FOR SPECIAL MINISTERIAL DETERMINATION – ANGORE PDL 8.

PNG LNG PIPE LINE SEGMENT # 2 PIR EXCLUDED LAND OWNERS REQUEST
NOTES AND COMMENTARIES TO BE INCORPORATED IN TO THE AFFITDAVIT.

1. The LOBID Team comprised of officers from both departments of


Petroleum and energy and Mineral Resources Development Corporation.
The Team Leaders were, the co-ordinator, Mr Ismael Panda and his deputy
, Mr Chris Kol.

2. The concluded LOBID exercise has failed and deemed null and void
because the team did not follow due processes and procedures. They
(LOBID team) did not comply with section 169 and 170 of the oil and Gas
ACT. Also the LOBID Team did not comply with the terms of reference
(TOR) of the GOPNG Sanctioned LOBID exercise.

3. The LOBID Team camped at Kutubu and carried out the LOBID exercise for
all the Pipe Line Segment 1 – 7

4. Kutubu is located in the Southern Highlands Province.

5. PNG LNG PIPE LINE SEGMENT 1 – 3 are located in the Hela Province.

6. PNG LNG PIPELINE SEGMENT # 2, about 13 Km is located in Angore PDL 8


area of Hulia – Benaria Local level Government Territory.

7. The PNG LNG PIPELINE sits on the 13 Km land of the 22 stock clans that
were excluded by the LOBID team. Accordingly, the 22 clans will miss out
on the 14.03 % benefits allocated for pipeline segment.

8. The Acting Secretary, Mr Kepsy Puiye’s letter dated 01/10/2018 in reply to


Mr Hangu Pipiya’s complaint, pp.6 is misleading, because Angore PDL8 is
situated downstream from Hides and KP 1 to KP 32 starts from Hides.
Angore PDL8 covers KP 16 to KP 32.

9. The Deputy HELA governor, who is also the President of Hulia – Benaria
LLG told the LOBID team to go to Benaria after they complete the SHP
pipeline Segments. He informed his people of directive to LOBID team.

10.The people of the 22 clan assembled at Benaria on the appointed Date but
later in the day they were informed that, LOBID team would not come to
Benaria. The people prepared a big reception with a lot of food and couple
of pigs slaughtered and cooked and a singsing group was dressed up in
readiness to receive the LOBID team.

11.After the Leaders received the information that the LOBID team would not
come to Benaria , the Hela deputy governor became upset and he hired
several vehicles and loaded the food with all the leaders of the 22 clans
and went to Kutubu to meet the LOBID team.They arrived at Kutubu and
handed over the food and asked the LOBID team why they did not want to
come to Benaria. The LOBID team in replyment told the Hela deputy
Governor and his clan leaders that, everything has been considered and is
recorded and everyone would be included.

12.But, when the ministerial determination was published, that statement


was found to be half true. Only 8 clans were included and rest 14 clans
were excluded.

13.The Publication of the Ministerial Determination Irrked Mr Hangu Pipiya


and he took issue of the deceit and half truth about all the 22 clans would
be included by the LOBID team Leaders and he petitioned the LOBID team
leaders and DPE and gave 21 days , 14 days and 7 days notice to reply and
explain their actions.

14.The Department of petroleum nor the LOBID Team leaders did not
responded to all the three notices.

15.The complainant , Mr Hangu Pipiya realised that, time will be wasted so he


engaged Nandii Lawyers to take carriege of the issue and on the 15 th
October 2018 wrote to the Acting secretary, requesting for an expedited
response which he did not get (Annex copy of letter )

16.Mr Hangu Pipiya never gave up and approached the LOBID co-ordinator,
Mr Ismael Panda many times but he did not give him a favourable answer.
The last time Mr Pipiya went to Mr Ismael Panda’s office , he told Mr
Pipiya to take his leaders to tari and he ( Mr Panda) will sort it out there,
during the opening of the Land owners Bank Accounts. But, Hangu replied,
if that is so , then you give me a written assurance and he was ordered out
by Mr Ismael Panda.
17.Mr Hangu Pipiya followed as told and flew to tari with some of the clan
leaders who were in Port Moresby for that purpose without knowing that
Mr Panda has no power to include the excluded clans and allow them to
open Bank accounts . Mr Hangu Pipiya spent a lot of money on airfares for
himself and other clan leaders that flew to Tari , only to be told that LOBID
was concluded and the process is closed.

18.Mr Hangu Pipiya and other clan Leaders protested but Mr Ismael Panda
told them to take the issue to court of law and he will act upon a court
order.

19.In paragraph # 7 of Mr Kepsy Puiye’s letter 0f 1st /10 /2018, He said and I
quote ,” Please be advised that all outstanding issues shall be addressed
mutually during the PNG LNG Pipeline LBBSA review.” On the other hand ,
Mr Ismael Panda told Mr Hangu Pipiya and other clan leaders to take the
issue to court.

20.The blatant lies and deceitfully fabricated stories made other clan leaders
give up,but Mr Hangu Pipiya continued the fight for the rights of the 22
clans to benefit from the stream of pipeline benefits in the 14.03%
allocated to them.

21.His mission was not accomplished and did not want his 22 clans to be
spectators, He made a number of attempts to approach the office of new
petroleum Minister Hon. Kerenga Kua to address the issue but to no avail.

22.As shrewed and cunning as he is, Mr Hangu Pipiya still want justice to be
accorded to people and has engaged another Law Firm, Peter Daime Kaii
Lawyers to institute legal proceeds as blatantly told. The principal, Peter
Daime has already served section 5 notice to DPE , Petroleum Minister and
the State.

23.Mr Hangu Pipiya has provided a true, correct, and proper name lists of
clan with the help of clan leaders for consideration and endorsement by
the court. They also decided on the allocation of the percentage to the
clans from the 14.03% allocated to them at LBBSA in Kokopo.

24.The department of petroleum created two new systems.


System # 1. Green and Brown field.
The LOBID team told the landowners that, those clans in the green field will
benefit from the PNG LNG pipeline benefits and those clans in the brown
field will not receive any benefits at all.
The LOBID team divided the landowner clans on which the PNG LNG
pipeline foot prints in to Green field and Brown field. But we don’t see any
green field and brown field foot prints of the PNG LNG pipeline.
Our question is, “Who invented the idea, for what purpose and for whose
Benefit?”

25. COMMENTARY

a) The LOBID team camped at kutubu and collected information on the


LOBID that covers four (4) provinces and they are Hela (host province),
Southern Highlands, Gulf and Central Province.

b) The LOBID team had at no one time during the LOBID exercise travelled
the foot print of the PNG LNG pipe line to assemble the landowners
and identify the true landowners of the project impact region,

c) Many Landowner clans were left out or not included, have been
intolerably told to take the issue to court to seek judicial rectification,
but this is an expensive exercise. Who is going to pay for the legal and
associated costs?

d) Many landowner clans have already been assisted to open bank


accounts. It is highly likely to cause bitterness among the excluded
clans, when those opened the accounts receive the pipeline benefits.
And who predicts what happens next…

e) The state, its agents and servants have created huge problems and it
must immediately stop all forms of payments and solve the problem to
ensure the pipeline benefit are shared fairly and equitably among
landowner clans.
