEREAS, Section 444, par. (b) (1) (vi), of Republic Act No. 7160, otherwise known as the
“Local Government Code of 1991,” provides that for efficient, effective and economical governance the
purpose of which is the general welfare of the municipality and its inhabitants pursuant to Section 16 of
this Code, the municipal mayor shall upon authorization by the Sangguniang Bayan, represent the
municipality in all its business transactions and sign on its behalf all bonds, contracts, and obligations,
and such other documents made pursuant to law or ordinance;
WHEREAS, pursuant to Section 470, par. ( d ) ( 2), of the said Code also provides that the
treasurer shall take charge of the treasury office, perform the duties provided for under Book II of the
Code, and shall take custody and exercise proper management of the funds of the local government unit
concerned;
WHEREAS, in view of the foregoing, there is a necessity to authorize the Municipal Mayor,
Hon. CONCEPCION A ZARATE, and Acting Municipal Treasurer, MRS. VIOLETA V. SUPAN,
as the official signatories of all business transactions of this local government unit with the Land Bank
of the Philippines, Philippine National Bank and Development Bank of the Philippines;

WHEREAS, the enactment of Republic Act No. 7160, otherwise known as the “Local Government
Code of 1991,” provided a way for check and balance among the Local Government Units by granting them
separate powers;
WHEREAS, Section 445 (1) of the Code grants the Municipal Vice Mayor the power to be the
Presiding Officer of the Sangguniang Bayan and sign all warrants drawn on the Municipal Treasury for all
expenditures appropriated for the operation of the Sangguniang Bayan;
WHEREAS, in consonance to the above provision, this body passed a Resolution Authorizing the
Transfer of the Administration of Funds for the Sangguniang Bayan from the Executive Department to the
Municipal Vice Mayor on July 15, 2010;
RESOLVED, as it is hereby resolved, to authorize the Municipal Vice Mayor, Hon. MANUEL I.
PASCUA, and the Acting Municipal Treasurer, MRS. VIOLETA V. SUPAN, as the official signatories in all
business transactions of this Sanggunian with the Land Bank of the Philippines, Philippine National Bank and

WHEREAS, Section 176 of Commission on Audit Circular No. 91-386 allows the
establishment of petty cash for government agencies;
WHEREAS, the Local Chief Executive has endorsed the request of the OIC-Municipal
Treasurer seeking for the adoption of a resolution authorizing the establishment of petty cash for the
Local Government Unit;
WHEREAS, this body, after careful evaluation, had found out the request to be of merit;
NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., duly seconded, be it:
RESOLVED, as it is hereby resolved, to allow the establishment of petty cash for the Local
Government, as requested by the OIC-Treasurer;

WHEREAS, the National Food Authority (NFA) is the government agency charged with, among
others, ensuring the nation with adequate supply and distribution of grains;
WHEREAS, pursuant to the provisions of the Local Government Code of 1991, local
government units have been vested the authority to discharge the functions and responsibilities of national
agencies and offices devolved to them;
WHEREAS, the local government units are authorized to set aside five percent (5%) of the
twenty percent (20%) of their estimated revenue from regular sources as an annual lump sum
appropriation for Calamity Fund and Special Development Fund, respectively;
WHEREAS, the local government units have been tasked with providing basic social services at
all times, particularly in times of calamities;
WHEREAS, in order to provide basic social services to the populace, the Pura Municipal
Government had requested the NFA to allow them to purchase rice on credit for the following purposes:
(1) for relief operations whenever a state of calamity is declared in their locality; and (2) for stockpiling
purposes in preparation for any eventuality/emergency that may occur at any given time;

WHEREAS, the Barangay Council of Poblacion No. 2 is desirous of purchasing from Mr. Luis
Caratiquit his residential lot, including the house and all the improvements thereon, situated at Arellano St.
cor. Esteban St., Pura, Tarlac, with an area of 157 sq. mts., more or less, as described in Transfer Certificate
of Title (TCT) No. 68218;
WHEREAS, after proper negotiations, the property owner, Mr. Luis Caratiquit, expressed his
willingness to sell his property to the Barangay Government in the amount of TWO HUNDRED FIFTY
THOUSAND PESOS (P250,000,00);
WHEREAS, the sale of the above-described property can only be consummated upon approval of
the Provincial Appraisal Committee;
NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., Chairman, Committee on Rules,
Privileges and Legal Matters, unanimously seconded, be it:
RESOLVED, as it is hereby resolved, to endorse the intention of the Poblacion 2 Barangay Council
to purchase from Mr. Luis Caratiquit his residential lot, including the house and all the improvements
thereon, situated at Arellano St. cor. Esteban St., Poblacion 2, Pura, Tarlac, with an area of 157 sq. mts.,
more or less, as described in TCT No. 68218, as contained in Barangay Resolution No. 8, Series of 2011, to

WHEREAS, the Municipal Tax Code provides that failure to pay the tax prescribed within the time
required shall subject tax payer to a surcharge of Twenty Five Percent (25%) of the original amount of Tax
due;
WHEREAS, Section 2B.05 of Chapter II, Article B of the Revised Tax Code of the Municipality
provides that the sangguniang bayan, through a resolution may extend the time of payment of Business Tax
without penalty or surcharge for a justifiable reason or cause provided that the period of extension shall not
exceed six (6) months;
WHEREAS, the Market Vendors Association have requested for an extension of the time of payment
of their business taxes through a letter dated January 14, 2011;
WHEREAS, upon recommendation of the Committee on Ways and Means the body agreed to extend
the time of payment up to February 28, 2011.
NOW THEREFORE, on motion of Coun. Felino C. Millo Jr., Chairman, Committee on Rules,
Privileges and Legal Matters, duly seconded, be it:
RESOLVED, as it is hereby resolved, to extend the time of payment of the Business Tax of the
Market Vendors up to February 28, 2011;

given the go-signal for this undertaking based on their report dated February 11, 2011;
WHEREAS, after a thorough investigation and upon the recommendation of the SB Committee
on Public Utilities, Facilities, Market and Slaughterhouse, the request of the Local Chief Executive was
found to be in order;
RESOLVED, as it is hereby resolved, to adopt this resolution allowing the demolition of the
existing Pura Public Market to pave the way for the construction of a new and modern one.

WHEREAS, it has been decided by the Executive Department that the temporary relocation site
for the stall-owners of the Pura Public Market will be the Pura Municipal Covered Court;
WHEREAS, pursuant to Section 11, par. (c), of Republic Act No. 7160, local government offices
and facilities shall not be transferred, relocated or converted to other uses unless public hearings are first
conducted for the purpose and the concurrence of the majority of all the members of the sanggunian
concerned is obtained;
WHEREAS, in compliance thereto, the Committee on Public Utilities and Facilities, Market and
Slaughterhouse, in coordination with the Committee on Rules, Privileges and Legal Matters, conducted
the necessary public hearing in January 2011 at the Pura Municipal Training Center;
NOW THEREFORE, upon the recommendation of the concerned committees of this August
body, be it:
RESOLVED, as it is hereby resolved, to designate the Pura Municipal Covered Court as the
temporary relocation site for the stall-owners of the market vendors of this Municipality.

WHEREAS, in addition to the powers granted to each local government unit to levy taxes,
Section 18 of the local government code, in consonance with the Constitution, also granted powers to
Local Government Unit (LGU) to create their own sources of revenue in the exercise and furtherance of
its governmental and proprietary powers and functions;
WHEREAS, the municipality acquired Farm Tractors and Multi-purpose thresher in order to
enhance production of the agricultural sector;
WHEREAS, in the exercise of the revenue raising measure, the Municipality, hereby fixes the
fees for the use of the above equipment;
NOW THEREFORE, the Sangguniang Bayan of Pura in session assembled do hereby enact the
following:
Section 1. TITLE. This ordinance shall be known as the “Ordinance Amending the Prescribed
Fee for the use of Farm Tractor and Multi-Purpose Thresher”
Section 2. DEFINITION OF TERMS. When used in this ordinance, the following shall mean:
a. Gross Output – The total production extracted from the shelled or unshelled corn
expressed in terms of kilos.

Section 3. SCOPE – this ordinance shall govern the imposition fee for the operation of the Farm
Tractors and Multi-Purpose Thresher.
Section 4. IMPOSITION OF FEE. There shall be a fee imposed for the use of the Farm Tractor
and Multi-Purpose Thresher prescribed hereunder.
c. Tractor Services Fee. The amount to be collected shall be ONE THOUSAND PESOS
(P1,000.00) per pass/hectare.
Section 5. TIME OF PAYMENT. The fee imposed in this ordinance shall be paid to the
Municipal Treasurer after completion of work duly authorized by the LGU.
Section 6. ADMINISTRATIVE PROVISIONS. The Office of the Municipal Mayor or the duly
authorized representative shall implement the provisions of this ordinance and, shall promulgate the
necessary guidelines for the operations thereto.
Section 7. APPLICABILITY CLAUSE. All other matters relating to operation of the Farm
Tractor and Multi-Purpose Thresher shall be governed by other existing rules and regulations.

WHEREAS, it is a constitutional mandate for the state to adopt an integrated and comprehensive
approach to health development which shall endeavor to make essential goods, health and social services
available to all people at affordable cost;
WHEREAS, consistent with the vision and objective of the state, the Municipal Government had
adopted several health programs including the establishment of a Maternity Lying-In/Birthing station;
WHEREAS, in order to ensure the smooth and efficient operation of the birthing station, there is a
need to adopt an ordinance regulating and imposing fees for its operation;
Section I. TITLE. This ordinance shall be known as “AN ORDINANCE REGULATING AND
IMPOSING FEES FOR THE USE OF MATERNITY LYING-IN (BIRTHING STATION) OF THE
MUNICIPALITY OF PURA.”
0 Section 2. Scope of Application. This ordinance shall govern the use of the Maternity Lying-In
in the Municipality of Pura.
Section 3. Imposition of Fee – There is hereby a fee imposed for the use of the Birthing Station in
the manner prescribed herein, to wit:

a. For eligible Philhealth members – No fee shall be charged
Section 4. Time of Payment. The fee imposed herein shall be paid to the Municipal Treasurer
before discharge of the patient.
Section 5. Administrative Provision. The Rural Health Unit/Municipal Treasurer shall keep a
registry of persons who have availed of the services of the Birthing Station and shall submit a monthly
report to the Office of the Mayor not later than ten (10) working days after the end of each month.
The Rural Health Unit shall be responsible for the accreditation of the birthing station with the
Philippine Health Insurance Corporation and shall, likewise, submit list of Philhealth members who have
availed of the services of the said Birthing Station to the Office of the Mayor not later than ten (10)
working days after the end of each month.
The Local Chief Executive shall issue the necessary implementing guidelines for the smooth
implementation of this ordinance.
Section 6. Repealing Clause. All ordinances, rules and regulations or parts thereof in conflict with
or inconsistent with any provision of this ordinance are hereby repealed or modified accordingly.
Section 7. Penalty. Any violation of the provisions of this ordinance shall be punished by a fine of
not less than One Thousand Pesos (P 1,000.00) or imprisonment of not less than one (1) month but not
more than six (6) months or both at the discretion of the court.

basic production and post-harvest facilities, such as hand tractors;
WHEREAS, this LGU has a total of Eight Hundred Eighty Nine and 75/100 (889.75) hectares of
irrigated and One Thousand One Hundred Sixty Eight and 85/100 (1,168.85) hectares of non-irrigated
rice land, which is more or than or equal to the minimum required area of Two Thousand Fifty Eight and
60/100 (2,058.60) hectares to avail of the assistance package from the Department of Agriculture;
WHEREAS, this LGU has an average palay yield of Four (4.0) metric tons per hectare per year;
WHEREAS, this LGU has 1,767 farmers that will directly benefit with the said facilities and has
access to the services of expert personnel to manage and operate the same;
WHEREAS, this LGU has an available warehouse/shed located in Brgy. Matindeg, which can be
legally used as the official garage of such facilities, especially when not in use;

accountability, and valuing performance monitoring;

WHEREAS, the Performance Challenge Fund progressive realization to achieve the Millennium
Development Goals (MDG’s), maintenance of core road network to boost tourism and local economic
development and comply with the Philippine Disaster Risk Reduction (DRR) and Management Act of
2010 and Ecological Solid Waste Management Act of 2000, programs and projects is anchored on the
contribution of local government units (LGU’s), as well as non-government and private sector
organizations;
WHEREAS, Local Government Units (LGU’s), as provided under Republic Act 7160, otherwise
known as the “Local Government Code of 1991”, assume the primary responsibility for the provision of
basic services and facilities and the improvement of quality of life of their constituents towards the
achievements of Millennium Development Goals (MDG), Disaster Risk Reduction (DRR) and Climate
Change Adaptation (CCA);
WHEREAS, the Province of Tarlac and the Municipality of Pura, have been awarded the Seal of
Good Housekeeping thereby entitling this LGU to receive the Performance Challenge Fund Subsidy
amounting to a maximum of One Million Pesos (P 1,000,000.00);
WHEREAS, the amount of Two Million Pesos (P 2,000,000.00) was allocated in the LGUs
Economic Development Fund for the construction of a New Public Market, which shall be the counterpart
fund of the Municipality in the availment of the PCF subsidy;

1. The fund raising activity thru cockfighting shall conform to the provisions of RA-7160
particularly section 391 (11) to ensure compliance with national policy standards and
regulations on morals, health and safety of the persons participating therein.
2. Cockfights shall be conducted in accordance with the rules and regulations set forth in
Municipal Ordinance No. 08-002 and other related laws.
3. Cockfights shall be managed by duly qualified persons who shall abide with the pertinent
provisions of the Municipal Tax and Revenue Code.
4. No Gambling of any kind shall be permitted within the premises of the temporary cockpit.
5. The Special Permit shall be valid starting September 20, 2011 up to January 30, 2012 only
and shall not be subject to any extension after its expiration.

necessity for the Local Chief Executive to enter into an agreement with the Tarlac Provincial
Government;
WHEREAS, Section 22, paragraph (c), of Republic Act No. 7160 provides in part that unless
otherwise provided in this Code, no contract may be entered into by the Local Chief Executive in behalf
of the Local Government Unit without prior authorization from the Sanggunian concerned;

WHEREAS, Section 354 of Republic Act No. 7160 provides that the Secretary of Budget
and Management and the Chairman of the Commission on Audit (COA) shall jointly promulgate
a Budget Operations Manual for local government units to improve and systematize methods,
techniques, and procedures employed in budget preparation, authorizing, execution and
accountability;
WHEREAS, Article 410 of the Implementing Guidelines of RA 7160 provides that the
Local Development Council shall submit to the local finance committee a copy of the local
development plan and annual investment program prepared and approved during the fiscal year
in accordance with applicable laws, specifying therein the projects proposed for inclusion in the
local government budget;
WHEREAS, the Annual Investment Plan has already been reviewed at the Sangguniang
Bayan and found to have complied with the substantial requirements set forth by law;
RESOLVED FURTHER, to furnish copy of this resolution all agencies concerned for
their information and guidance.
