WHEREAS, Section 2 of Republic Act No. 9646 or otherwise known as "An Act
Regulating the Practice of Real estate Service in the Philippines, Creating for the
Purpose A Professional Regulatory Board of Real Estate Service, Appropriating Funds
Therefor and for Other Purposes” states that the state recognizes the vital role of real
estate service practitioners in the social political, economic development and progress
of the country by promoting the real estate market, stimulating economic activity and
enhancing government income from real property-based transactions. Hence, it shall
develop and nurture through proper and effective regulation and supervision a corps of
technically competent, responsible and respected professional real estate service
practitioners whose standards of practice and service shall be globally competitive and
will promote the growth of the real estate industry;
WHEREAS, Joint Memorandum Circular No. 01 series of 2021 with the subject
“Creation of the Anti-Illegal Real Estate Practices (AIREP) Inter-Agency Task Force at
the National, Regional, and Local Levels and Providing for Mechanisms to Address
Illegal Real Estate Transactions,” mandates all Cities and Municipalities to organize a
Local Task Force on Anti-Illegal Real Estate Practices to lead in ending the illicit
practices of unscrupulous developers, real estate brokers, agents, and salespersons
engaged in the illegal selling of subdivision houses and/or lots, condominium units, and
memorial lots.
NOW, THEREFORE, I, ENGR. ANGEL ARAS SIA, JR., Municipal Mayor of
La Paz, Leyte, by virtue of power vested upon me by law, do hereby order the creation
of Anti-Illegal Real Estate Practices Local Task Force in this municipality/city.
Section 1. COMPOSITION:
Section 2. FUNCTIONS.
1. Implement the plans, programs, and projects cascaded to it by the National and
Regional Task Forces;
2. Coordinate and monitor the execution of the provisions of the JMC No. 01 series
of 2021 at the LGU level;
3. Coordinate closely with the Regional Task Force and enter into a Memorandum
of Understanding with the latter to ensure the effective implementation of JMC
No. 01 series of 2021;
4. Submit regular status reports on the progress of the implementation of the
provisions of the JMC No. 01 series of 2021, as well as its policy
recommendations, to the Regional Task Force;
5. Conduct information, education, and communication activities to increase the
awareness of the public on the modus operandi of real estate scammers;
6. Promptly file and prosecute cases concerning violations of Republic Act No.
9646, Republic Act No. 11201, Presidential Decree No. 957 and other related
laws, provide legal assistance to law enforcers, and ensure the availability of
public attorneys for the protection of individual’s rights;
7. Assist the LGUs in the formulation of programs, projects, or activities in relation
to addressing and protecting the public from illegal real estate practices; and
8. Perform such other functions consistent with the provisions of the JMC No. 01
series of 2021 or as may be directed/delegated by the National or Regional Task
Force.
