NOTICE OF DISMISSAL WITHOUT PREJUDICE

PLAINTIFF BIG EMPEROR TECHNOLOGY

CORPORATION, through the undersigned counsel,
respectfully states:

1. That due to some procedural defects in the petition ,

plaintiff hereby serves notice of dismissal of the petition in
accordance with Rule 17 Section 1 of the Rules of Court in
order to withdraw the petition without prejudice to refiling
the same.

2. Under Rule 17 , Section 1 of the Rules of Court:

DISMISSAL OF ACTIONS

SEC. 1. Dismissal upon notice by plaintiff. — A complaint may be

dismissed by the plaintiff by filing a notice of dismissal at any time
before service of the answer or of a motion for summary judgment.
Upon such notice being filed, the court shall issue an order confirming
the dismissal.
 PRAYER

WHEREFORE, PREMISES CONSIDERED, it is respectfully

PRAYED that the Honorable Court issue an order
CONFIRMING the instant NOTICE OF DISMISSAL WITHOUT
PREJUDICE to refiling the same .

Other Reliefs just and equitable are likewise prayed for.
