This refers to the above-cited subject submitted into this office for legal opinion.

Upon, cautious review of the approve ordinance, this office is of the view that the same is
valid, legal and without any legal infirmities and the said ordinance is authorized in
accordance with the Local Government Code giving Sangguniang Bayan the power to enact
ordinance for grant honorarium to any qualified official or employee designated to fill a
temporary vacancy in a concurrent capacity, at the rate authorized by law.1
