MINUTES OF THE MONTHLY MEETING

Meeting : Lupon Monthly Meeting

Date : February 28, 2022, 2:30pm (Monday)

Venue : Lupong Tagapamayapa Office

 The meeting commenced at 2:30PM starting with the opening prayer by Lupon Member Elvie
Chavez.

 Lupon President called to order the regular meeting of the Lupon Tagapamayapa at 2:30pm on
February 28, 2022 at Lupon Tagapamayapa Office.

 Roll call Mylene Rafada, Barangay Lupon Secretary conducted a roll call. Attendees’ name
attached.
 Approval of minutes from last meeting. Mylene Rafada, Lupon Tagapamayapa Secretary read the
minutes from the last meeting. The minutes were approved as read with corrections.

1. REVIEW OF THE PREVIOUS MINUTES OF THE MEETING:


Lupon President asked the body if anything else was observed on the previous minutes of the
meeting.

OIC-PB Kgd Chairman wants to clarify if a lot of CFA were returned in the Lupon Office. Lupon
Pres. defense, the allegations are patently absurd because the Lupon office doesn't receive any
returned CFA.

3. REVIEW ON OTHER MATTERS ARISED:


A. HARASSMENT VS SLANDER/UNJUST VEXATION

  B. KP CASE TO ANOTHER KP CASE ON BOTH PARTIES

C. TAX DECLERATION ON OWNERSHIP


  The property is owned by the person if their named is stated on the tax declaration,
otherwise if the tax declaration indicates the people of the Philippines then it’s owned
by the government. No basis to claim by the the one holding the documents.

D. COLLECTION OF SUM OF MONEY WITH OR WITHOUT CONTRACT

E. COLLECTION OF SUM OF MONEY VS GRAVE COERCION


 The debt with or without contract if the land lord/lady wants to expel the house that is
grave coercion.
F. SPA ON CIVIL/CRIMINAL CASES
 SPA is only allowed on Civil Cases, On Criminal Cases complainant needs to attend
the hearing in person.

G. CFA VS LETTER OF DESISTANCE


 Clarified that it is not allowed to issue a letter of desistance until the Certificate of File
Action (CFA) has been submitted in the court.

H. COLLECTION OF SUM OF MONEY CATEGORY SPECIFICATION


 Reminded the body that cases about Collection of Sum of Money, needs to be
categorized and it’s need to be specific and included in the katitikan for easy
reconciliation.

I. HOUSE RENTAL ON OWNERSHIP/POSSESSION


 Landlord/lady is the legal owner of the property but if there is a tenant then they cannot
force the tenant to leave.

J. REPUDATION/MOTION FOR EXECUTION.


 Need to explain to both parties the following
a) Repudation – applies for 10 days only and with FVI if none and they just want to
change the amicable settlement they can directly bring to the court
b) Motion for execution – less than six (6) months to apply

K. ILLEGAL OCCUPANCY UNLAWFUL /DETAINER OR OWNER


 Like for example of the respondent Henita’s case that she built a temporary shelter in
a dangerous zone without the permission of Barangay or the City government.

L. IMPORTANCE OF DEMAND LETTER


 If the person with debt and no demand letter from the lender we give the complainant
a demand letter for easier to collect as our help and
a) To send thru courier most of the time not received
b) If personal delivery they cannot refuse
c) With affidavit of service with notarized

M. ELEMENT OF CONTRACT/DEED OF SALE

P. RECORDING DURING HEARING IN THE LUPON OFFICE


 Hearings should be recorded but we would need to ask permission from both parties, if
both parties agrees the hearing be recorded but if one (1) party or both parties
disagreed then the hearing will not be recorded. OIC-PB Chairman suggested that it
should be stated in the katitikan that both parties agreed to record the hearing.
Q. VAWC JURISDICTION ON RELATIONSHIP
 Clarification that if the female complained about being abuse even if it is past or
present relationship then it will be under the jurisdiction of VAWC, if the male
complained about being abuse then it will be the care of Lupon office regardless if it is
a past or present relationship.

R. ANY COMPLAINT BY OR AGAINST CORP/PARTNERSHP


 If the complainant is corporation, partnership, or company are not usually allowed in
the Barangay, however if they are still insisting to resolve the issue then we will accept
or allow but if both parties do not reach an agreement we would immediate need to
drop the case and advise them to take it directly to the Court.

U. DRESS CODE OF BOTH PARTIES


 It is observed that most of the clients do not follow the dress code. We would need to
properly uphold the dress code and we should advise them to wear the casual dress.

V. PREFERENCES AS A LUPON MEMBER


 1. Careful observation of punctuality
2. To review and study the katitikan for the hearing of the day before to start
3. To learn the case for us to have our immediate advises to the client
4. How to communicate to other Lupon members.
5. Collection of Sum of Money to enhance the agreement

2. Every three (3) months – awardee for best lupon
3. 1k incentive with certification
