PROCESS SERVER’S RETURN OF SUMMONS

This is to certify that the undersigned was in receipt of a copy of summons, together with
the attached complaint and its annexes in the above-entitled case, for service upon the defendant
ROWENA MILCA CAPOQUIAN at Brgy. Burabod, Gamay, Northern Samar.

That on 14 December 2018 at around 11:00 o’clock in the morning, the undersigned tried
to serve copy of the summons, together with the complaint and its annexes, upon the defendant
but failed for the reason that the defendant was in Calbayog City, Samar at the time of the
service of summons, as per information from the defendant’s sister.

That on the same day at around 4:30 in the afternoon, the undersigned went again to the
residence of the defendant, who had just arrived from Calbayog City, Samar. The undersigned
tried to personally serve the copy of the summons, together with the copy of the complaint and
its annexes, upon the defendant by handing the same to the latter in person, BUT
DEFENDANT REFUSED TO RECEIVE IT.

That on 18 December 2018 at around 9:30 in the morning, effort to personally serve the
summons, together with the copy of the complaint and its annexes, upon the person of the
defendant was again exerted by the undersigned. Again, DEFENDANT REFUSED TO
ACKNOWLEDGE RECEIPT of the same thus, tender of summons to the defendant was
instead resorted to by the undersigned.

WHEREFORE, the original copy of the summons is now respectfully returned, DULY
SERVED.
