RE: MUNICIPAL ORDINANCE NO. 02, S-2023—AN ORDINANCE AMENDING


MUNICIPAL ORDINANCE NO. 011-S-2012 ALSO KNOWN AS THE GENDER AND
DEVELOPMENT CODE OF THE MUNICIPALITY OF GENERAL TINIO, NUEVA
ECIJA AND FOR OTHER PURPOSES

This has reference to your letter requesting this office’s legal opinion on
Municipal Ordinance No. 02, S-2023—The Gender and Development Code of the
Municipality of General Tinio, Nueva Ecija.

The office is coherent in its opinion that this Ordinance is in consonance with
the provisions of our Consitution, particularly Sec. 14, Art II thereof which provides
that the State recognizes the role of women in nation-building, and shall ensure that
fundamental equality before the law of men and women.

Republic Act 7192, directs all government agencies to institute measures that
would curtail if not totally eliminate gender bias in its policies, programs and
projects. This safeguards women’s rights and ensures that women are given the
opportunity to play on equal footing with men.

The Magna Carta of Women which is also known as RA 9710 also served as
anchor for this local legislation.

In sum, Ordinance No. 02, S-2023 solidifies the intent of our Constitution and
empowers women, children and members of the indigenous community by
providing Women’s and Children’s Desks, Integrated gender sensitive and
environment- Friendly Zonification Plan which immediately cater and hear their
needs and concerns. All these are plausible materialization, in the local government
setting, of the very intent of our Law.

Thus, Ordinance No. 02, S-2023 is Constitutional.
